Abstract

The phenomenon of singlehood or remaining unmarried often sparks debates within society, addressing aspects of religion, psychology, and health. The decision not to marry is often viewed as deviating from social norms and generates negative stigma, leading to various issues related to acceptance and its impact on individuals. This study employs a descriptive qualitative method to examine this phenomenon from multiple perspectives. Islamic law provides flexibility for individuals to remain unmarried, as long as the decision is based on the intention of piety and worship. Prominent scholars such as Imam Shafi'i and Imam Nawawi assert that living without a spouse is permissible, as long as it remains oriented towards spiritual goals. From a psychological standpoint, the choice to remain unmarried is influenced by factors such as family dynamics, views on independence, and life experiences. This decision may offer benefits, such as career development and personal freedom, but it can also present challenges in the form of social pressure and the risk of loneliness. From a health perspective, marital status is closely linked to both physical and mental well-being. Unmarried individuals tend to face a higher risk of mental health issues, such as depression and anxiety, yet they are also spared from marital conflicts that may negatively affect psychological well-being. This study concludes that the choice of singlehood can be understood from various viewpoints, while considering the individual’s circumstances, intentions, and needs. The contribution of this research is to provide a multidimensional insight into singlehood, which can serve as a reference for policymakers, health practitioners, and society in supporting individuals who choose this path wisely and with respect.

Abstract

The testimony of women is the focus, with scholars holding diverse views regarding the eligibility of women as witnesses. In some contexts, such as muamalah, women are allowed to testify, while in fiqh jinayah, their testimony is strictly prohibited. It is essential to interpret Quranic verses using a broader and more comprehensive approach, connecting them to the conditions of women during the time of the Quran’s revelation. QS Al-Baqarah (2): 282 should be seen as progress, as it acknowledges the role of women as witnesses, a recognition that was previously absent during the Jahiliyyah period. This verse affirms the status of women as autonomous legal subjects, reflecting humanitarian values. The interpretation of this verse should be contextual, not merely literal, and adapted to the changing times based on the mubadalah perspective. This study employs a qualitative descriptive method and literature review techniques to collect primary and secondary data. The aim is to answer the posed questions and explain the status of women from a mubadalah perspective. QS Al-Baqarah (2): 282 is viewed as progress because it acknowledges women as witnesses, even though at that time, they were largely confined to the domestic sphere. The interpretation of this verse must be analyzed historically and contextually, considering social changes that have opened access for women to various public domains. Individual competence and understanding, rather than gender, should be the basis for evaluating testimony, as recognized by classical and contemporary scholars. Thus, the equal value of women's testimony with that of men aligns with the principles of justice and humanity in Islam

Abstract

Application for polygamy permit made at the Krui Religious Court level. One of the polygamy practices that occurs in society. This study aims to analyse the Panel of Judges of the Krui Religious Court in its legal considerations in deciding case Number 0251/Pdt/2016/PA.Kr concerning the granting of polygamy permits. This research method uses the judicial case study type, namely the application of normative Law to certain legal events that give rise to conflicts of interest. The results of this Judge's consideration are that the Applicant has met the facultative reasons according to the provisions of Article 4 paragraph (2) letter (a) in conjunction with Article 57 letter (a). And has met the cumulative requirements as stipulated in Article 5, paragraph (1) of Law Number 1 of 1974 concerning Marriage in conjunction with Article 55, paragraph (2) and Article 58 of the Compilation of Islamic Law. The purpose of this writing is to serve as study material for judges and legal experts, scholars and students. The results of the study show that positive Law and Islamic Law have differences in considering permission, but both have the same goal, namely, to achieve justice. Judges making their decisions are not only based on the Law but also on the provisions contained in Islamic Law, one of which is that the Panel of Judges relies on the word of Allah in QS Al-Nisa / 4: 3. The submission of polygamy on the grounds of avoiding adultery, then the Applicant considers polygamy as the right solution. The implication of this study is the importance of considering psychological and sociological aspects in dealing with sexual dysfunction in married couples. This study highlights the legal considerations and jurisprudence of judges in cases of polygamy and the integration of positive norms and Islamic law.Keywords: Judge's considerations, Positive Law, Islamic Law, Polygamy

Abstract

Nilai kekeluargaan dalam Falsafah Ulun Lampung memiliki relevansi terhadap hubungan harmonis dalam keluarga. Tujuan dari penelitian ini adalah untuk mengeksplorasi bagaimana falsafah ini membentuk pandangan masyarakat Lampung mengenai pernikahan dan perceraian serta dampaknya terhadap keharmonisan keluarga. Metode penelitian yang digunakan adalah penelitian hukum normatif deskriptif, bertujuan menggambarkan kontribusi Falsafah Ulun Lampung terhadap tujuan pernikahan masyarakat Lampung. Penelitian ini menggunakan studi pustaka dan pendekatan deduktif, menganalisis teori hukum serta falsafah pernikahan untuk melihat relevansinya dengan praktik hukum keluarga dalam falsafah Ulun Lampung. Penelitian ini menunjukkan bahwa Falsafah Ulun Lampung mengutamakan nilai kesatuan, tanggung jawab, dan komitmen dalam pernikahan, serta menolak perceraian sebagai solusi atas permasalahan rumah tangga. Dalam pandangan masyarakat Lampung, pernikahan dianggap sebagai ikatan suci yang harus dijaga, dan perceraian dianggap dapat merusak struktur keluarga dan komunitas. Falsafah Ulun Lampung menawarkan pendekatan yang lebih mengedepankan penyelesaian masalah secara damai dan dengan mempertimbangkan faktor sosial, budaya, dan ekonomi. Dengan penekanan nilai-nilai kultural yang mendalam dalam Falsafah Ulun Lampung sebagai dasar bagi respons hukum yang progresif, yang dapat diterapkan untuk menjaga keharmonisan keluarga di era modern. Kata kunci: Falsafah Ulun Lampung, Kekeluargaan, Pernikahan
