Abstract

The E-Court application is a form of service in the form of E-Government to Citizen, which aims to save time and costs for justice seekers. However, the implementation of E-Court and E-Litigation needs to be understood by the public so that the realization of Efficiency is in line with the goals of simple, fast, and low-cost principles. The research method used is a normative method with a juridical and conceptual approach. The results show that to increase the role of the community in the implementation of the E-Court, the court socializes the implementation of the E-Court in accordance with PERMA No. 7 of 2022. The form of efficiency of the implementation of E-Court and E-Litigation is in the form of simplifying administration, implementing E-Litigation, and a definite and clear trial schedule.

Abstract

Tulisan ini membahas tentang bentuk perlindungan hukum terhadap konsumen bahan bakar minyak (BBM) pertamax yang disediakan oleh Pertamina. Perlindungan yang dianalisa adalah terkait kasus tindak pidana korupsi (Tipikor) yang dilakukan oleh beberapa petinggi Pertamina maupun anak Perusahaan Pertamina. Tindakan tersebut mengakibatkan kerugian kepada konsumen pengguna pertamax karena tindakan yang dilakukan adalah mengubah komposisi bahan bakar pertamax yang seharusnya dengan spesifikasi Ron-92, ternyata di oplos menjadi campuran Ron-89 dan Ron-90. Metode penelitian yang dilakukan adalah metode pendekatan yuridis normatif, yaitu suatu metode hukum yang dilakukan dengan meneliti bahan pustaka atau data sekunder yang berhubungan dengan Perlindungan Konsumen Pertamax Pertamina dalam Tindak Pidana Korupsi PT. Pertamina. Peran negara dalam memberikan kepastian hukum terhadap kerugian yang dialami konsumen BBM Pertamax sangat dibutuhkan. Hal ini bertujuan untuk mewujudkan asas kepastian hukum terhadap konsumen yang dirugikan.

Abstract

Health expenditure is a fundamental obligation of the state, as healthcare is an essential public service that must be provided to its citizens, particularly to lower- and middle-income groups. The allocation of the health budget, both in terms of amount and percentage, cannot be altered without undergoing a legislative process and must comply with minimum constitutional requirements. With the enactment of Law No. 17 of 2023 on Health, the provision mandating compulsory health spending has been removed. This change represents a significant regression compared to the previous Law No. 36 of 2009 on Health, which guaranteed a fiscal allocation of at least 5% of the national budget (APBN) for the health sector. The research employs a normative legal method, drawing on conceptual and statutory approaches. The findings indicate that, according to the World Health Organization (WHO), mandatory health spending of only 4–5% of the Gross Domestic Product (GDP) is tough to sustain. Therefore, governments are encouraged to allocate at least 5% of their GDP to mandatory health spending. Indonesia’s decision to eliminate this mandatory spending poses a substantial risk of neglecting public health financing, especially for vulnerable groups. Ultimately, this may hinder adequate access to healthcare services and reduce both the quantity and quality of health programs for the general population.
