Abstract

Penerapan sistem zonasi dalam Penerimaan Peserta Didik Baru (PPDB) di Indonesia menimbulkan berbagai permasalahan sosial dan moral. Meskipun sistem zonasi telah diatur dalam Peraturan Menteri Pendidikan dan Kebudayaan Republik Indonesia Nomor 1 Tahun 2021 tentang PPDB, ketentuan ini tidak dijelaskan dalam Pasal 51 ayat (1) UU No. 20 Tahun 2003 tentang Sistem Pendidikan Nasional (UU Sisdiknas), yang justru memberikan otonomi kepada sekolah melalui prinsip Manajemen Berbasis Sekolah. Penelitian ini menggunakan metode normatif dengan pendekatan perundang-undangan dan konseptual, mengandalkan data sekunder serta bahan hukum primer berupa Permen PPDB dan UU Sisdiknas. Teknik pengumpulan data dilakukan melalui studi pustaka yang menganalisis kedua regulasi tersebut. Hasil penelitian menunjukkan adanya ketidaksesuaian antara Permen PPDB dan UU Sisdiknas, yang menyebabkan berbagai masalah sosial dan moral bagi calon peserta didik serta orang tua. Ketidaksinkronan kebijakan ini mendorong sebagian masyarakat bertindak melawan hukum dan norma sosial karena perbedaan persepsi terhadap sistem zonasi.

Abstract

The position of administrative law in Indonesia does not have a special place compared to other fields of law. This is an important problem, that administrative law does not have a standard codification of general administrative law, like criminal law  which has the Criminal Code and civil law which has the Civil  Code. The last few decades have been very interesting regarding  the contrast in Law Number 30 of 2014 concerning Government Administration which is believed to be material law in the State Administrative Court. The debate about this rule is related to the conflict of norms between articles and other articles in it, according to the author that the rule is a manifestation of the concept of government management and not the rules of general administrative law. So this research needs to be studied through normative legal research methods with a statutory approach and conceptual approach. The results show that there are conflicts of norms and conflicts of rules. Abstract

The development of legal science is very rapid, especially in the aspect of administrative law as the first law enforcement part of other laws. So that in the theory of administrative law is inseparable from human rights, therefore the State Administrative Court is very narrow in its authority in terms of competence in handling administrative cases. Meanwhile, the Conseil d'État, which is the French administrative court, has the authority that all government actions can be disputed at the Conseil d'État. So with the concept of the idea, this research uses normative research methods with a statutory approach, conceptual approach, and comparative approach. This research examines the concept of the competence of the Conseil d'État as a measure of the expansion of competence by the Indonesian state administrative court. Thus this research will conclude the idea that it is important to amend Law No. 51/2009 on State Administrative Courts and also Article 87 of Law No. 30/2014 on Government Administration which has an open norm regarding the concept of factual actions.
