Abstract

Korupsi pada sektor pengadaan barang dan jasa pemerintah semakin meningkat dari tahun ke tahun baik dari segi jumlah kasusnya maupun dari segi nilai kerugian negara yang ditimbulkan. Korupsi dalam proses pengadaan barang dan jasa pada umumnya terjadi karena adanya penyalahgunaan wewenang dari penyelenggara negara yang terlibat dalam proses pengadaan mulai dari perencanaan sampai pada diterimanya barang dan jasa oleh Penggguna Anggaran (PA) atau Kuasa Pengguna Anggaran (KPA). Pada umumnya terpidana kasus korupsi pada sektor pengadaan didakwa dengan menggunakan Pasal 3 jo Pasal 18 ayat (1) huruf b Undang-Undang Republik Indonesia Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana diubah dengan Undang-Undang Republik Indonesia Nomor 20 Tahun 2001 tentang perubahan atas Undang-Undang Republik Indonesia Nomor 31 tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi. Salah satu unsur yang wajib dibuktikan oleh Jaksa Penuntut Umum pada persidangan adalah unsur penyalahgunaan wewenang disamping unsur yang lain juga perlu dibuktikan khususnya berkenaan dengan unsur adanya kerugian negara secara nyata. Dengan berlakunya Undang-Undang Republik Indonesia Nomor 30 Tahun 2014 Tentang Administrasi Pemerintahan, terdapat disharmonisasi perundang-undangan terkait kompetensi dan prosedur pembuktian penyalahgunaan wewenang.

Abstract

As a potential natural wealth, mining sectors should be managed with proper rules. Therefore, control instruments are needed in the form of mining business licenses to prevent the negative impact of mining management. At the stage of production operations, the requirements that must be met by businesses are administrative, technical, environmental, and financial. This paper aims to describe maladministration in the issuance of mining business license process especially on upgrading process of exploration permits to production operating permits. This research is a normative juridical research with statute approach and case approach. The results showed that the issuance of mining business license production operation (IUP OP) of PT. Aneka Tambang, Tbk based on the Decree of the Regent of North Konawe No. 158 of 2010 does not meet the technical requirements, especially regionally because the IUP is overlapping 11 other IUP with the same commodity, and there is an IUP OP area which not a part of the exploration area.

Abstract

Salah satu hak bagi ABH yang masih terabaikan adalah masih terdapat ABH yang masih dilakukan penahanan di Rutan bercampur dengan tahanan dewasa yang seharusnya penahanan dilakukan pada LPKS dan/atau LPAS agar tidak bercampur dengan tahanan dewasa sehingga anak rentan mendapatkan pengaruh buruk. Adapun rumusan masalah dalam penelitian ini yakni Bagaimanakah praktik penahanan ABH dalam rangka menghadapi proses hukum? Apa bentuk maladministrasi yang terjadi dalam proses penahanan ABH dalam menjalani proses hukum? Penelitian ini masuk dalam penelitian hukum normatif dengan menggunakan metode pendekatan perundang-undangan (statute approach) dan Pendekatan konseptual (conceptual approach). Berdasarkan hasil penelitian disimpulkan bahwa proses penahanan terhadap ABH dalam rangka menjalani proses hukum masih bercampur dengan tahanan orang dewasa akibat belum tersedianya LPKS dan/atau LPAS. Adapun bentuk maladministrasi yang terjadi akibat belum tersedianya LPKS dan/atau LPAS yaitu, pengabaian kewajiban hukum, penundaan berlarut, dan penyimpangan prosedur dalam penyelenggaraan pelayanan publik. Kata kunci: Maladministrasi, pemenuhan, Hak ABH One of the rights for ABH that is still neglected is that there are still ABH who are still being held in detention centers mixed with adult prisoners who should be held at LPKS and / or LPAS so as not to mix with adult prisoners so that children are vulnerable to bad influences. The formulation of the problem in this study is: How is the practice of ABH detention in order to face the legal process? What forms of maladministration occur in the process of detention of ABH in undergoing legal proceedings? This research is included in normative legal research using the statutory approach method statute approach and conceptual approach. Based on the results of the study, it was concluded that the detention process for ABH in the context of undergoing legal proceedings is still mixed with adult detention due to the unavailability of LPKS and / or LPAS. Abstract

The role of the Commitment Making Officer (PPK) is very important to ensure procurement objectives are achieved by reviewing the results of the selection of government procurement of goods and services so that the entire procurement process is carried out transparently, fairly and in accordance with applicable regulations. This research aims to analyze whether the process of reviewing election results in procurement process No. 15117081 carried out by PPK Southeast Sulawesi has complied with the principles of transparency, accountability and fairness in selecting tender winners based on LKPP Regulation No. 12 of 2021. The research method used is a legal research method with a statutory approach and case study. The results of the research show that the implementation of the review by the PPK in the aquo case is not in accordance with the provisions of LKPP regulation No.12 of 2021. The review should be carried out by the PKK only based on the Minutes of Election Results (BAHP) documents received, not providing field evidence or clarification to participants or other parties. The implication of these findings is that there is a potential violation of the principles of government procurement of goods and services which must be carried out transparently, fairly and in accordance with regulations.

Abstract

The corruption case involving the former North Konawe regent, Aswad Sulaiman, was acquitted by the Kendari Corruption Court in 2017, according to decision Number 56/Pid.Sus-TPK/2016/PN.Kdi. While the Supreme Court Cassation decision number 1964 K/PID.SUS/2017 decided that Defendant Aswad Sulaiman was proven legally and convincingly guilty of committing a crime by jointly committing an ongoing criminal act of corruption, imposing a prison sentence of 6 years and an IDR 200 million fine. If not paid, it will be replaced with imprisonment for 6 months, punished for producing a compensation of IDR 3,310,639,545 (three billion three hundred ten million six hundred thirty-nine thousand five hundred and forty-five rupiah). This study focuses on the legal ratio of the panel of judges in imposing an acquittal in the corruption case Number 56/Pid.Sus-TPK/2016/PN.Kdi and decision number 1964 K/PID.SUS/2017. This study used normative legal research with a statutory approach and a case approach, Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption, which was last amended by Law Number 20 of 2001. The results are that the recovery of state financial losses must be investigated as the starting point that the defendant has committed corruption by not releasing him from criminal responsibility but only as a basis for mitigating considerations for the defendant. The judges deciding this case have at least gone through 3 stages: constating, qualifying, and constituting.

Abstract

This study examines the position of the Election Supervisory Agency (Bawaslu) as a third party in election disputes in Indonesia. Bawaslu plays an important role in the supervision and resolution of election disputes, including in handling administrative violations and election crimes. Research shows that Bawaslu faces challenges in harmonizing authority with other institutions, such as the KPU and the Constitutional Court, as well as in increasing public participation in election supervision. Through a normative juridical approach, this study highlights the need for regulatory clarity and collaboration between institutions to realize democratic and transparent elections.

Abstract

Regional elections are a means of exercising popular sovereignty that allows citizens to directly elect leaders at the regional level while providing legitimacy to democratically elected governments. In their journey, political elites often use various methods to become contestants or to prevent their political opponents from competing by changing various legal rules that are considered ‘obstructing’ their political goals through judicial review (JR) at the Supreme Court against regulations under the law. This study aims to analyse the ratio decidendi of Supreme Court Decision No. 23 P/HUM/2024 which changes the age requirement for nominating regional head candidates from the age when they are determined as candidates by the KPU to the inauguration requirement. This research is a type of legal research using 2 (two) types of legal approaches, namely statute approach and conceptual approach. The results showed that the ratio decidendi in the case considered the importance of providing opportunities for the younger generation to participate in the political process and the human rights aspect that age restrictions can be considered a violation of individual political rights.This consideration is a real mistake considering that the position of the judge in deciding JR cases at the Supreme Court acts as a Negative Legislator who is limited to making an assessment of whether the regulation that is the object of the test is contrary to the law as the touchstone?Textually, the KPU regulation that is the object of the test is still in line with the Law so that the petition should be rejected.

Abstract

The idea of revising the 1945 Constitution is likely to spark debate. Nevertheless, Article 37 of the 1945 Constitution has provided a mechanism for amendment, rather than replacement, of the constitution. The amendments to the 1945 Constitution are now mandatory, as previously decreed by the MPR leadership, which will be continued by the current leadership. This paper examines the role of public participation in the amendment of constitutions in Indonesia and Thailand. The study employs a normative legal research approach, utilizing statutes, conceptual frameworks, and comparative analyses. Data was collected from books, academic journals, relevant laws, and regulations. The results indicate that the forms of public participation in Indonesia and Thailand in the constitution-making and amendment processes are largely similar, including public hearings, working visits, socialization, seminars, workshops, and discussions. However, a notable difference exists in that Indonesia lacks explicit provisions for public participation in its constitutional amendment process, whereas Thailand has established clear regulations. It is recommended that Indonesia clearly regulate public participation as a procedure in its constitution-making and amendment processes.

Abstract

Control of the land plot must be proven through a valid certificate of ownership. In its development, it was found that there were duplicate certificates that overlapped each other. This study aims to provide an analysis related to the issuance of double certificates and the mechanism for their completion. This research is a normative juridical research with a legislative approach and a conceptual approach. The results of the study show that double certificates arise as a result of various factors, including administrative errors, lack of supervision, and the practice of abuse of authority in issuing certificates, thus creating legal uncertainty for land rights holders. The legal settlement requires a comprehensive approach, involving the improvement of the land administration system, and strict enforcement of any violations.

Abstract

Introduction: Elections for regional heads and heads of government are one of the important aspects in building a democratic system that encourages citizen participation in the political process.Purposes of the Research:  This study aims to describe the dynamics and challenges of democracy associated with the implementation of regional elections in several countries. Local elections are a major test of a country's democratic health, and a variety of factors can affect the outcome and integrity of the process.Methods of the Research: This research is legal research using two legal approaches, namely the statute approach and the comparative approach.Results of the Research: The results showed that regional elections have complex dynamics and several significant challenges in the context of democracy. These dynamics include intense political competition, increased public participation, and changes in political communication through social media. While the challenges that need to be faced in regional elections include contests involving incumbents, fraud in elections, political money, voter participation, political polarization, and the integrity of organizers that occur in Indonesia and in the Netherlands. Thus, this study shows that regional elections are not only a political event, but also a test of the quality of a country's democracy. Concerted efforts to address these challenges will play a key role in maintaining and strengthening democratic systems that are healthy and responsive to people's needs.
