Abstract

Dinamika kekerasan seksual terhadap anak di Indonesia, terkhusus di konteks pemerkosaan, telah mencapai taraf yang sangat memprihatinkan. Rata-rata terjadi satu kejadian pemerkosaan setiap empat jam. Ada dua pendekatan yang dipergunakan guna menangani tindak pidana kekerasan seksual. Pertama, adanya hukuman pidana yang berat bagi pelaku kekerasan seksual pada anak. Kedua, upaya pemulihan bagi anak korban kekerasan seksual berupa restitusi. Perubahan hukum pidana dapat mengakibatkan perubahan masyarakat dengan memberikan kompensasi atau restitusi ke anak yang menjadi korban tindak pidana. Tujuan riset ini yakni menganalisis Implementasi Hak Restitusi Bagi Korban Kekerasan Seksual Anak Menurut PP RI No. 43 Tahun 2017 serta mengkaji Penerapan Restorative Justice Melalui Pemenuhan Restitusi Pada Korban Tindak Pidana Anak. Riset ini mempergunakan jenis penelitian kepustakaan (Library Research) dengan pendekatan normatif. Hasil penelitian menunjukan Pengaturan restitusi bagi anak korban tindak pidana menurut PP RI No. 43 Tahun 2017 merupakan hak anak yang menjadi korban tindak pidana. Kesediaan dan peran serta korban, pelaku, serta masyarakat pada proses perbaikan tindak pidana merupakan komponen utama penerapan restorative justice dalam kejahatan anak.

Abstract

Judges are always faced with concrete events, conflicts or cases that must be resolved or resolved and for this reason the law needs to be found. Right against the law is a legal principle that allows judges to override norms in statutory regulations because the relevant statutory regulations are not in accordance with the values ​​of justice and social conditions of society on condition that they must be based on rational legal arguments. Example of a judge's decision that applies right against the law namely SAS who was sentenced to death for committing sexual abuse and rape against children. This research uses normative juridical research with secondary data support. The results of this research are that a judge, in examining, adjudicating and deciding a case before him, must first use written law, but if the written law according to the judge's belief does not produce justice and truth, then the judge can implement it. right against the law Judges in handling cases of sexual abuse and rape against children can apply the death penalty to the perpetrator right against the law namely overriding norms in statutory regulations because the relevant statutory regulations are not in accordance with the values ​​of justice and the social conditions of society.

Abstract

Customary law existed long before Indonesia became independent. This system is a reflection of the noble values ​​believed in by indigenous peoples, such as mutual cooperation, kinship and respect for others. This research aims to analyze the principles of customary law that can be integrated into the formal justice system to support the development of a restorative justice system in Indonesia and the main challenges faced in implementing customary law as part of the restorative justice system in Indonesia and how to overcome them. The research method uses normative research methods and secondary data. Integration of customary law principles into the formal justice system can be done in various ways, such as adopting restorative principles, building hybrid models, increasing recognition of legality, involving communities, aligning with human rights, and applying local approaches in certain cases. The implementation of customary law as part of the restorative justice system in Indonesia faces various challenges, but with a strategic and adaptive approach, these challenges can be overcome.

Abstract

This study analyzes the strengthening of the presumption of innocence principle in Indonesia's criminal justice system to prevent wrongful arrests by the police. Using normative legal research methods with statutory and conceptual approaches, the study examines primary legal sources (Criminal Procedure Code, Police Law), secondary (legal literature), and tertiary materials. Findings reveal three main issues: (1) regulatory weaknesses including unclear standards for preliminary evidence and excessive discretionary authority, (2) confession-oriented investigative culture, and (3) lack of effective victim recovery mechanisms. The research proposes comprehensive solutions including: regulatory reform through improved evidence standards and judicial review mechanisms, transformation of investigative culture through human rights-based training, strengthening of independent oversight, and implementation of technology for procedural transparency. These solutions require an integrated approach incorporating adapted global best practices such as the warrant system (UK) and Miranda rights (US) modified for local context. Expected outcomes include a fairer criminal justice system with reduced wrongful arrests, enhanced professional standards for law enforcement, and comprehensive protection of suspect rights. The study makes significant contributions to the development of due process theory and judicial system reform in Indonesia. The proposed multidimensional approach balances effective law enforcement with human rights protection, offering practical policy recommendations for creating a justice system that upholds the rule of law while maintaining public trust. Implementation requires political commitment, institutional capacity building, and phased technological integration over a five-year roadmap.

Abstract

The values ​​of Pancasila are starting to fade in the younger generation, namely the rampant brawls that occur between students, then the western way of dressing, attitudes and manners that are far from Indonesian customs and culture. The rampant cases of murder, theft, hoax cases and the worsening use of good and correct Indonesian because the younger generation prefers to use slang and the rampant behavior that deviates from customary values. Therefore, we, the Community Service Activity Implementation Team, want to share the knowledge we have with YPPK Teruna Bakti High School Students regarding the Strengthening of Pancasila Values ​​in High School Students.

Abstract

The policy proposal by the West Java Provincial Government to introduce mandatory military training for problematic students has sparked public debate concerning its legality, effectiveness, and the state’s approach to addressing juvenile delinquency. This paper analyzes the policy from a legal perspective, particularly in relation to human rights law and the principles embedded in the national education system. Using a normative juridical method with a conceptual and statutory approach, the study finds that the policy potentially violates children's rights, as well as the principles of non-discrimination and fairness in education. Moreover, the coercive approach through military training is deemed incompatible with the spirit of character development, which should be humanistic and participatory. The paper recommends that interventions for problematic students should focus on value-based education, counseling, and empowerment, rather than militarization. Public policy should ensure the protection of children's rights while upholding the principles of proportionality and appropriateness in disciplinary measures.

Abstract

Tindak pidana seksual oleh dokter terhadap pasien merupakan pelanggaran berat terhadap hukum dan etika profesi kedokteran. Penelitian ini bertujuan untuk menganalisis penerapan Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual (UU TPKS) terhadap dokter pelaku kekerasan seksual serta meninjau pelanggaran dari sisi etika profesi. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan undang-undang, konseptual, dan studi kasus. Hasil penelitian menunjukkan bahwa UU TPKS memberikan dasar hukum kuat, namun penerapannya masih terkendala pembuktian, relasi kuasa, dan lemahnya dukungan institusi. Dari sisi etik, tindakan seksual oleh dokter melanggar prinsip otonomi, non-maleficence, dan beneficence. Selain itu, mekanisme etik yang tertutup serta minimnya perlindungan korban memperlihatkan pentingnya sinergi antara hukum pidana dan penguatan etika profesi dalam mewujudkan sistem layanan kesehatan yang adil dan aman

Abstract

Eradicating corruption is a top priority to improve people's welfare and strengthen the Unitary State of the Republic of Indonesia (NKRI) and in order to achieve national goals. Therefore, the policy of optimizing corruption eradication must be followed up with a comprehensive, integral, and holistic strategy in order to truly achieve the expected results. Prevention and preventive actions will be more useful in overcoming corruption problems than taking high legal sanctions. This shows that corruption prevention must be optimized properly in eradicating corruption in Indonesia. Therefore, providing knowledge to High School Students in Jayapura City, Papua Province about how to prevent Corruption is very important so that they can avoid themselves from Corruption
