Abstract

Hukum waris Islam, terkhusus ahli waris pengganti dalam perundang-undangan (Kompilasi Hukum Islam) di Indonesia merupakan hal unik. Berdasarkan analisis yuridis, ditemukan eksistensi ahli waris pengganti merupakan pertemuan ekletisisme hukum Islam dan local wisdom. Maka dalam menyelesaikan persoalan ahli waris bisa memakai KHI, local wisdom, putusan hakim (jurisprudensi).

Abstract

Kompilasi Hukum Islam (KHI) pasal 96 ayat (1) dinyatakan bahwa apabila terjadi cerai mati, maka separuh harta bersama menjadi hak pasangan yang hidup lebih lama. Ketentuan pasal ini bila ditelusuri tampaknya sedikit kontradiksi dengan hukum waris Islam dalam al Qur’an, dimana dalam ketentuan hukum waris Islam seorang suami ataupun istri tidak dapat langsung dipastikan mendapat bagian separo dari harta peninggalan, akan tetapi seorang suami atau istri bisa mendapatkan bagaian separo dari harta peninggalan kalau suami atau istri tersebut tidak memiliki anak. Ketentuan pasal 96 KHI diberlakukan secara universal tanpa melihat kontribusi istri dalam menghasilkan harta kekayaan dalam suatu rumah tangga tentu ketentuan ini akan banyak merugikan pihak istri dan ahli warisnya bila yang meninggal dalam rumah tangga tersebut adalah istri. Berdasarkan persoalan tersebut, maka artikel ini bertujuan mendeskripsikan konsep pembagian kewarisan pasal 96 ayat (1) Kompilasi Hukum Islam dan mendeskripsikan praktik pembagian kewarisan pasal 96 ayat (1) dalam Kompilasi Hukum Islam pada masyarakat kota Bandar Lampung. Setelah hasil wawancara dengan berbagai tokoh dan masyarakat ditemukan fakta bahwa implementasi pembagian waris harta bersama di Bandar Lampung sangat variatif. Adakalanya istri atau suami mendapatkan harta gono gini, sebagaimana dalam ajaran Islam. Adakalanya istri yang memiliki penuh harta untuk dikelolanya. Adakalanya istri tidak mendapatkan apa-apa, yang mendapatkan adalah anak pertama laki-laki, atau anak bungsu dalam keluarga (tergantung adat atau suku). Adakalanya suami atau istri dan anak-anak yang dilahirkannya dapat warisan, sebelum suami atau istrinya meninggal dunia. Adakalanya pula, harta warisan dibagikan setelah kedua orang tuanya meninggal. Latar belakang terjadinya system kewarisan pembagian harta gono gini disebabkan beberapa factor yakni adat, etika, pemahaman hukum dan agama dan factor inkulturasi.

Abstract

This article examines the tradition of Nyorog in Betawi communities living in the City of Bekasi, West Java. Even though they live in West Java, the Betawi communities continue to maintain their own culture, including the Nyorog culture that can be found when welcoming Ramadan and Eid al-Fitr. The Nyorog tradition is full of social values, even including the values of Islamic family law. Based on the interview results with several figures, this study finds out that some of the values contained in the Nyorog tradition can be understood substantively as an effort to care for family harmony, as well as a means of physical, spiritual, and social education. In conflict situations or estrangement of relations within the family, the Nyorog tradition may function as a medium of reconciliation between conflicting family members, knitting back the broken relationship to a Sakinah Mawaddah wa Rahmah (serene, peaceful, prosperous) family.

Abstract

In normal situations, da’wah can be done face-to-face through ta’lim or Friday prayers, where the da’i and audience (mad’u) meet in a forum. However, such da’wah cannot be carried out in the Covid-19 pandemic situation, which has been running for almost two years. Instead, the preachers use social media such as Youtube, Instagram, WhatsApp, Facebook, and others to greet and provide enlightenment in the community. The problem is often found in social media content used by preachers with unethical language, sarcasm and lack of wisdom, especially those related to government prohibitions to reduce the risk of spreading the virus in houses of worship. Such as the prohibition of holding Friday prayers, Eid al-Fitr, Eid al-Adha, the prohibition of homecoming, holding ta’lim, and the commemoration of religious holidays, especially in the red zone category for the spread of Covid-19. This study examines the language content of da’wah communication on social media during the Covid-19 pandemic. Primary data sources are obtained from YouTube, Instagram, WhatsApp, and Facebook during the Covid-19 season. Secondary data is obtained from books, e-books, and relevant journals. This research is descriptive qualitative, with deductive and inductive thinking techniques. The research findings show that some preachers conveyed da’wah messages on social media with unethical, rude, and inappropriate languages to convey messages of a great and holy religion.

Abstract

Hasil penulisan ini memberikan gambaran bahwa penyebab masyarakat menggunakan jalan umum untuk acara Walimatul ‘Urs yaitu, tidak adanya lahan, belum adanya modal, terdapat gedung yang bisa disewa terlalu jauh dari rumah yang memiliki acara Walimatul Urs, tidak adanya komunikasi antara pemerintah setempat serta perizinan yang tidak dilakukan kepada dinas perhubungan maupun kepada kepolisian. Penggunaan jalan untuk acara Walimatul ‘Urs, belum sesuai dengan aturan yang ada kerena masih ada masyarakat yang tidak melaporkannya kepada pihak dinas terkait maupun kepada pihak kepolisan untuk meminta izin penggunaan jalan untuk acara Walimatul ‘Urs , namun demikian tetap ada jalan alternatif disediakan oleh pihak pelaksana, tidak adanya izin tersebut karena kurang pahamnya masyarakat mengenai tata cara mendapatkan izin penggunaan jalan tersebut. Terkadang hal tersebut baru disampaikan pada saat kurang 2 hari acara akan dilaksanakan, jika penggunaan jalan untuk kepentingan pribadi tersebut mengakibatkan tidak tercapainya suatu rasa aman dan nyaman di dalam masyarakat, apalagi bagian jalan tersebut merupakan bagian yang sangat penting bagi pengguna jalan, bila bagian jalan tersebut terganggu oleh masyarakat yang menyelenggarakan acara untuk kepentingan pribadinya, tentu fungsi jalan tidak tercapai secara optimal. Pandangan hukum Islam terhadap penggunaan jalan umum untuk acara Walimatul ‘Urs , tidak bertentangan dengan hukum Islam karena sudah sejalan dengan aturan hukum Islam yang dimana tidak mengganggu aktivitas masyarakat yang lainnya karena tetap memberikan jalan alternatif tidak semua badan jalan ditutup, ada izin maupun tidak ada izin dari pihak desa, dinas terkait maupun dari pihak kepolisian dalam artian kemaslahatan tetap diutamakan karena itu merupakan hal yang paling utama.

Abstract

Di era kemajuan tekhnologi dan informasi banyak sekali manfaat yang bisa digunakan khususnya untuk berkomunikasi dengan sesame manusia baik dengan jarak dekat maupun jarak jauh hanya menggunakan satu alat komunikasi yang dinamakan handphone/telephone genggam yang didalam nya banyak fitur-fitur yang bisa digunakan untuk memudahkan aktivitas untuk mengakses dan menjelajahi dunia maya atau lebih sering dikenal jejaring media sosial , seperti Whatapps, Instagram, Facebook, Line, Telegram, dan aplikasi dating seperti Tinder, Michat, Nearby, Tantan, Bumble dan lain sebagainya, Kemudahan-kemudahan yang ditawarkan didalam nya sering kali memberikan dampak positif dan dampak negatif bagi pengguna nya, terlebih pada jejaring sosial media, yang terkadang membuat penggunanya berlebih-lebihan dalam mengekspresikan diri dan mencari perhatian didunia maya, Didalam kehidupan keluarga karena pengaruh kemajuan tehknologi dan informasi inilah pasangan suami istri lebih banyak berkomunikasi menggunakan handphone baik untuk jarak dekat maupun jarak jauh yang terkadang sering kali menimbulkan konflik kesalah pahaman dan lepas dari tanggung jawab sebagai suami dan istri, Islam tidak melarang secara mutlak akan adanya kemajuan tekhnologi dan informasi ini terlebih jika manfaat nya digunakan dengan baik dan positif dalam kehidupan sehari-hari, Jika dilihat pada era sekarang ini sudah banyak pengguna aplikasi dating sebagai alat untuk sekedar mencari teman maupun relasi tetapi seringkali disalah gunakan, seperti terjadinya pornografi, penipuan, pemerasan bahkan perselingkuhan. Penulis menggunakan metode penelitian kualitatif dengan menggunakan Teori Fenomenologi realistik oleh Max Scheler dan teori Saddud Al –Dzari’ah sebagai pisau analisis dan rujukan serta memperkuat argument dalam menganalisis data, Adapun tekhnik pengumpulan data dengan melakukan observasi, wawancara dan dokumentasi pada beberapa pengguna aplikasi dating dilingkungan kerja aparatur sipil negera Disdukcapil Kota Bandar Lampung.

Abstract

This study aims to comprehensively describe the endogamous marriages of the Prophet Muhammad's descendants from the perspective of the sociology of Islamic law. The marriage mainly occurs in syarīfah (the female descendants); they are required to marry the prospectives from ḥabīb (male descendants) groups only. Endogamous marriage will be explored holistically by clarifying the reciprocal relationship between social change and Islamic law among syarīfah. This field research examines the enactment of the law in social life. It used a sociological Islamic law approach to reveal the facts about endogamous marriage in Bangil, East Java, Indonesia, because many of the Prophet's descendants live there. Data collection techniques were interviews and literature search, while the analysis technique used is Miles and Hubermen's analytical procedure. After conducting in-depth research, a conclusion was found that endogamous marriage among syarīfah in Bangil is a form of obedience to customs passed down across generations since their ancestors, namely the tradition of marrying someone of equal lineage. Endogamous marriages have been maintained to this day due to religious teachings, the spirit of protecting the Prophet's family, and the social conditions of those who support its preservation.

Abstract

This article aims to explain the results of the author's analysis of the implementation of halal certificates on food products sold online, inhibiting and supporting factors for the application of halal certificates to food sold online, and the impact of Sharia economic law on the haleness of food products sold online without halal certificates. The results of the 2021 survey on e-commerce statistics show that the types of goods and services sold the most online in Lampung are food and beverage groups, totaling 40.86 percent of all businesses sampled by e-commerce. The rapid progress of buying and selling food online has become an additional task for halal certificate implementation agencies in providing security and comfort, especially for Muslim consumers in Indonesia, so they can consume halal food that is traded online. The research methodology that the author uses is qualitative in terms of the type of research documentation, interviews, and observations. The author goes directly to the field to conduct observations and interviews with primary data derived from the results of interviews with the BPJPH task force and LPPOM MUI. The results of the study show that there are no special strategies for food sold online. Supporting factors include the existence of institutions assisting the halal product process for MSME business actors. The inhibiting factor is that there is no direct regulation of cooperation with online business application server managers, a lack of public understanding of halal certificates, Analysis of Sharia Economic Law on the haleness of food products sold online: the haleness of products sold online or offline without MUI halal certificates are categorized as syubhat. According to Imam Nawawi, doing syubhat is  form of underestimating.the.law.without.realizing.that.they.have.done.haram.

Abstract

The Muslim-friendly tourism trend is a new phenomenon in the tourism industry. The Muslim community's demands for a tourist destination are not only limited to the uniqueness and tourist attraction of the place but also comfort and guarantees in carrying out worship. This research aims to analyze the Global Muslim Travel Index for Muslim-Friendly Tourism in Improving the Community's Economy from an Islamic economic perspective. This type of research is qualitative. This research was conducted in Lampung Province in September 2023. This data collection technique used observation and interviews. The research results show that tourism development opportunities that accommodate Muslim needs, in accordance with GMTI, act as a generator of employment opportunities to improve the economic welfare of the community. A tourist destination that is friendly to Muslim tourists is a place that offers natural beauty, comfort, cleanliness, and freshness. This area is also equipped with comprehensive facilities, ranging from places of worship to accommodation, and functions as an attractive culinary center. This tourism acts as an economic center for residents. The development of tourism potential based on Sharia principles also has a significant positive impact on surrounding communities, such as food and beverage businesses, children's toy rental service providers, and various other sectors.
