Abstract

The culture of thought that is still traditionalist in most Islamic boarding schools raises questions about the relevance in the modern era. The use of yellow books as the main reference is considered extremely classic and generally in facing the complexity of modern society problems. Therefore, this study aimed to examine the contextualization of fiqh mu’amalat in the classic text of yellow book at Sidogiri Islamic Boarding School as one of the agendas of Halaqah Fiqh of Civilization. This was a qualitative study with primary data collected through observation and interview, while the secondary data was from literature studies on scientific writing references. Primary data included the results of interviews with the chairman of the supervisory board, the chairman of Bahtsul Masail, and the secretary of Islamic boarding school as well as observations of the business development activities of Islamic boarding school. Meanwhile, secondary data was in the form of written sources regarding the contextualization of fiqh mu’amalat supported by various references to books, journal articles, and other related documents. The results showed that the contextualization of fiqh mu’amalat at Sidogiri Islamic Boarding School was conducted through the elaboration of classic text (yellow book) with the reality of mu’amalat in modern society. Consistency in integrating the teachings of Salaf in the books of classical Ulema has succeeded in maintaining the application of the mu’amalat principles in every development of business units. The contextualization of fiqh Salaf started by making Bahtsul Masail an intellectual forum to answer the problems of mu’amalat in society. The results were actualized by making it a practical reference in every contract conducted in Islamic Boarding School Cooperative (Kopontren) business unit, Basmalah Store, and Baitul Mal wat Tamwil (BMT). The success of the economic empowerment confirmed that fiqh in Islamic boarding schools was not only studied dogmatically. This also showed the openness of Islamic boarding schools to accept progressive ideas in seeing new civilizations with their classical values. In conclusion, this study was expected to be an academic reference that pioneered the renewal of fiqh mu’amalat in the digital era.

Abstract

Text is one of the most important elements for Muslims. It not only acts as a symbol but also a representation of authority that connects family identity among Muslim communities. In the world of pesantren (Islamic boarding schools), ijtihad is one means of reproducing text authority, including in the fiqh mu’amalah. The article aimed to examine the authority of the text in the ijtihad of the fiqh mu’amalah of Islamic boarding schools in Indonesia. The article is the result of library research with a qualitative descriptive research design. Meanwhile, the research objects studied and examined were related to text and authoritative power in the ijtihad of santri (Islamic students) in pesantren (Islamic boarding schools). The study showed that as authoritative power, santri plays a role in transferring the text of the kitab kuning (yellow book) in the discourse of fiqh muamalah, both explicitly (qawli) and implicitly (ilhaqi), as legitimacy for the decisions made in the bahthsul masail forum. Based on the concept of El-Fadl’s authority, the role of santri as the authoritative power of the text in ijtihad is based on five foundations, honesty and openness, sincerity in understanding "God’s will" in the text, the principle of comprehensiveness, rationalization of interpretation and search for "God’s command," and the ability to self-control in ijtihad. This study recommends that the bahsul masa’il methodology be preserved, either in the pesantren environment or formal education, affiliated with the pesantren. So, the religious texts are interpreted and read properly according to their context.

Abstract

This study examines the sharia tourism policy in Banten Province related to the preservation of Islamic educational values, local cultural heritage, and modern challenges in the implementation of sharia tourism policies. This articles also aims to increase the competitiveness of Banten as a halal tourism destination in Indonesia and attract Muslim tourists from within and outside the country. The research method uses sociological juridical. The results of the study indicate that the sharia tourism policy in Banten contributes significantly to maintaining Islamic educational values and local cultural identity. However, the legal policy also poses challenges in creating an inclusive tourism environment, especially for non-Muslim tourists and local communities such as the Baduy indigenous community. There is a potential for exclusivity that can limit Banten's appeal to a wider range of visitors and affect the economic sustainability of local businesses that depend on diverse tourists. A balance between economic growth, preservation of Islamic values and cultural diversity is needed to create a sustainable, inclusive and adaptive tourism model to local socio-cultural dynamics.

Abstract

This study explores the reform of Indonesian marriage law through the lens of maqasid al-usrah, the family-centered objectives within Islamic legal theory. It critically assesses whether key legal reforms such as marriage registration, minimum age requirements, regulation of divorce, and prenuptial asset arrangements align with the ethical aims of Islamic family law, including the protection of lineage, dignity, justice, and family welfare. Employing a qualitative library research method, the paper draws on classical Islamic jurisprudence, statutory legal documents, court practices, and the analytical framework of Jamaluddin al-Athiyya. It finds that while Indonesian legislation increasingly incorporates maslahah (public benefit) and maqasid reasoning to justify reforms, the implementation often falls short due to bureaucratic barriers, legal pluralism, and social inequality. For instance, minimum age laws are undermined by widespread judicial dispensations, and formal protections for women are diluted by enduring patriarchal norms and unequal access to justice. The study argues that maqasid al-usrah has been invoked more as a justificatory narrative than as a fully operational legal method. It concludes that meaningful application of maqasid requires not only legal reform but also structural, procedural, and cultural transformation to ensure that laws genuinely promote justice, protect the vulnerable, and reflect the dynamic needs of Indonesian Muslim society. This research contributes to the growing discourse on maqasid-based legal reform and offers a practical framework for evaluating future policy developments in Islamic family law.

Abstract

The development of communication technology has driven a transformation in Islamic preaching from one-way sermons to two-way interactive discussions. This shift represents not only a change in medium but also in communication paradigm, positioning the audience as active participants in the delivery of religious messages. This study aims to analyze the characteristics of interactive da’wah using content analysis on digital platforms such as YouTube and TikTok. Employing a qualitative descriptive approach, this study examined 20 popular da’wah contents featuring preacher–audience interaction. The findings reveal that interactive da’wah emphasizes dialogical participation, spontaneous response, and the use of digital media as an open discussion space. This model enhances emotional engagement while shifting religious authority from a top-down to a participatory model. In conclusion, interactive da’wah represents a new form of Islamic communication adapted to the digital communication culture of modern society.
