Abstract

This research aims to determine the legal certainty of the role of insurance supervisory institutions and the form of legal protection for insurance customers after the formation of the Policy Guarantee Institution (LPP). This has become urgent, considering that recently there have been many cases of failure to pay insurance claims to customers. This research method is normative, with an approach to statutory regulations and a conceptual approach. The sources of legal materials used are primary, secondary and tertiary legal materials. The method for collecting legal materials is carried out through literature study with the analysis method using analytical descriptive and systematic interpretation. The research results found that legal certainty regarding the role of insurance supervisory institutions is inherent in the Financial Services Authority (OJK) with its juridical basis being Law Number 21 of 2011 concerning the Financial Services Authority and Law Number 40 of 2014 concerning Insurance. OJK plays a role in risk mitigation and legal protection. The form of legal protection is preventive (prevention) and repressive (control). The policy guarantor is the authority of the Deposit Insurance Corporation (LPS). However, it is known that the minimum and maximum nominal limits of the policy guarantee that will be guaranteed are not regulated, thus indicating that legal certainty as well as legal protection for insurance customers has not been realized as it should be.

Abstract

Regional elections are a means of exercising popular sovereignty that allows citizens to directly elect leaders at the regional level while providing legitimacy to democratically elected governments. In their journey, political elites often use various methods to become contestants or to prevent their political opponents from competing by changing various legal rules that are considered ‘obstructing’ their political goals through judicial review (JR) at the Supreme Court against regulations under the law. This study aims to analyse the ratio decidendi of Supreme Court Decision No. 23 P/HUM/2024 which changes the age requirement for nominating regional head candidates from the age when they are determined as candidates by the KPU to the inauguration requirement. This research is a type of legal research using 2 (two) types of legal approaches, namely statute approach and conceptual approach. The results showed that the ratio decidendi in the case considered the importance of providing opportunities for the younger generation to participate in the political process and the human rights aspect that age restrictions can be considered a violation of individual political rights.This consideration is a real mistake considering that the position of the judge in deciding JR cases at the Supreme Court acts as a Negative Legislator who is limited to making an assessment of whether the regulation that is the object of the test is contrary to the law as the touchstone?Textually, the KPU regulation that is the object of the test is still in line with the Law so that the petition should be rejected.

Abstract

Permasalahan dalam Layanan Pendanaan Bersama Berbasis Teknologi Informasi (LPBBTI) yang kerap terjadi ialah seperti penerima dana yang berujung gagal bayar hingga penagihan pinjaman dan data pribadi disalahgunakan. Berdasarkan hal tersebut, patut digali terkait perlindungan hukum represif dalam penyelenggaraan Layanan Pendanaan Bersama Berbasis Teknologi Informasi (LPBBTI), mengingat keseluruhan kegiatannya ialah dilakukan secara online. Hal tersebut ialah kemudian dapat mengetahui bagaimana perwujudan asas penyelesaian sengketa secara cepat, sederhana, biaya ringan, dan bermanfaat secara berkelanjutan. Tipe penelitian ini ialah penelitian normatif, dengan pendekatan peraturan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa penyelesaian sengketa dalam Layanan Pendanaan Bersama Berbasis Teknologi Informasi (LPBBTI) cenderung dilakukan melalui litigasi secara online. Pengaturan mengenai non litigasi secara online terkait hal tersebut belum diatur di Indonesia. Non litigsi secara online menjadi urgensi untuk mewujudkan penyelesaian sengketa secara cepat, sederhana, biaya ringan, dan berkelanjutan sekaligus sebagai perwujudan perlindungan hukum terhadap para pihak dan perekonomian nasional yang baik, serta dunia bisnis yang sehat. Kepastian hukum terkait pengaturannya tersebut dengan ini perlu untuk diwujudkan.

Abstract

The current global paradigm shift in the employment sector no longer focuses exclusively on physical safety. Instead, this focus has expanded to the urgency of protecting workers’ psychological well-being. Unfortunately, the issue of worker mental health in Indonesia remains marginalized within the labor law framework. This research aims to critically analyze the technical normative vacuum within national regulation. Furthermore, this study aims to formulate an ideal regulatory model by adopting best practices from Singapore. This research employs a doctrinal legal research method, drawing on statutory, conceptual, and comparative approaches. This study examines in depth the legal architectural gaps between the two countries. The results reveal crucial facts regarding Article 35 section (3) of Law Number 13 of 2003. Although the article mandates protection of mental health, the absence of specific implementing regulations renders the norm unenforceable. This condition differs from Singapore, which possesses the WSHA 2006 and integrated Tripartite Advisory technical guidelines. This disparity creates structural vulnerability for Indonesian workers against psychosocial hazards. These hazards include extreme work stress and intimidation, exacerbated by the lack of standardized early-detection instruments. As a prescriptive solution, this research recommends the issuance of a specific Ministerial Regulation on Mental Health Protection at the Workplace. This regulation must mandate psychosocial risk assessment and require access to EAP. This reform is urgently needed to shift the protection paradigm from a voluntary, reactive approach to a mandatory, preventive one. This is necessary to guarantee workers’ fundamental rights to a healthy and dignified working environment.

Abstract

Protection of workers' rights becomes a crucial issue when corporate assets are confiscated by the state due to Corruption and Money Laundering (TPPU). This condition creates a jurisdictional conflict because the preferred creditor mechanism in labor law (Article 95 paragraph (4) of the Labor Law) cannot be applied to assets that are under criminal confiscation status. This difference in legal regimes creates a normative vacuum (rechtsvacuüm) which results in workers losing their legal position and economic rights, as reflected in the case of PT Duta Palma Group. This study uses a normative method to analyze legal accountability and formulate a mechanism to guarantee the fulfillment of workers' rights. The results of the study indicate that effective protection can only be realized through three main mechanisms: (1) A Joint Procedural Mechanism in the form of Mediation followed by Arbitration to produce a final and binding determination of the amount of workers' rights; (2) An Administrative Mechanism through the Attorney General's Office policy (Perja) which requires the recognition and provision of funds based on the results of arbitration decisions; and (3) Legislative mechanisms in the form of cross-sectoral legal reconstruction to clarify the priority of paying workers' rights over state-seized assets. This approach functions as an instrument of efficiency, the realization of restorative, corrective, and rehabilitative justice, and guarantees legal certainty and the protection of workers' human rights.

Abstract

Perkembangan kerja jarak jauh meningkatkan fleksibilitas, namun belum diikuti regulasi khusus yang mengatur hubungan kerja dan jaminan sosial. Akibatnya, standar jam kerja, K3, perlindungan upah, dan kepesertaan program jaminan sosial menjadi tidak jelas. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan studi kasus melalui analisis peraturan perundang-undangan serta praktik pelanggaran hak pekerja jarak jauh. Ditemukan tiga persoalan utama: (1) ketidakjelasan status hubungan kerja digital, (2) lemahnya pengawasan kepesertaan BPJS Ketenagakerjaan, dan (3) kendala yurisdiksi pada pekerjaan lintas wilayah dan lintas negara. Kondisi ini menurunkan akses pekerja pada manfaat jaminan kecelakaan kerja, kematian, hari tua, dan kehilangan pekerjaan. Perlindungan pekerja jarak jauh masih parsial dan belum setara dengan pekerja konvensional. Diperlukan pembaruan regulasi khusus kerja jarak jauh, integrasi basis data ketenagakerjaan dengan BPJS untuk pengawasan digital, serta harmonisasi norma ketenagakerjaan dan jaminan sosial agar kepatuhan meningkat dan perlindungan menjadi lebih inklusif. Remote work in Indonesia expands flexibility but lacks specific regulations governing employment relations and social security, creating uncertainty over working hours, OSH, wage protection, and mandatory coverage. This study adopts a normative juridical method with a case-study approach, analyzing legislation and reported cases involving remote workers rights violations. Three critical issues emerge: (1) ambiguity in digital employment relationships, (2) weak supervision of BPJS Ketenagakerjaan enrollment and compliance, and (3) jurisdictional challenges across regions and borders, leading to limited access to social security benefits. Protection for remote workers remains fragmented and unequal compared with conventional workers. Targeted remote work regulation, interoperable digital monitoring systems between labor databases and BPJS, and harmonized labor social security rules are needed to strengthen compliance and ensure equitable protection in Indonesia’s evolving labor ecosystem.

Abstract

The reform of criminal law constitutes an unavoidable response to the dynamic development of societal values and demands for justice. The enactment of the New Criminal Code, particularly the recognition of living law in Article 2, has generated fundamental debate concerning its implications for the principle of legality. This article aims to examine the philosophical and normative foundations of the inclusion of living law and to critically analyze the appropriate limitations of living law as a manifestation of material legality within the framework of criminal law reform. This study employs normative legal research using a statutory approach and a conceptual approach. The analysis of Article 2 of the New Criminal Code is conducted through systematic interpretation, by positioning the living law clause within the overall structure of the criminal law system, and teleological interpretation, by examining its objectives in balancing justice and legal certainty. The study is grounded in legal positivism and the doctrine of legal certainty as its primary theoretical analytical tools to assess the coherence of living law with the fundamental principles of legality, particularly lex certa, lex stricta, and lex scripta. The findings indicate that the principle of legality in the New Criminal Code is formulated in a material sense by acknowledging legal values that live and develop within society, in line with Article 28 of the Law on Judicial Power, which obliges judges to explore and understand the living values of law and justice. Nevertheless, the recognition of living law without clear normative boundaries poses a potential risk to legal certainty and predictability in criminal law enforcement. Therefore, this article argues that living law must be strictly limited through formal regulation at the provincial level, as mandated by Article 2 of the New Criminal Code. Such limitations are essential to ensure the protection of customary law maintained by Indigenous Communities while simultaneously safeguarding the principle of legality as the core foundation of criminal law.
