Abstract

This research aims to examine and analyze the Sociological Juridical Review of Zakat Fitra Distribution in Pomalaa District, Kolaka Regency. The analysis technique in this research uses qualitative analysis techniques. Provisions for the Distribution of Zakat Fitrah must be distributed immediately to mustahik for 8 groups (asnaf), poor people, poor people, those who have softened their hearts (converts), to (free) servants, to (free) people who donate, filsabilillah and for people who are on a journey, as Allah says in the Qur'an surah at-Taubah 60. If you have not had time to pay zakat fitrah before the Eid al-Fitr holiday, it is sunnah to pay zakat after the morning prayer before the Eid al-Fitr prayer. The makruh time to pay zakat is after Eid al-Fitr and before sunset on Hari Raya. Even though this time is considered quite risky, it is still recommended to pay zakat fitrah at this time if Muslims have not had the opportunity to do it before, so that no Muslims go hungry on Eid al-Fitr. Delays in the distribution of zakat fitrah in the district. Pomalaa in Kab. Kolaka at the Nurul Huda Mosque is due to the awareness of the community in collecting zakat and the zakat distribution committee which is a new form of youth during the month of Ramadhan, which always changes every year and does not understand and does not review the provisions of zakat fitrah so that the community receiving zakat fitrah does not receive zakat. Accordingly, the distribution of zakat becomes uneven.

Abstract

Pertambangan di Indonesia dari berbagai riset telah menunjukan dampak positif diantaranya adalah sebagai lokomotif perekonomian yang secara langsung berkontribusi langsung pada peningkatan PDB, selain itu pada aspek ekonomi sektor riil berkontribusi terhadap peningkatan serapan tenaga kerja, peningkatan pendapatan, mempunyai multi efek player dengan meningkatkan usaha mikro masyarakat, namun disatu sisi riset yang lain menunjukan  dampak negatif terutama dampak lingkungan, konflik agraria, alih fungsi lahan dari pertanian menjadi kawasan eksploitasi pertambangan menyebabkan defisit  persediaan pangan. Khusus untuk permasalahan mitra pada pengabdian masyarakat ini karena terdapat protes warga soal kerusakan lingkungan, konflik horizontal antara masyarakat dan perusahaan, aktifitas ilegal memuat nikel tanpa memiliki syarat admininstrasi yang lengkap, untuk  itu kami melakukan pengabdian kepada masyarakat kiranya dengan informasi yang kami transformasikan masalah dapat diselesaikan oleh stake holders yang didaerah Lokasi mitra. Metode yang kami lakukan ialah metode pra pelaksanaan dan pelaksanaan; pra pelaksanaan dengan  memperhatikan base line visi misi fakultas hingga menentukan topik yang sesuai, kemudian melaksanakan observasi berita dan konfirmasi lapangan untuk memastikan urgensi kebutuhan mitra yang sesuai dengan topik, mengiventaris bahan materi lalu merumuskannnya hingga sistematis dan tersaji dengan baik, kemudian pelaksanaan  dilakukan dengan metode  service learning. Hasil dan pembahasan kami mengemukakan sumber hukum dan ketentuan inti pertambangan di Indonesia, tata kelola dan manejem lingkungan, penanganan konflik agraria, norma yang dapat diterapkan apabila perusahan badan hukum atau perorangan memuat nikel keatas kapal yang belum lengkap syarat admininstrasinya, layanan pengaduan masyarakat yang dapat diakomodir pemeritah daerah sesuai dengan norma undang-undang saat ini.

Abstract

This research and community service aims to analyze the practice of debt and credit agreements and their legal consequences in the community of Palewai Village, Tanggetada District.  The method used in this article is descriptive qualitative through a socialization approach, direct interviews with creditors and debtors, and analysis of laws and regulations relevant to debt and credit agreements. The results showed that there are still many people who do debt and credit without adequate legal understanding, which risks causing disputes. The practice of financing with fiduciary collateral is also not fully understood by debtors, especially regarding the rights and obligations in this lending and borrowing practice. In addition, the mismatch between the date of receipt of salary and income and the due date is a source of problems. This research and service emphasizes the importance of legal education to the community to increase awareness of legal protection in debt and credit transactions.ABSTRAKPenelitian dan pengabdian ini bertujuan untuk menganalisis praktik perjanjian utang piutang dan konsekuensi hukumnya dalam masyarakat Desa Palewai, Kecamatan Tanggetada. Metode yang dilakukan pada artikel ini adalah deskriptif kualitatif melalui pendekatan sosialisasi, wawancara langsung dengan kreditur dan debitur, serta analisa terhadap peraturan perundang-undangan yang relevan dengan perjanjian utang piutang. Hasil penelitian menunjukkan bahwa masih banyak masyarakat yang melakukan utang piutang secara asal tanpa pemahaman hukum yang memadai, yang berisiko menimbulkan sengketa. Praktik pembiayaan dengan jaminan fidusia juga belum sepenuhnya dipahami oleh debitur, khususnya terkait hak dan kewajiban dalam praktek pinjam meminjam ini. Selain itu, ketidak sesuaian antara tanggal penerimaan gaji dan pemasukan dengan tanggal jatuh tempo menjadi sumber masalah. Penelitian sekaligus pengabdian ini menekankan pentingnya edukasi hukum kepada masyarakat meningkatkan kesadaran akan perlindungan hukum dalam transaksi utang piutang.

Abstract

The Ogoh-ogoh tradition in Gunung Sari Village, Watubangga District, Kolaka Regency, has been carried out since 1982 as part of preparations for the Hindu New Year celebration of Nyepi. Although the majority of the village's population is Muslim, this tradition remains alive as a symbol of cleansing from evil through the burning of large, terrifying effigies. This research examines the development of this tradition and its alignment with the village's regulations. The aim of this research is to describe the implementation of the Ogoh-ogoh tradition, analyze the symbolic meaning within the tradition, and evaluate whether the tradition complies with local government regulations. Additionally, this research seeks to identify the factors that support the continuation of this tradition within a predominantly Muslim community. The research method used is qualitative with an ethnographic approach. Data was collected through interviews with community leaders and other key informants, as well as related literature. The collected data was analyzed descriptively to understand the implementation of the tradition. The Ogoh-ogoh tradition is embraced with enthusiasm and does not conflict with village regulations. This tradition is maintained as a form of respect for cultural and religious diversity. The Ogoh-ogoh tradition in Gunung Sari Village reflects interfaith harmony and can be carried out without conflict with village rules.ABSTRAKTradisi Ogoh-ogoh di Desa Gunung Sari, Kecamatan Watubangga, Kabupaten Kolaka, dilaksanakan sejak 1982 dan menjadi bagian dari persiapan Hari Raya Nyepi umat Hindu. Meskipun mayoritas penduduk desa beragama Islam, tradisi ini tetap hidup sebagai simbol pembersihan dari keburukan melalui pembakaran patung raksasa. Penelitian ini mengkaji perkembangan tradisi ini serta kesesuaiannya dengan peraturan desa setempat. Penelitian ini bertujuan untuk menggambarkan pelaksanaan Tradisi Ogoh-ogoh, menganalisis makna simbolis dalam tradisi ini, serta mengevaluasi apakah tradisi tersebut sesuai dengan peraturan pemerintah desa. Selain itu, penelitian ini ingin mengidentifikasi faktor yang mendukung kelangsungan tradisi tersebut dalam konteks masyarakat yang mayoritas Muslim. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan etnografi. Data dikumpulkan melalui wawancara dengan tokoh masyarakat dan informan kunci lainnya, serta literatur terkait. Data yang terkumpul dianalisis secara deskriptif untuk memahami pelaksanaan tradisi. Tradisi Ogoh-ogoh diterima dengan antusiasme dan tidak bertentangan dengan peraturan desa. Tradisi ini dijaga sebagai bentuk penghormatan terhadap keberagaman budaya dan agama. Tradisi Ogoh-ogoh di Desa Gunung Sari mencerminkan kerukunan antaragama dan dapat dilaksanakan tanpa konflik dengan aturan desa.

Abstract

The study employs descriptive-analytical methods to examine the relevant laws and enforcement practices. It views the RESD as an emerging norm through a constructivist lens, influencing both the host countries and the global normative framework. The research finds a growing momentum to revise BIT clauses to better reflect dynamic RESD principles and social responsibility. This involves moving away from focusing solely on unilateral power. The study proposes a new model for RESD, aimed at promoting good governance and fairness in administrative processes. This model will be vital for renegotiating or redesigning BIT provisions, particularly for countries like Indonesia. By explaining the acronyms and simplifying the sentences, the key points become clearer: the need for a balanced approach in BIT negotiations, the role of RESD in this balance, and the potential for revised treaty clauses to better align with principles of social justice and fairness.

Abstract

Purpose: This study aims to evaluate the adequacy of Indonesia’s regulatory framework in protecting patients within online health service agreements and to identify structural normative gaps that require legislative reform. Methods: Employing a normative legal research methodology combining statutory and conceptual approaches, the study analyzes primary legal sources including Law No. 17 of 2023 on Health, Government Regulation No. 28 of 2024, and Minister of Health Regulation No. 20 of 2019 on Inter-Facility Telemedicine Services (which primarily governs telemedicine between health facilities rather than direct doctor-patient teleconsultation through third-party applications), alongside consumer protection legislation and civil law principles, as well as secondary sources including academic literature and judicial decisions. Results: The findings reveal that the existing regulatory framework remains fragmented and contains structural gaps that undermine substantive legal protection for patients, particularly in determining professional liability when medical errors occur through digital platforms, ensuring the validity of electronic informed consent, and providing accessible remedies for aggrieved patients. The regulatory oversight body for personal data protection is still being strengthened, further limiting enforcement effectiveness. Conclusions: Indonesia urgently requires a comprehensive and integrated telemedicine statute that explicitly addresses the unique contractual and liability dimensions of digital health services, establishes clear data governance standards, defines platform operator responsibilities, and creates a dedicated dispute resolution mechanism suited to the online health environment. This study contributes to the field by offering a systematic normative mapping of existing gaps and proposing a concrete legislative reform agenda distinct from prior scholarship that addressed only general physician-patient relationships.

Abstract

Equality before the law is a foundational principle of any state based on law, requiring that all citizens be treated equally without discrimination; in Indonesia it is constitutionally guaranteed by Article 27 paragraph (1) of the 1945 Constitution. Its realisation nevertheless remains contested where policy produces uneven outcomes for parties in comparable positions. This article examines the 2014 policy converting several private universities (PTS) into new state universities (PTN-B), under which the government recruited external candidates for appointment as state civil apparatus (ASN) while long-serving lecturers and education personnel who had built and sustained the converted institutions were excluded from equivalent treatment. Employing a normative legal method that integrates a statute approach, a conceptual approach, and a case approach centred on Universitas Sembilanbelas November Kolaka, the study analyses the relevant constitutional provisions, the State Civil Apparatus Law, employment legislation, and comparative acquired-rights instruments through grammatical, systematic, and teleological interpretation. The analysis finds a significant gap between the normative guarantee of equality and administrative practice. Excluding long-serving personnel from ASN appointment while recruiting external candidates violates both substantive legal equality and distributive justice, because procedural legality does not by itself secure a just distribution of rights and opportunities. Measured against the Rawlsian difference principle, the Aristotelian principle of proportionality, and Stahl’s protective conception of the rechtsstaat, the policy privileges formal certainty over substantive justice. The study recommends reformulating ASN appointment policy and enacting explicit transitional-justice provisions so that institutional transformation upholds rather than erodes equality before the law.
