Abstract

Child Victims of Violence are entitled to Restitution for the loss of a crime, The legal application of the fulfillment of the Right to Restitution has been proven in the decision of the panel of judges, in the implementation of the restitution charged, the perpetrator cannot pay restitution, Restitution is regulated by Law No. 35 of 2014 concerning Child Protection, Government Regulation No. 43 of 2017 concerning the Implementation of Restitution for Children who are Victims of Crime. The legal theories used are Legal Certainty Theory and Child Protection Theory. The research method used in this research is a normative juridical approach which is carried out as an effort to obtain the necessary data related to the problem. Data used with secondary data and tertiary legal materials. In addition, primary data is also used as a supporter of secondary data legal materials. For data analysis, a qualitative juridical analysis method is used. The results of the study that the application of the law to fulfill the restitution rights of child victims of violence in the form of a judge's decision in this case the perpetrator is unable to make restitution payments, therefore from the results of further research the legal rules for fulfilling restitution rights need to be revised to add phrases contained in article 21 of the regulation.

Abstract

The validity and fairness of the law against the charges are very important to be considered by the Public Prosecutor. The prosecution process by the public prosecutor begins with the study of the investigation file, then from the results of the public prosecutor's research can identify what evidence and the evidentiary strength is fulfilled, then for the inherent weaknesses known in the case file to prepare the juridical—accurate facts to anticipate problems that arise in the effort to prove in court. The problem in this paper is the basis for the Public Prosecutor's consideration regarding the Corruption Crime case and how to review the aspects of legality and legal justice against the Public Prosecutor's demands in case Number: 2/Pid.Sus.TPK/2023/PN.Mks. This paper uses a type of normative juridical method with the consideration that the problem being studied is relevant to the regulations and how to handle it in judicial practice. From the results of the research carried out, it can be concluded as follows: first, the Public Prosecutor in his Indictment in the form of an "alternative indictment" has been read out in the trial on January 13, 2023, filing an indictment against the defendant Eltinus Omaleng with the First Indictment Article 2 paragraph (1) Jo Article 18 of Law No. 31 of 1999 concerning the Eradication of Corruption Crimes Jo Article 55 paragraph (1) 1 of the Criminal Code Jo Article 64 (1) of the Criminal Code and the Second Indictment of Article 3 Jo Article 18 of Law No. 31 of 1999 concerning the Eradication of Corruption Jo Article 55 paragraph (1) 1 of the Criminal Code Jo Article 64 (1) of the Criminal Code. Second, the indictment and demands of the Public Prosecutor in case Number: 2/Pid.Sus.TPK/2023/PN.Mks do not have legal validity and justice, because all elements of the articles charged were not proven at trial.

Abstract

This study analyzes the effectiveness of implementing restorative justice in resolving social conflicts within Indonesian communities as part of the transitional justice process. Using a qualitative approach and a case study method in several regions such as Poso, North Maluku, and West Sumatra this research explores how restorative mechanisms rooted in local wisdom can restore social relations, strengthen community cohesion, and prevent recurring conflicts. The findings reveal that restorative justice approaches are effective in fostering reconciliation at the community level through dialogue, acknowledgment of wrongdoing, and traditional symbolic acts. However, their effectiveness largely depends on institutional support, facilitator capacity, and the alignment of public policies. The integration of local values such as musyawarah (deliberation), pela gandong, and alek nagari emerges as a key factor in sustaining the peacebuilding process. These findings emphasize the importance of strengthening the national legal framework, engaging civil society, and enhancing the capacity of local actors so that restorative justice can function not only as a conflict resolution mechanism but also as a means of achieving long-term social transformation

Abstract

Program kolaborasi akademisi dalam upaya penegakan hukum melalui pengabdian masyarakat bertujuan untuk meningkatkan pemahaman dan kesadaran hukum di kalangan masyarakat, khususnya terkait peraturan dan undang-undang yang berlaku. Kegiatan ini dilakukan sebagai bentuk tanggung jawab sosial akademisi dalam memberikan kontribusi nyata untuk menciptakan masyarakat yang taat hukum. Metode yang digunakan dalam kegiatan ini adalah pendekatan psikoedukasi, yaitu memberikan edukasi melalui sesi penyuluhan, diskusi, serta konsultasi hukum interaktif. Melalui pendekatan ini, masyarakat diberikan pemahaman tentang isu-isu hukum yang relevan dengan kehidupan sehari-hari, termasuk cara menghadapi permasalahan hukum dan langkah-langkah preventif yang dapat diambil untuk mencegah terjadinya pelanggaran. Program ini melibatkan berbagai pihak, termasuk praktisi hukum, dan akademisi. Hasil dari program ini menunjukkan peningkatan signifikan dalam pemahaman hukum masyarakat, terlihat dari tingginya partisipasi dan antusiasme mereka dalam setiap sesi kegiatan. Selain itu, terdapat perubahan positif dalam sikap masyarakat terhadap pentingnya menaati peraturan dan menjalankan hak serta kewajiban hukum. Program ini berhasil membangun jembatan antara akademisi dan masyarakat, sehingga terjalin kolaborasi yang efektif dalam upaya penegakan hukum. Kesimpulannya, kegiatan ini menjadi model efektif dalam memberdayakan masyarakat melalui edukasi hukum dan diharapkan dapat berkelanjutan untuk mendukung terciptanya masyarakat yang lebih sadar hukum.

Abstract

This study examines the complex dynamics of Indonesian Islam amidst the rise of global Islamic fundamentalism, focusing specifically on processes of radicalization and counter-radicalization within the archipelago. Indonesia, as the world’s largest Muslim-majority nation, presents a unique case due to its historically pluralistic and moderate religious landscape, which now faces increasing pressure from extremist ideologies. The primary objective of this research is to identify the key drivers of radicalization among Indonesian Muslims and to critically assess the effectiveness of existing counter-radicalization strategies implemented by the government and civil society organizations. Utilizing a mixed-methods approach, this study combines a quantitative analysis of survey data from 500 university students and religious leaders across Java and Sumatra with qualitative in-depth interviews. The qualitative component involved 30 participants, including former extremists, religious scholars, and policymakers, providing nuanced insights into their experiences and perspectives on radicalization and deradicalization. Results indicate that socio-economic grievances, misinterpretations of religious texts, and online propaganda are significant factors contributing to radicalization, particularly among younger demographics. In conclusion, Indonesian Islam demonstrates significant resilience against fundamentalist encroachment, largely due to its strong civil society and established moderate religious organizations.
