Abstract

The objective of this study is to assess the efficacy of the Al-Ta’hῑl Al-Fiqhῑy learning approach in enhancing students' cognitive capabilities at STIBA Makassar. A true experiment with a posttest-only control group design was employed to assess the substantial impact of the method on students in their seventh semester. The findings of this study indicate that implementing the Al-Ta’hῑl Al-Fiqhῑy method markedly enhanced students' cognitive abilities. The calculated value of Cohen's d reached 1.26, indicating a huge effect size with a probability of 81.4% that the observed difference is due to the intervention and not other confounding factors. Moreover, the results of Cohen's U3 test demonstrated that 89.7% of students in the experimental group exhibited higher cognitive scores than those in the control group. These findings suggest that the Al-Ta’hῑl Al-Fiqhῑy method represents an effective alternative for enhancing the quality of education and fostering deeper comprehension in the field of fiqh.   Keywords: Effectiveness, Al-Ta’hῑl Al-Fiqhῑy Method, Cognitive Ability.

Abstract

The present study aims to examine the alignment of Islamic values with the principles of efficiency and profitability, as contained in Bank Indonesia's Hedging Swap regulation, to ensure innovation in the digital financial sector. The objective of this study is to ascertain how the integration of contemporary banking law with fiqh can establish a framework that facilitates the development of Shariah compliant digital financial products that comply with financial law based on Islamic principles without compromising the capacity of banks to generate profits. This research adopted a qualitative methodology and a literature study approach, employing data processing techniques to collect and evaluate pertinent literature on digital financial products and Islamic jurisprudence. The data triangulation method was applied by sorting and extracting through a deductive approach to data interpretation specific to the research objectives. The study concluded that the al-tahawwuth al-murakkab contract successfully integrates Islamic principles, bank profits and the dynamics of the digital era. However, the approach is only relevant for commercial banks and does not fully support digital transformation in micro scale banks.

Abstract

This study aims to analyse the fiqh muamalah review of the practice of buying and selling imitation products, which is now rampant in contemporary economic transactions. The type of research used is library research with a normative approach and deductive analysis. The results of the study show that formally, the sale and purchase of imitation products has fulfilled the pillars and requirements of the contract, namely the existence of ijab-kabul and the element of willingness (riḍā) between the seller and the buyer. However, from a broader perspective of fiqh muamalah, this practice is categorised as a transaction that is haram and prohibited. This prohibition is based on the existence of an element of ḍarar (harm) to a third party, namely the original manufacturer whose intellectual property rights are violated without permission or tolerance. In addition, this practice contains elements of tadlīs (deception) and garar related to the uncertainty of the quality of products that resemble the original goods but do not have the same quality standards. This study concludes that even though the formal requirements are met, the violation of other people’s property rights and the element of manipulation make this transaction incompatible with the principles of Islamic justice. The results of this study are expected to serve as a reference for academics, the government, and the public in understanding the limits of transaction honesty and the protection of the rights of original producers in order to create a muamalah ecosystem that is free from injustice.
