Abstract

Restitution in the context of human trafficking crimes is crucial to ensure the restoration of victims' rights that have been violated. Human trafficking is a serious crime that not only harms victims physically and mentally but also deprives them of their right to live with dignity. Restitution serves as compensation that victims are entitled to for the material and immaterial losses they have suffered. Although Indonesia has a legal framework regulating restitution, such as in the Criminal Code and Law No. 21 of 2007, its implementation still faces significant challenges, such as the difficulty in determining the value of the losses and the social stigma experienced by victims. Therefore, a sensitive approach to the victims' psychological condition, support from the government, law enforcement agencies, and non-governmental organizations (NGOs) is essential to create an environment that supports victims' recovery. In addition, a comprehensive rehabilitation program that includes psychological support, education, and job opportunities is vital. In conclusion, although the implementation of restitution faces considerable challenges, strategic measures such as increasing legal awareness, training for law enforcement, in-depth research, and multi-party cooperation can help create a fairer and more effective system in addressing human trafficking crimes.

Abstract

The state's obligation to protect activists is a crucial aspect of human rights enforcement and democracy. Despite existing legal frameworks, both domestic and international, many activists still face significant threats in practice. The decision in Jepara District Court Case No. 14 Pid.Sus/2024/PN Jpa illustrates challenges in safeguarding freedom of expression, particularly on environmental issues. This case raises concerns about the inadequate implementation of anti-SLAPP policies, which aim to protect public participation. The ruling risks suppressing freedom of speech and creating a chilling effect on environmental activists. Protecting activists through legal reforms and consistent policy implementation is essential to fostering democracy, social justice, and public engagement in critical discussions.

Abstract

This research aims to find out whether the arrangements for determining suspects in National Police Chief Regulation Number 6 of 2019 concerning Criminal Investigations are in accordance with the provisions in the Criminal Procedure Code (KUHAP). This research uses normative research methods with a prescriptive approach. The data used in this research is secondary data obtained from library materials, such as books, journals and statutory regulations. The results of the research show that "the beginning of evidence" in National Police Chief Regulation Number 6 of 2019 do have several differences with the provisions in the Criminal Procedure Code who have been perfected by the ruling of the constitutional court number 21 / puu-xii / 2014. that there must be 2 sufficient tools of evidence and the investigator's objective conviction to satisfy the establishment of a suspect. But, contrary to the regulations of the 6/2019 capture, there was an SPDP that contained the identity of the suspect. This would be a conflict of norms, but the stipulations of the 6/2019 capture should be consistent with the requirements of KUHAP.

Abstract

The objective of this research is to understand and analyze the legislative ratio regarding the age restriction provisions for children of female inmates in women's correctional facilities under Article 62 paragraph (1) of Law Number 22 of 2022 on Corrections. The method used in this research is normative legal research. The results of this research indicate that the rights of young children of female inmates are not fully guaranteed within the existing legal framework. The regulation of this legal protection is still not optimal in determining the age limit for children of female inmates. This research proposes improvements in the policy of age restriction in legal protection for young children of female inmates and contributes to a better understanding of the age restrictions in legal protection for young children of female inmates in correctional facilities.

Abstract

The dissemination of pornographic content in cyberspace represents a complex challenge arising from advancements in information and communication technology. This content is widely accessible and distributed through social media and instant messaging platforms, presenting significant obstacles in law enforcement and criminal accountability. In Indonesia, the dissemination of pornographic content is regulated under Law No. 44 of 2008 on Pornography and Law No. 11 of 2008 on Information and Electronic Transactions (ITE). These laws prohibit the creation, distribution, and access to pornographic materials, with clear criminal sanctions for violators. Two models of liability are addressed: individual and corporate. Individual accountability involves actions such as uploading content, while corporate liability pertains to platforms facilitating its dissemination. Enforcement challenges include user anonymity and resource limitations among law enforcement agencies. To address this issue, preventive measures such as public education on the dangers of pornography and involvement of internet service providers in monitoring illegal content are crucial. International cooperation is also essential to tackle cross-border violations. With collective efforts, the spread of pornographic content can be mitigated. Effective prosecution, based on the relevant legal framework, is imperative to deter violations, protect society, and foster a safer cyberspace environment.

Abstract

Social media currently plays a significant role in everyday life, facilitating the sharing of information, including sensitive issues such as Domestic Violence (DV). Uploading videos as evidence of DV is often used as an attempt to seek public support or demand justice. However, this practice poses legal risks, particularly related to defamation, especially if the identity of the affected party is revealed. In Indonesia, defamation is regulated under the Criminal Code (KUHP) and the Electronic Information and Transactions Law (ITE Law), particularly Article 27, paragraph (3), which is frequently applied in social media-related cases. The dilemma arises in balancing the victim's right to disclose their experience of violence with the perpetrator's right to protect their reputation. These cases highlight the challenges of law enforcement in the digital era, where victims often turn to social media due to a lack of trust in formal legal systems, while others may use the law to defend their reputation. Data from the Ministry of Communication and Information (Kominfo) and the National Commission on Violence Against Women (Komnas Perempuan) show an increase in such cases, indicating the need for legal revisions that are more just and responsive to technological advancements and social dynamics.

Abstract

Pemberian sanksi tambahan pada tindak pidana kejahatan siber yang berkaitan dengan kejahatan asusila merupakan langkah penting dalam menangani ancaman yang muncul dalam era digitalisasi. Artikel ini mengeksplorasi urgensi, jenis-jenis sanksi tambahan yang mungkin diberlakukan, pertimbangan hakim dalam menjatuhkan sanksi tambahan, serta tantangan dalam implementasinya. Kejahatan siber terkait asusila, seperti penyebaran konten pornografi dan grooming, memiliki dampak serius terhadap korban dan masyarakat. Oleh karena itu, pemberian sanksi tambahan bertujuan untuk memberikan hukuman yang setimpal kepada pelaku serta mencegah terulangnya tindakan kriminal serupa di masa depan. Hakim perlu mempertimbangkan berbagai faktor, termasuk keparahan tindakan, dampak terhadap korban, serta prinsip-prinsip keadilan dan hak asasi manusia dalam menentukan sanksi tambahan yang tepat. Meskipun dihadapkan pada sejumlah tantangan, kerja sama antara berbagai lembaga dan pemangku kepentingan terkait diharapkan dapat memperkuat penegakan hukum terhadap kejahatan siber dan memberikan perlindungan yang lebih baik bagi masyarakat dari ancaman di dunia maya.

Abstract

Penelitian ini bertujuan untuk mengetahui dan mengkaji definisi kekerasan psikis dalam Undang- Undang KDRT No 23 Tahun 2004 dapat diterapkan didalam UU Perubahan Perlindungan Anak No 35 Tahun 2014. Penelitian ini merupakan penelitian yuridis normatif. Hasil penelitian menunjukkan bahwa definisi kekerasan psikis dalam Undang- Undang Nomor 23 Tahun 2004 Tentang Penghapusan Kekerasan dalam Rumah Tangga dapat diterapkan didalam Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak.

Abstract

Putusan Nomor 813 K/PID2-23 menjadi perhatian yang mendalam dalam ranah hukum, khususnya terkait analisis asas keadilan ratio decidendi yang diaplikasikan oleh hakim dalam penentuan putusan. Dalam konteks ini, penting untuk memahami berbagai aspek yang menjadi pertimbangan hakim dalam menjatuhkan keputusan yang adil dan berkeadilan. Dalam pembahasan ini, kita akan mengeksplorasi beberapa aspek kunci yang perlu diperhatikan dalam analisis asas keadilan dalam putusan Nomor 813 K/PID2-23. Aspek-aspek tersebut meliputi prinsip proporsionalitas dalam penerapan hukum, kesetaraan di hadapan hukum, kepastian hukum, dan rehabilitasi serta resosialisasi. Penelitian ini juga mengacu pada relevansi dan implikasi putusan tersebut terhadap perkembangan hukum dan keadilan di masyarakat. Diharapkan pembahasan ini dapat memberikan wawasan yang lebih mendalam tentang bagaimana asas keadilan ratio decidendi hakim diterapkan dalam konteks kasus-kasus pidana yang kompleks seperti putusan Nomor 813 K/PID2-23.
