Abstract

Pasar merupakan salah satu tempat bagi masyarakat untuk melakukan kegiatan jual beli barang ataupun jasa. Entitas pasar mampu menggerakkan roda perekonomian guna mencapai masyarakat yang maju, mandiri dan sejahtera. Kesejahteraan rakyat merupakan tujuan dari setiap pemerintahan, baik pusat maupun daerah dan sejalan amanat UUD 1945 Pasal 33. Tanpa tujuan kesejahteraan bagi seluruh masyarakat, arah pembangunan suatu daerah dapat diprediksi rentan terhadap penyalahgunaan oleh pihak-pihak tertentu yang bertujuan untuk memonopoli kesejahteraan diri sendiri, kelompoknya atau kelompok tertentu dalam jaringannya. Artikel ini mencakup aspek pengelolaan pasar dimana Penelitian hukum empiris dilakukan dengan penelusuran bahan-bahan kepustakaan untuk selanjutnya digunakan sebagai landasan dalam menganalisis permasalahan yang diteliti Lokus penelitian di Kabupaten Wonogiri. Langkah pengumpulan data penelitian melalui observasi, wawancara mendalam dan studi Pustaka. pemerintah daerah yang mengimplikasikan bahwa otonomi daerah tidak lagi dimaknai sebagai perpindahan kewajiban dari pemerintah pusat ke pemerintah daerah, namun sebagai pelimpahan kewenangan dari pemerintah pusat ke pemerintah daerah untuk pemerataan pembangunan dan ekonomi di daerah

Abstract

Regional Head Elections are one of the main pillars of democracy in Indonesia. A fair, transparent, and efficient regional election process is very important to ensure legitimacy and public trust in the results of general elections because currently the election process is often considered not transparent so that the results are considered less than satisfactory. Therefore, innovation and breakthroughs are needed that can support the regional election process, which can increase the number of people participating in casting their votes, and the results can be received as well as possible. Information technology (IT) has great potential in supporting the implementation of democratic regional elections by improving various aspects, starting from voter registration, including updating the voter list, to the final stage of vote counting. This study aims to explore how information technology can be used to support democratic regional elections. The main focus of this study is on the identification and analysis of technology that can increase transparency, accountability, public participation, and security of the regional election process. This research method uses a qualitative approach with a literature review method. Data was collected from various sources, including scientific journals, news articles, and comparative studies of IT implementation in elections in various countries.

Abstract

This study aims, first, to analyze the legal reasoning of the Constitutional Court in Decision Number 115/PUU-XXII/2024, which annulled the phrase "riots" in Article 28 paragraph (3) and Article 45A paragraph (3) of Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 on Electronic Information and Transactions. Second, it seeks to examine the implications of this annulment for the scope of freedom of expression and the potential regulation of hate speech or incitement in Indonesia's digital sphere. It further explores how this Constitutional Court decision may influence the dynamics of digital democracy, particularly in the context of public criticism and online participation in Indonesia. This study employs a qualitative research method, with the primary legal material being Constitutional Court Decision Number 115/PUU-XXII/2024 on the Judicial Review of Provisions in Law Number 1 of 2024. The findings reveal that the Constitutional Court's removal of the phrase "riots" has the potential to broaden the space for digital freedom of expression, but it also presents new challenges in maintaining public order. Therefore, a deeper understanding of the boundaries of freedom of expression in the digital age is required, along with the development of effective legal and non-legal mechanisms to balance expressive freedom and social order.

Abstract

This study analyzes the paradigmatic dilemma of Indonesia’s narcotics law: the necessity of strict prosecution against transnational syndicates versus the humanitarian crisis of prison overcrowding caused by the incarceration of addicts. Law Number 35 of 2009 concerning Narcotics embodies a philosophical dualism (retribution vs. rehabilitation), yet its implementation is dominated by a punitive orientation. The purpose of this research is to analyze the philosophical tension within Law 35/2009 and project the implications of its legislative synchronization with the restorative principles in the new Criminal Code (Law 1/2023). The method used is normative juridical with a prescriptive character, utilizing statutory, conceptual, and comparative approaches. The results conclude that the new Criminal Code risks significant failure in resolving the capacity crisis due to restrictions on alternative sanctions for crimes carrying penalties of over five years, which covers the majority of Narcotics cases. The codification attempt also potentially weakens the prosecution of transnational crimes due to the incomplete adoption of special investigation techniques. The primary recommendation is a firm legislative synchronization that separates jurisdiction: the new Criminal Code as lex generalis for minor users, and the Narcotics Law as a strengthened lex specialis to target dealers, supported by the implementation of factual decriminalization based on public health.
