Abstract

ABSTRACT Islam is the majority religion in Indonesia and plays a central role in shaping the country's social, cultural and political landscape. With more than 230 million adherents or about 87% of the total population, Indonesia has the largest Muslim community in the world. This phenomenon is often identified through the term Islam Nusantara, which describes a distinctly Indonesian form of Islam. The concept emphasizes harmony, mutual cooperation and tolerance, while adhering to the core teachings of Islam. This article aims to discuss the dynamics of thought between two groups of Muslims in Indonesia: visual Muslims (traditional) and virtual Muslims (modern). The study explores how these two groups understand Islam Nusantara and construct their identities. The research approach is conducted through a structured literature study and includes important methodological steps to achieve the objectives of the analysis. The research reveals significant differences between the two groups. Visual (traditional) Muslims are more inclined towards preserving local traditions as the core of religious practice, while virtual (modern) Muslims tend to accept global influences and focus on innovation and renewal in understanding religion.

Abstract

Negative campaigns in regional head elections have become a phenomenon that often appears, not only in Indonesia, but also in various other countries. In the perspective of Islamic law, this negative campaign practice can be linked to the principles of morality and ethics. This is mainly related to the prohibition on spreading slander (namimah), swearing (ghibah) and damaging individual honor. The results of the study show that negative campaigns in regional head elections that contain elements of slander, lies or insults clearly conflict with the values of justice, truth and morals that are upheld in Islam. On the other hand, criticism that is constructive, fact-based, and aims for the benefit of the people, is seen as acceptable in Islamic law, as long as it continues to comply with Sharia norms. This study suggests the importance of strengthening Islamic political ethics education for the community and prospective regional heads, with the aim of building a healthier and more dignified democratic process in accordance with Islamic teachings.

Abstract

Objective: To analyze the concept of mujmal and mubayyan in Ushul Fiqh and examine their implications for the process of legal istinbath and contemporary fatwa, emphasizing the importance of the bayan method in explaining the ambiguous meaning of the wording. Theoretical framework: This study uses the theoretical framework of Ushul al-Fiqh, especially the theory of the classification of shari'i words based on the clarity of meaning (mujmal and mubayyan) and the bayan method according to Imam al-Ghazali (al-Mustashfa), al-Amidi (al-Ihkam), as well as the approach of maqāṣid al-sharī'ah in the contextualization of law. Literature review: The mujmal word is understood as a word that requires additional explanation, while the mubayyan word has a clear meaning. Scholars such as al-Ghazali, al-Amidi, and Wahbah az-Zuhaili have discussed the forms of bayan and their functions in the legal istinbath. This study complements previous research by linking the concept to the context of contemporary fatwas. Methods: This research uses a qualitative method with a library research approach. Primary data sources are the classic books of ushul fiqh, while secondary data are obtained from contemporary literature, journal articles, and fiqh encyclopedias. The analysis is carried out through a descriptive-analytical approach with a focus on the structure of pronunciation and its relevance to modern legal problems. Results:  The pronunciation of mujmal and mubayyan has direct implications for the validity of the law. The mujmal recitation requires an explanation (bayan) before it is used as a legal basis, while the mubayyan recitation can be directly used as an argument. In the context of contemporary fatwas, the identification of the nature of the pronunciation is key in determining the ijtihad method and the maqashid approach. The Mufti is required to master the theory of lafazh as well as social reality so that the fatwa produced remains valid and contextual. Implications: Understanding the fazh of mujmal and mubayyan is important to strengthen the ushul fiqh curriculum and improve the accuracy of ijtihad and fatwa in dealing with modern legal issues. Novelty: This study integrates the theory of lafazh with the context of contemporary fatwas through the approach of maqāṣid al-sharī'ah, going beyond previous normative studies that tended to be theoretical.

Abstract

Objective: This study aims to compare textual (nashiyah) and contextual (siyaqiyah) approaches in Islamic education, both in terms of basic principles, methods of application, and their implications on the development of students' values and character. Theoretical framework: This study is based on the theoretical framework of Islamic interpretation, which distinguishes between text-based approaches (literal texts) and context-based approaches. Leading figures such as Azyumardi Azra, Fazlur Rahman (with the theory of double movement), and Amina Wadud provide an important foundation in understanding both approaches in the context of education and social religion. Literature review: Previous studies have shown that the textual approach emphasizes the literal and normative meanings of the Qur'an and Hadith, as affirmed by classical scholars such as Ibn Taymiyyah and Al-Ghazali. Meanwhile, the contextual approach considers the social, cultural, and historical background of the revelation of the text, as developed by Fazlur Rahman and Amina Wadud. Methods: This study uses a qualitative approach with an analytical descriptive method. Data were collected through a literature study that involved the analysis of various scientific literature, books, and articles relevant to the theme of textual and contextual approaches in Islamic education. The analysis is carried out systematically to identify the advantages, disadvantages, similarities, and differences between the two approaches. Results: The results of the study show that the textual approach is effective in maintaining the purity of Islamic teachings and providing legal certainty, but it is less adaptive to social changes. In contrast, contextual approaches are more flexible in dealing with the dynamics of the times and relevant to contemporary issues, but are prone to interpretations that deviate from the literal meaning. Both approaches have their respective relevance and effectiveness, and complement each other in Islamic educational practices. Implications: This study encourages proportional integration between textual and contextual approaches in Islamic education to remain normative and responsive to social dynamics. Novelty: This study makes a new contribution by discussing the theoretical and practical comparison of the two approaches in Islamic education and emphasizing the importance of integrating the two as adaptive models in the contemporary era.
