Abstract

Unidentified space debris poses a significant threat to the sustainability of space exploration and the safety of astronauts. As the number of artificial objects in Earth's orbit increases, the risk of collisions and damage to operational satellites and spacecraft also grows. This study examines the legal and security challenges in mitigating unidentified space debris using a normative approach, analyzing key international treaties such as the Treaty on Principles Governing the Activities of States in the Exploration and Use of Outer Space, including the Moon and Other Celestial Bodies (Outer Space Treaty 1967), the Convention on International Liability for Damage Caused by Space Objects 1972 (Liability Convention 1972), and the Agreement on the Rescue of Astronauts, the Return of Astronauts and the Return of Objects Launched into Outer Space 1967 (Rescue Agreement 1967). While these treaties establish a legal framework for space object responsibility, gaps remain in ownership attribution and enforcement mechanisms, particularly for unidentified debris. Additionally, limited monitoring technology hampers effective collision risk mitigation. To address these challenges, stronger international regulations, the development of more precise tracking technologies, and enhanced global cooperation in space debris removal efforts are essential to maintaining the safety and sustainability of future space missions.

Abstract

Tujuan penelitian ini dilakukan untuk mengetahui dan menganalisis tentang implementasi Regional Comprehensive Economic Partnership di indonesia menurut hukum internasional, mengetahui pengaturan RCEP menurut konvensi wina 1969 tentang perjanjian internasional. Dengan menggunakan jenis penelitian hukum normatif dan bersifat preskriptif analitis. Pendekatan yang digunakan menggunakan pendekatan ketentuan konvensi internasional dan pendekatan konseptual. Hasil penelitian menyimpulkan bahwa keikutsertaan Indonesia dalam perjanjian Regional Comprehensive Economic Partnership berdampak pada ekspor RCEP dapat meningkatkan akses pasar bagi produk-produk Indonesia, mempecepat arus investasi asing langsung, dan memperkuat peran Indonesia dalam rantai pasok global. Namun, di sisi lain, persaingan dengan produk impor yang lebih murah serta ketimpangan daya saing Industri domestik. Peran konvensi wina 1969 memberikan kepastian hukum sebagai acuan untuk memastikan bahwa perjanjian RCEP tersebut sesuai dengan asas pacta sunt servanda dan itikad baik.

Abstract

The sea fence phenomenon at Pantai Indah Kapuk 2 (PIK 2) raises legal issues related to reducing community access and adverse impacts on the environment. This research aims to conduct a further study of legal violations arising from the sea fence incident. This research was conducted by analyzing and systematizing the data and information obtained qualitatively. Data on legal violations due to the sea fence phenomenon were collected using the literature study method. The data collected was analyzed using normative legal methods with a statutory and conceptual approach. The results of this study inform that the phenomenon of sea fencing violates various provisions of Indonesian laws and regulations. Furthermore, the sea fencing phenomenon is also identified as contradicting the principles of sustainable marine resource management and potentially violating the state’s obligation to protect and preserve the environment as per Article 192 of UNCLOS 1982.

Abstract

This research examines North Korea's violation of the principle of good faith under the Nuclear Non-Proliferation Treaty (NPT) and its legal consequences. The main issue addressed in this study is North Korea’s breach of the good faith principle within the framework of the NPT, which raises legal implications regarding its status and obligations as a party to the treaty. Although North Korea was formally bound by the NPT, it secretly developed a nuclear weapons program, demonstrating non-compliance with the fundamental principle of international treaty implementation. This issue was further exacerbated by its refusal to allow inspections by the International Atomic Energy Agency (IAEA) and its unilateral withdrawal from the NPT, which has sparked debate over the legitimacy and legality of such action.Using a normative juridical approach, this study analyzes North Korea’s clandestine development of nuclear weapons while still a member of the NPT, as well as the validity of its withdrawal from the treaty. The findings show that North Korea violated the principle of good faith through its secret nuclear program, refusal of IAEA inspections, and withdrawal that did not meet the requirements of Article X of the NPT. The withdrawal may be deemed invalid as it was conducted in bad faith and without fulfilling the treaty's formal provisions. The legal consequences include the continued applicability of obligations under the NPT and state responsibility for breaches of international law. Ideal forms of accountability include the cessation of the nuclear program, payment of reparations, guarantees of non-repetition, and renewed compliance with NPT provisions through verifiable denuclearization.

Abstract

Sentralisasi kewenangan dalam sektor mineral dan batubara pasca berlakunya Undang-Undang Nomor 3 Tahun 2020 menimbulkan implikasi yuridis terhadap pelaksanaan otonomi daerah, khususnya dalam aspek pengawasan dan pengendalian kegiatan pertambangan. Penelitian ini bertujuan untuk menganalisis implikasi yuridis sentralisasi kewenangan terhadap efektivitas koordinasi antara pemerintah daerah dan pemerintah pusat, serta menilai efektivitas penegakan hukum lingkungan terhadap aktivitas pertambangan di Kabupaten Lebong, khususnya di kawasan penyangga Taman Nasional Kerinci Seblat (TNKS). Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa sentralisasi kewenangan telah mengurangi peran pemerintah daerah dalam pengawasan, sehingga menimbulkan celah pengendalian terhadap aktivitas pertambangan tanpa izin (PETI). Selain itu, penegakan hukum lingkungan belum berjalan efektif karena masih bersifat represif, parsial, dan belum menyentuh akar permasalahan. Oleh karena itu, diperlukan penguatan koordinasi antarinstansi, optimalisasi instrumen penegakan hukum, serta kebijakan alternatif bagi masyarakat guna mendukung pengelolaan sumber daya alam yang berkelanjutan.

Abstract

Penelitian ini bertujuan untuk menganalisis pengaturan hukum laut internasional dan hukum nasional Indonesia dalam penegakan hukum di Zona Ekonomi Eksklusif (ZEE), serta mengkaji pelaksanaan dan kendala penegakan hukum terhadap pelanggaran oleh kapal asing di Laut Natuna Utara. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan, kasus, dan konseptual. Bahan hukum yang digunakan meliputi UNCLOS 1982, peraturan perundang-undangan nasional, serta putusan Permanent Court of Arbitration (PCA) tahun 2016. Hasil penelitian menunjukkan bahwa secara normatif Indonesia memiliki dasar hukum yang kuat dalam menegakkan hukum di ZEE, baik berdasarkan UNCLOS 1982 maupun hukum nasional. Namun, dalam praktiknya, penegakan hukum menghadapi berbagai kendala, seperti keterbatasan sarana pengawasan, tumpang tindih kewenangan antar lembaga, serta tekanan geopolitik akibat klaim sepihak China di Laut Cina Selatan. Pelaksanaan penegakan hukum telah dilakukan melalui patroli, penangkapan kapal, dan langkah diplomasi, tetapi efektivitasnya belum optimal. Maka penegakan hukum di Laut Natuna Utara memerlukan penguatan kapasitas pengawasan maritim, peningkatan koordinasi antar lembaga, serta strategi diplomasi yang konsisten guna menjaga kedaulatan dan kepentingan nasional Indonesia.

Abstract

Indonesia, as an archipelagic nation with a vast marine territory, possesses significant coral reef ecosystems, including those in Bengkulu. However, the condition of coral reefs in Bengkulu has suffered damage due to human activities and natural factors. The Bengkulu Provincial Government issued Regional Regulation Number 5 of 2019 concerning the Management of Coastal Areas and Small Islands as a protective measure, but the effectiveness of its implementation has not been optimal. This research aims to analyze the implementation of this Regional Regulation in the protection of coral reefs in Bengkulu waters and to identify the challenges faced. Employing a normative legal research method with a literature study, this research examines laws and regulations, scientific literature, and related news. The research results indicate that the Regional Regulation has been implemented through various programs such as coral reef restoration, marine debris management, and socialization. However, its effectiveness is hampered by a lack of public awareness, weak supervision, and insufficient control over tourism activities. Further efforts are needed to increase public awareness, strengthen supervision, and manage tourism activities sustainably to achieve effective coral reef protection in Bengkulu.

Abstract

The limited number of studies on the synchronization of policies for protecting traditional fishers within the framework of the blue economy indicates the need for studies that examine the interrelationship among regulations, ecosystem degradation, economic inequality, and the sustainability of traditional fishers’ livelihoods. This study aimed to analyze the effectiveness of fisher protection regulations and explore sustainability-based economic empowerment strategies in the coastal areas of Bengkulu. This study used a descriptive qualitative approach, with the research location in the coastal areas of Bengkulu selected using purposive sampling. Data were collected through in-depth observation of conflicts over fishing area claims between trawl fishers and traditional fishers in Seluma Regency, Bengkulu Province, and were then analyzed using thematic analysis. The results showed that the dominant factors influencing the conflict were weak enforcement of sanctions against the use of trawl fishing gear and the absence of participatory supervision by the competent authorities, which prompted traditional fishers to take self-help actions to protect their fishing areas. This finding reinforces the theory of legal pluralism, which highlights the gap between formal state law and the practice of living law carried out by communities in the field. Thus, integrated supervision of coastal areas between the government and fishing communities is the key to reducing conflict and creating legal certainty for traditional fishers. The implications of this study include enriching the literature on maritime legal sociology in Bengkulu and providing practical recommendations for the Regional Government of Seluma Regency to strengthen fishing area zoning through regional regulations that accommodate the rights of traditional fishers.

Abstract

Illegal fishing in the North Natuna Sea after 2020 remains a serious threat to Indonesia’s maritime sovereignty and the sustainability of national marine resources. This area has a strategic position, is rich in fishery resources, and directly borders several countries, making it vulnerable to illegal fishing activities by foreign vessels. This study aims to analyze the effectiveness of law enforcement against illegal fishing in the North Natuna Sea after 2020, identify the obstacles encountered, and formulate strategies for strengthening maritime law enforcement policies. This study used a normative juridical method with statutory and case approaches. Data were obtained through a literature review of relevant regulations, official reports, and scientific literature. The results showed that the Indonesian government has strengthened law enforcement efforts through integrated maritime patrols, interagency cooperation, the implementation of stricter sanctions, and the reinforcement of the roles of authorities such as the Indonesian Navy (TNI AL) and the Ministry of Marine Affairs and Fisheries. However, the effectiveness of law enforcement still faces obstacles in the form of limited facilities and infrastructure, the vastness of the surveillance area, and international political pressure. These findings confirm that a diplomatic approach remains necessary to maintain maritime sovereignty without triggering open conflict. Thus, law enforcement against illegal fishing in the North Natuna Sea requires a comprehensive and sustainable strategy through regulatory strengthening, capacity building for law enforcement officials, and the optimization of regional and international cooperation. This study contributes to the development of more effective maritime policies for addressing illegal fishing in Indonesian waters.
