Abstract

Undang-Undang No. 6 Tahun 2023 tentang Cipta Kerja membawa perubahan signifikan dalam regulasi ketenagakerjaan di Indonesia, khususnya terkait status Perjanjian Kerja Waktu Tertentu (PKWT). Penelitian ini bertujuan menganalisis implikasi hukum dari perubahan tersebut terhadap kepastian hukum status PKWT. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Data dikumpulkan melalui studi kepustakaan dan dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa UU No. 6/2023 memberikan fleksibilitas lebih besar dalam pengaturan PKWT, namun juga menimbulkan potensi ketidakpastian hukum bagi pekerja. Kesimpulannya, diperlukan harmonisasi regulasi dan implementasi yang konsisten untuk menjamin kepastian hukum status PKWT. Penelitian ini merekomendasikan penyusunan peraturan pelaksana yang komprehensif dan sosialisasi intensif kepada para pemangku kepentingan untuk memastikan perlindungan hak-hak pekerja dalam kerangka PKWT yang baru.

Abstract

Abstract This research examines legal protection for workers at PT MLG through the lens of the legal protection theory proposed by Muchsan. The study aims to analyze the implementation of legal protection in labor practices, particularly concerning wage reporting to BPJS and worker registration. Data collected through interviews and observations reveal discrepancies in wage reporting and the lack of registration for all workers in BPJS, resulting in vulnerabilities to violations of workers' rights. This study employs an empirical normative approach, utilizing both field research and library research methods. In the context of legal protection, Muchsan's theory emphasizes the importance of two approaches: preventive and repressive legal protection. The findings of this study recommend the need for evaluation of labor oversight processes and increased awareness among all stakeholders, including employers, workers, and the government, to ensure the protection of workers' rights in accordance with applicable legal provisions. By implementing these measures, it is expected that legal protection at PT MLG can be enhanced, reducing violations and supporting the welfare of workers, thereby fostering a healthier and more sustainable industrial climate. Abstract

This study investigates the implementation of e-litigation (e-litigasi) as a form of digital transformation in public legal services, focusing on divorce cases at the Klaten Religious Court, Indonesia. This research aims to explore whether the digital justice system can effectively promote inclusive and equitable access to justice for all societal segments, particularly in regions with limited digital literacy. A qualitative case study approach was employed, utilizing in-depth interviews, direct observation, and document analysis. The research subjects included judges, court staff, advocates, and litigants directly involved in e-litigation procedures. Data was analyzed to identify procedural dynamics, institutional readiness, social barriers, and user experiences. The findings indicate that while e-litigation enhances procedural efficiency and reduces the average litigation time from 42 to 24 working days, significant digital divides persist. Litigants with higher education and greater technological access tend to benefit more from the system, whereas those from rural or less-educated backgrounds face systemic exclusion. Institutional readiness also varies, with some court staff still lacking full digital proficiency, which affects the quality-of-service delivery. This study, although limited to a single location, highlights crucial implications for inclusive digital governance in the legal sector. To ensure an equitable transformation of public services, targeted digital literacy programs are recommended for vulnerable communities, along with a uniform enhancement of digital capacity among court human resources. Furthermore, the development of a digital justice framework that integrates social, institutional, and technological dimensions is essential to create a more responsive and equitable system.

Abstract

This study explores the roles of government institutions and community participation in waste management practices in Patangpuluhan Subdistrict, Yogyakarta. It responds to the gap between formal waste management regulations and their implementation in densely populated urban areas where infrastructure and public awareness are still limited. The research argues that sustainable waste governance cannot rely solely on legal instruments; it requires active community involvement and institutional collaboration at the grassroots level. Employing a qualitative socio-legal approach, data were collected through semi-structured interviews with local government officials, community leaders, and waste bank managers, as well as through document analysis and field observations. The study investigates how national and local waste policies are interpreted, implemented, and adapted by local actors. The findings reveal multidimensional challenges, including land constraints, low compliance with regulations, and unequal access to waste facilities. Although Law No. 18 of 2008 provides a strong legal basis, its implementation in the field is constrained by the gap between “law in books” and “law in action” and the limited institutional capacity at the local level. Waste bank initiatives in several Neighborhood Units (RWs) show high participation but remain fragmented. The study’s novelty lies in its juridical-sociological lens, highlighting the interplay between normative frameworks and lived realities, and offering critical insights into the social drivers behind legal compliance in environmental governance.

Abstract

This study aims to address a gap in literature by providing an in-depth analysis of the social and cultural dynamics of communities affected by illegal sand and stone mining in Gunung Kidul Regency. It focuses on shifts in livelihood patterns, cultural values, and adaptive mechanisms that emerge amid illegal mining activities. The central argument is that such practices foster social polarization, fragile economic dependence, and the erosion of community cohesion. Employing a qualitative ethnographic approach, the research explores the everyday lives of affected residents. Data were gathered through participant observation and in-depth interviews with key informants, including community leaders, village heads, and residents either involved in or impacted by mining. Additional supporting data were obtained from document studies. The data analysis followed an interactive process consisting of data reduction, display, and conclusion drawing. The study reveals that illegal mining has transformed the community’s economic structure from traditional agriculture to mining dependency, generating quick but unstable income. This shift has triggered social conflicts and polarization between pro- and anti-mining groups; undermining long-standing social cohesion rooted in cooperation. Furthermore, cultural values that emphasize respect for nature are increasingly eroded. Practically, the findings highlight that law enforcement alone is insufficient to address the issue. A comprehensive response should integrate local economic diversification, community empowerment, and the restoration of social cohesion.

Abstract

This study's primary objective is to examine how Article 1337 of the Civil Code governs the boundaries of freedom of contract in Indonesian corporate contracts. This article aims to safeguard the parties' freedom to enter into agreements by preventing abuse that harms other parties or violates legal and moral standards. This research combines a normative technique with a legislative approach, closely examining primary, secondary, and tertiary legal texts to comprehend the application of Article 1337 in business practice. According to the findings, Article 1337 is crucial since it establishes explicit boundaries on contract freedom; yet, the efficacy of this provision is greatly reliant on the thoroughness of law enforcement and judicial interpretation. We identified subjectivity in determining public decency and order, along with an informational and power imbalance between the parties, as the primary obstacles to putting this article into practice. Therefore, consistent enforcement of the legislation and clearer standards are necessary for the fair and efficient enforcement of Article 1337.

Abstract

The study employs descriptive-analytical methods to examine the relevant laws and enforcement practices. It views the RESD as an emerging norm through a constructivist lens, influencing both the host countries and the global normative framework. The research finds a growing momentum to revise BIT clauses to better reflect dynamic RESD principles and social responsibility. This involves moving away from focusing solely on unilateral power. The study proposes a new model for RESD, aimed at promoting good governance and fairness in administrative processes. This model will be vital for renegotiating or redesigning BIT provisions, particularly for countries like Indonesia. By explaining the acronyms and simplifying the sentences, the key points become clearer: the need for a balanced approach in BIT negotiations, the role of RESD in this balance, and the potential for revised treaty clauses to better align with principles of social justice and fairness.
