Abstract

Penelitian ini bertujuan untuk merancang model penyelesaian sengketa pagar rumah berbasis ekonomi syariah di Desa Trasak Larangan Pamekasan Madura, Indonesia. Model ini bertujuan mengintegrasikan nilai-nilai lokal, seperti musyawarah, dan prinsip-prinsip ekonomi syariah, seperti Islah (perdamaian) dan Ta’awun (tolong-menolong), dalam penyelesaian konflik agraria. Penelitian ini menggunakan pendekatan kualitatif dengan metode interpretif fenomenologi. Data diperoleh melalui wawancara mendalam dengan pihak yang bersengketa, kepala desa, dan tokoh masyarakat. Hasil penelitian menunjukkan bahwa meskipun penyelesaian teknis melalui hukum formal telah dilakukan, hubungan sosial antara pihak yang bersengketa tetap tidak pulih sepenuhnya. Pendekatan berbasis nilai-nilai lokal dan syariah terbukti lebih diterima oleh masyarakat dan lebih efektif dalam memulihkan hubungan sosial yang rusak. Berdasarkan temuan ini, penelitian ini menyarankan agar model penyelesaian sengketa berbasis ekonomi syariah dapat diadopsi dalam kebijakan mediasi di tingkat desa. Hal ini diharapkan dapat menciptakan solusi yang lebih inklusif, berkelanjutan, dan sesuai dengan konteks sosial budaya masyarakat, serta meningkatkan efektivitas penyelesaian sengketa agraria di Indonesia.

Abstract

As stated in Law Number 6 of 2014 on Village, the Village Head is required to maintain peace and order in the village community, so that if a conflict occurs in the community, it is the responsibility of the Village Head to resolve it. This study aims to analyze the role of the Chief of Village in resolving agraria conflicts, in this case land disputes in Sera Tengah Village, Bluto District. The research method uses a qualitative approach with data collection techniques using interviews and participatory observation. The results of this study are that the role of the Chief of Village is very significant in resolving agraria conflicts in Sera Tengah Village. The role of the Chief of Village, which is his responsibility, can resolve agraria conflicts without continuing to the court process. The resolution mechanism is in the form of Complaints to the Chief of Village or village apparatus, problem analysis, data/evidence analysis, mediation and ends with the decision process issued by the chief of village with the disputing parties witnessed directly by the Sera Tengah Village Apparatus.

Abstract

Zakat, as one of the pillars of Islam, has an important role in realizing social and economic justice for Muslims. One of the effective zakat distribution schemes in achieving this goal is productive zakat. This study aims to analyze the role of productive zakat in the economic empowerment of mustahik. The research method used is a literature study by reviewing various scientific sources, such as journals, books, and scientific articles. The results of the study indicate that productive zakat has a significant role in the economic empowerment of mustahik through several aspects such as zakat funds distributed in the form of business capital, training, and mentoring. This has brought significant benefits, such as increasing mustahik's income through profitable businesses, creating new jobs that reduce unemployment, increasing mustahik's skills and knowledge in managing businesses, increasing mustahik's self-confidence and independence by having their own income, and strengthening social solidarity among Muslims by helping mustahik escape poverty. With its various benefits, productive zakat is a solution for the economic empowerment of mustahik.
