Abstract

The fatwa of the National Sharia Council of the Indonesian Ulema Council (DSN MUI) plays a crucial role in addressing issues of default (failure to fulfill agreements) in sharia-based contracts. In Sharia financial transactions, default needs to be resolved fairly and in accordance with Islamic principles, which prohibit elements of riba (unjust enrichment), gharar (uncertainty), and zalim (oppression). (penindasan). The DSN MUI fatwa provides guidance on ta’widh or compensation as a form of recompense for the actual losses suffered by the aggrieved party, unlike fines which are more punitive or seek additional profit. Through this fatwa, DSN MUI encourages adherence to contracts, maintains the balance of rights and obligations, and ensures that the resolution of default is carried out without harming either party. The procedures in this research were carried out in stages, namely collecting library data, reading, taking notes, reviewing, gathering concepts or manuscripts, and then elaborating and explaining the collected data or texts related to the main discussion topic in this research. This article discusses the important role of the DSN MUI fatwa in creating transparency, justice, and adherence to Sharia principles in addressing default, as well as its impact on the integrity of Sharia financial transactions in Indonesia.

Abstract

This study examines the development of Islamic banking in Indonesia, starting with the establishment of Bank Muamalat in 1991 as the first Islamic bank. This sector offers financial products and services that comply with Islamic principles, attracting the interest of those seeking interest-free alternatives. Regulatory support from the government, through policies from Bank Indonesia and the Financial Services Authority (OJK), along with socialization programs, has strengthened the growth of Islamic banking. Although it still holds a small market share, increasing public awareness and the adoption of digital technology present greater growth opportunities. In the future, Islamic banking is expected to make a more significant contribution to the national economy and support better financial inclusion in Indonesia.

Abstract

Murabaha-based financing is one of the main instruments utilized by Islamic banks to support financing activities in the real sector. However, the implementation of this contract often faces challenges, especially related to the risk of non-performing financing or potential defaults. This article aims to explore strategies undertaken by Islamic banks in managing non-performing financing in murabahah contracts, while maintaining compliance with sharia principles and maintaining financial stability. Through a literature study approach, this research aims to identify the factors that cause such non-performing financing and understand the efforts of Islamic banks in overcoming non-performing financing in murabahah contracts. This research is expected to be useful in providing an explanation of the resolution of murabahah financing problems in Islamic banks and uncovering the various factors that cause the emergence of non-performing financing. The findings show that these measures contribute significantly to improving the effectiveness of handling non-performing financing as well as maintaining customer trust and the reputation of Islamic banks in the community.
