Abstract

This study aims to determine and analyze the implementation of the provisions of the Islamic Law Compilation regarding the distribution of inheritance to orphans who are victims of natural disasters who are in guardianship. To find out and analyze the role of the notary in the implementation of the distribution of inheritance to orphans victims of natural disasters who are in guardianship. And to find out and analyze the obstacles and solutions to the distribution of inheritance experienced by orphans who are victims of natural disasters who are in guardianship. The research method used in this research is juridical empirical, while the data collection method uses library research and field research. The data analysis method was carried outqualitative then presented descriptively. This research resulted in the main notary's responsibility in making inheritance deeds for the share of orphans who are victims of natural disasters who are in guardianship, still following the perspective provisions of Article 106 of Act No. 23 of 2006 as amended by Act No. 24 of 2013 concerning Population Administration. , because population classification has no longer been applied since the enactment of the Population Administration Law. Notaries have the authority to make a Certificate of Inheritance regardless of population classification. The authority of the Notary in making the Certificate of Inheritance for Indonesian Citizens is based on the provisions of Article 15 of the UUJN, so that the Certificate of Inheritance for Indonesian Citizens is made in the form of this authentic deed based on the provisions of Article 1868 of the Civil Code. The role of the notary in making SKW is only to confirm that the existence of an SKW is very authentic evidence. In addition, the role of the notary in the distribution of Islamic inheritance, but the one who has full authority to determine legal recognition and termination is the Religious Court. Notary in the distribution of inheritance plays a role in making the Deed of Inheritance Statement and Certificate of Inheritance Rights. If there is a dispute, the notary can make peace deeds and/or an agreement to relinquish the rights of claim. Abstract

Marriage is an important moment in human life that involves not only individuals, but also society. In the legal context, marriage creates a legal bond, resulting in a number of obligations and rights between husband, wife, and children. Birth certificates of illegitimate children are a crucial issue, especially in the context of legal justice in Indonesia. This study aims to analyze the implementation of regulations related to birth certificates of illegitimate children without a marriage certificate, with a focus on existing weaknesses and how Islamic justice values ​​can be integrated. The research method used is a descriptive analytical approach with primary and secondary data collection, including interviews and observations. The results of the study indicate that there are still many illegitimate children in Semarang City who do not have birth certificates, caused by factors such as inconsistencies in Family Card data, low public awareness, and slow administrative processes. In addition, the social stigma that considers illegitimate children as illegitimate children hinders the protection of their rights. Therefore, it is necessary to increase legal awareness and improve the administrative system by the government to ensure justice and protection for all children, in accordance with the values ​​of Pancasila which emphasize social justice. This study is expected to contribute ideas to the development of civil law in Indonesia.

Abstract

The transformation of Pancasila cultured school is a strategic step in realizing education that reflects the noble values of the Indonesian nation. This research aims to examine the implementation of Pancasila ethics and values in the educational process at SMK Pancasila, as an effort to strengthen students' character and create a learning environment based on national values. Through a qualitative approach, this study analyzes the implementation of Pancasila values, such as Gotong Royong, Social Justice, and Unity, in various aspects of school life, both in learning, extracurricular activities, and interactions between school members. The results showed that the implementation of Pancasila values in SMK Pancasila has had a positive impact in shaping the character of students who are noble, have a sense of responsibility, and care for others. However, challenges in the integration of Pancasila values still arise related to teaching consistency and active participation of all related parties. This study suggests the need to strengthen training for teachers and the involvement of parents and the community in supporting a school culture based on Pancasila.   Abstrak Transformasi sekolah berbudaya Pancasila merupakan langkah strategis dalam mewujudkan pendidikan yang mencerminkan nilai-nilai luhur bangsa Indonesia. Penelitian ini bertujuan untuk mengkaji implementasi etika dan nilai Pancasila dalam proses pendidikan di SMK Pancasila, sebagai upaya untuk memperkuat karakter siswa dan menciptakan lingkungan belajar yang berbasis pada nilai-nilai kebangsaan. Melalui pendekatan kualitatif, penelitian ini menganalisis penerapan nilai Pancasila, seperti Gotong Royong, Keadilan Sosial, dan Persatuan, dalam berbagai aspek kehidupan sekolah, baik dalam pembelajaran, kegiatan ekstrakurikuler, maupun interaksi antarwarga sekolah. Hasil penelitian menunjukkan bahwa implementasi nilai Pancasila di SMK Pancasila telah memberikan dampak positif dalam membentuk karakter siswa yang berakhlak mulia, memiliki rasa tanggung jawab, dan peduli terhadap sesama. Namun, tantangan dalam integrasi nilai Pancasila masih muncul terkait konsistensi pengajaran dan partisipasi aktif seluruh pihak terkait. Penelitian ini menyarankan perlunya penguatan pelatihan bagi guru dan keterlibatan orang tua serta masyarakat dalam mendukung budaya sekolah yang berlandaskan Pancasila.

Abstract

If we observe the existing legal system in Indonesia, there is a foundational legal principle that is deeply rooted in the country, namely Bhinneka Tunggal Ika, which means "Unity in Diversity." Within Bhinneka Tunggal Ika lies the emblem of Pancasila as the cornerstone of Indonesia's national legal foundation. The values contained in Pancasila are reflected in its five principles: religious values in the first principle, humanitarian values in the second, unity in the third, democracy in the fourth, and justice in the fifth principle. Thus, society believes that the character of the Indonesian nation is embodied in Pancasila. Thought can be seen as an effort to deeply and seriously reflect on the body of knowledge and the values of Pancasila that have developed in the implementation of education in the era of globalization, which are subsequently formulated into a concept or theory. Education in Indonesia is seen as being less grounded in character education based on Pancasila, and instead tends to prioritize or even boast of an education system that focuses merely on cognitive logical reasoning.   Abstrak Jika memperhatikan hukum yang ada di Indonesia selama ini terdapat dasar hukum yang sangat melekat erat pada Indonesia yaitu Bhinneka Tunggal Ika yang artinya berbeda-beda tetapi tetap satu, Dimana dalam Bhinneka Tunggal Ika terdapat simbol Pancasila sebagai prasasti dasar hukum negara Indonesia. Nilai nilai yang terkandung dalam Pancasila ada 5 sila. Nilai keagamaan yaitu dalam sila 1, nilai kemanusiaan dalam sila 2, nilai persatuan dalam sila ke 3, nilai kerakyatan dalam sila 4 dan yang terakhir  nilai keadilan dalam sila 5. Dengan demikian Masyarakat menganggap bahwa karakter bangsa Indonesia tercermin melalui Pancasila. Pemikiran dapat dipandang sebagai suatu upaya untuk melakukan refleksi mendalam dan serius dalam menelaah ilmu pengetahuan serta nilai-nilai Pancasila yang berkembang dalam pelaksanaan pendidikan di era globalisasi, yang kemudian dirumuskan menjadi sebuah konsep atau teori. Pendidikan di Indonesia dianggap kurang berbasis pada pendidikan karakter Pancasila, melainkan lebih mendominankan atau menyombongkan pendidikan yang takabur pada keunggulan berpikir logika kognitif belaka.

Abstract

Child grooming cases experienced by children in Indonesia, particularly through digital platforms such as Instagram and WhatsApp, reflect the existence of normative gaps (lacunae) in the legal protection system for Generation Z amid the rapid digital era. This crime is carried out covertly and systematically by adults who manipulate victims. This research aims to formulate effective legal policy reforms to tackle the threat of child grooming, referring to the perspective of Islamic Law and the Convention on the Rights of the Child (CRC). This research uses a normative method with legislative, conceptual, and comparative approaches, supported by data in the form of national legal documents, Islamic legal literature (including the concepts of hifzh al-nafs and hifzh al-'irdh), and international legal instruments. The research findings show that national legislation has not explicitly regulated child grooming offenses, thus creating gaps in law enforcement. The scientific contribution of this study is to produce a comprehensive legal framework through synthesis between the principles of protection of honor and life in Islamic Law and the minimum standards of child protection in the CRC. It is concluded that legal policy reform is urgent, which must be realized by explicitly including the formulation of child grooming offenses in legislation. This reformulation not only closes interpretive gaps and ensures legal certainty, but also strengthens legal protection for Generation Z in digital spaces by uniting Islamic philosophical values and international standards
