Abstract

A common issue in Indonesian divorces is infidelity, as evidenced by the frequent circulation of divorce news on social media. Infidelity has become a prevalent trend, particularly within families, influenced by various factors, including the advancement of increasingly sophisticated technology. Moreover, the problem of infidelity remains contentious, with assumptions and arguments that sometimes justify condoning infidelity or even endorsing divorce. This study explores why infidelity has emerged as a significant socio-religious issue in contemporary Muslim family discourse. The analysis interprets infidelity and examines responses such as forgiveness and divorce through the lens of Jamaluddin Athiyyah's Maqashid al-Usrah framework. The research employs normative legal methods, library research, and document analysis. The findings suggest the necessity of strengthening Islamic family ethics, focusing on protecting dignity, ensuring relational justice, and preventing broader socio-religious harm.

Abstract

Criminal acts committed by children are increasingly frequent in Indonesia. The state is responsible for providing special protection for their rights. Law No. 11 of 2012 on the Juvenile Criminal Justice System was introduced as a state response to the need for a child-friendly justice system. This research aims to analyze the legal protection of children who commit criminal acts from the perspective of John Rawls' theory of justice. This study employs a normative legal method using statutory and conceptual approaches. Data sources were obtained through literature studies using primary and secondary legal materials such as legislation, academic literature, and journals. Law No. 11 of 2012 provides legal protection for child offenders through diversion mechanisms and the application of restorative justice. These measures are taken to avoid the imprisonment of children, protect their fundamental rights, and ensure a humane and educational judicial process. The government also emphasizes the involvement of the community and families in the child’s recovery process. The protection of children under Law No. 11 of 2012 aligns with the two main principles of John Rawls' theory of justice: the principle of equal liberty and the difference principle. Children, as a vulnerable group, are positioned as individuals whose rights must be guaranteed equally with other children and who must receive special treatment to ensure substantive justice. This law reflects a legal partiality toward children as the most disadvantaged group within the criminal justice system.

Abstract

This study aims to analyze the social construction of kiai authority within the pesantren tradition that enables the abuse of power in the form of sexual violence against female students, as well as to examine how state law delegitimizes such authority through the Sumenep District Court Decision Number 136/Pid.Sus/PN Smp. This research employs a normative legal research method using statutory approach and case approach. The research data consist of primary and secondary legal materials analyzed descriptively and analytically through Peter L. Berger’s social construction theory. The findings reveal that kiai authority is formed through the processes of externalization, objectification, and internalization, positioning the kiai as a religious figure possessing strong moral and spiritual legitimacy. This condition creates hierarchical power relations that encourage the absolute obedience of students, thereby opening opportunities for the manipulation of authority, intimidation, and sexual violence. The court decision in this case demonstrates that state law functions as a corrective mechanism that dismantles the social construction of kiai authority when it is used to legitimize criminal acts. The novelty of this study lies in positioning a court decision as a social archive to explain the delegitimization of kiai authority through Peter L. Berger’s social construction theory, thereby extending socio-legal analysis within the pesantren context. The findings imply the need to strengthen institutional accountability mechanisms and student protection systems to ensure that religious legitimacy cannot be misused to justify criminal conduct. This study emphasizes the importance of strengthening student protection mechanisms, institutional supervision within pesantren, and legal awareness to prevent the abuse of religious authority. Abstract

Abstracts: This study examines the implementation of restorative justice through the mechanism of penal mediation within Indonesia's criminal justice system, using John Rawls’ theory of justice as a theoretical framework. The research is grounded in the need for a more humane, participatory, and efficient alternative for resolving minor criminal offenses, as opposed to the conventional retributive justice system. This is a normative legal study employing both statutory and conceptual approaches. The data sources consist of primary and secondary legal materials obtained through literature review. The findings reveal that penal mediation has been applied in cases such as petty theft, defamation, and domestic violence, involving offenders, victims, families, and the community in the restorative process. This implementation reflects Rawls’ principles of justice particularly the equal basic liberties and the difference principle—in protecting vulnerable groups such as juvenile offenders and first-time offenders. In conclusion, penal mediation aligns not only with restorative justice values and the Islamic legal concept of maslahah, but also embodies a substantive model of justice that is inclusive and responsive to local values. Therefore, this approach deserves to be formally institutionalized within the national criminal law system.Keywords: Penal mediation, restorative justice, John Rawls’ theory of justice, Indonesian criminal law, non-litigation resolution.Abstrak : Penelitian ini mengkaji penerapan keadilan restoratif melalui mekanisme mediasi penal dalam sistem peradilan pidana Indonesia, dengan menggunakan perspektif teori keadilan John Rawls. Latar belakang penelitian ini berangkat dari kebutuhan untuk menghadirkan alternatif penyelesaian perkara pidana ringan yang lebih manusiawi, partisipatif, dan efisien dibandingkan sistem peradilan konvensional yang cenderung retributif. Penelitian ini merupakan studi hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Sumber data diperoleh dari bahan hukum primer dan sekunder melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa mediasi penal telah diterapkan dalam sejumlah kasus seperti pencurian ringan, penghinaan, dan kekerasan rumah tangga, dengan melibatkan pelaku, korban, keluarga, dan masyarakat dalam proses pemulihan. Implementasi ini mencerminkan prinsip keadilan Rawls, yaitu kebebasan dasar yang setara dan prinsip perbedaan, khususnya dalam melindungi pelaku dari kelompok rentan seperti anak dan pelaku pertama. Kesimpulannya, mediasi penal bukan hanya sejalan dengan nilai-nilai keadilan restoratif dan maslahah dalam hukum Islam, tetapi juga mencerminkan prinsip keadilan substantif yang inklusif dan adaptif terhadap nilai lokal. Oleh karena itu, pendekatan ini layak untuk dilembagakan secara normatif dalam sistem hukum pidana nasional.Kata kunci: Mediasi penal, keadilan restoratif, teori keadilan John Rawls, hukum pidana Indonesia, penyelesaian non-litigasi.

Abstract

Divorce among civil servants (PNS) has been increasingly prevalent in Bojonegoro Regency over the past four years. The majority of these cases are dominated by domestic violence (KDRT) and infidelity. There are specific regulations in Government Regulation No. 45 of 1990 concerning civil servants' benefits, which indicate that the status of civil servants is different from that of the general public. This study focuses on the dysfunction of Article 8, which governs the division of one-third of a civil servant’s salary after divorce. This research uses empirical legal research or field research with a qualitative approach. Primary data was obtained from semi-structured interviews with religious court judges in Bojonegoro. The findings of this study reveal that Article 8, which regulates the division of civil servant salaries, is not fully implemented in the Bojonegoro state court or experiences dysfunction. This is due to the potential harm that may arise after the divorce if it is applied in civil servant divorce cases, such as the continued use of alimony by the ex-wife from her former husband until she remarries. This also opens the possibility that if the ex-wife enters into a religious marriage, alimony from the ex-husband will continue to be paid to the ex-wife and her new husband.
