Abstract

Abstrak Kemajuan zaman dalam bidang transportasi sudah ditransformasi dari sistem konvensional menjadi lebih multi-kreatif salah satunya dengan lahirnya transportasi berbasis online yang dapat dimanfaatkan oleh individu-individu maupun oleh kelompok. Saat ini, muncul berbagai macam jenis transportasi berbasis online, salah satunya Go-jek. Dalam penelitan ini digunakan metode penelitian hukum normatif/metode yuridis normatif. Hasil penelitian menunjukkan Terdapat dua pertanggungjawaban sebagai pelaksanaan perlindungan hukum yang diberikan oleh PT Gojek terhadap konsumen sebagai pengguna jasa transportasi online, yaitu tanggung jawab yang harus dilaksanakan sebaik-baiknya (responsibility) dan tanggung jawab ganti rugi (liability), yang diatur dalam Surat Perjanjian Kemitraan PT. Gojek Indonesia dengan Mitra Gojek tentang Klaim Asuransi. Perlindungan hukumnya adalah kecelakaan, objek pesanan rusak/hilang, objek tidak sampai ke konsumen. Caranya adalah driver Go-jek mendatangi Kantor Perusahaan PT. Go-jek untuk menyampaikan masalah yang dihadapi kepada perwakilan perusahaan dengan membawa dokumen-dokumen bukti pemesanan Go-jek. Upaya hukum yang dapat dilakukan oleh konsumen apabila hak-haknya tidak terpenuhi dapat dilakukan melalui dua cara, pertama melalui jalur non litigasi dan kedua melalui jalur litigasi. Jalur non litigasi dilakukan dengan cara mediasi, negosiasi, maupun konsiliasi yang dapat di fasilitasi dan didampingi oleh LPKSM atau Advokat. Namun apabila salah satu pihak tidak sepakat dengan penyelesaian yang telah dilaksanakan melalui jalur-jalur tersebut, maka Konsumen dapat menempuh jalur litigasi, yaitu jalur melalui pengadilan yang dapat ditempuh melalui proses hukum pidana maupun proses gugatan perdata untuk mendapatkan ganti rugi. Abstract The progress of the times in the field of transportation has been transformed from a conventional system to a more multi-creative one, one of which is the birth of online-based transportation that can be used by individuals and by groups. Currently, various types of online-based transportation appear, one of which is Go-Jek. In this research, normative legal research methods/normative juridical methods are used. The results of the study show that there are two responsibilities as the implementation of legal protection provided by PT Gojek to consumers as users of online transportation services, namely responsibilities that must be carried out as well as possible (responsibility) and responsibility for compensation (liability), which are regulated in the Partnership Agreement. PT. Gojek Indonesia with Gojek Partners regarding Insurance Claims. The legal protection is an accident, the object of the order is damaged/lost, the object does not reach the consumer. The trick is the Go-jek driver comes to the PT. Go-jek to convey the problems encountered to company representatives by bringing documents proof of Go-jek orders. Legal remedies that can be taken by consumers if their rights are not fulfilled can be done in two ways, first through non- litigation and secondly through litigation. The non- litigation path is carried out by means of mediation, negotiation, or conciliation which can be facilitated and accompanied by LPKSM or an advocate. However, if one of the parties does not agree with the settlement that has been carried out through these channels, then the consumer can take litigation, namely the path through the courts that can be taken through criminal law processes or civil lawsuits to obtain compensation. Abstract

The determination of the qualification/degree of injury in the injury case is crucial in the criminal justice system, because it will be used as a consideration for law enforcement officials in determining criminal sanctions against violent perpetrators. The degree of injury when viewed from legal and medical aspects has several differences. In the legal aspect, the determination of the qualification/degree of injury is based on existing legal foundations, such as the Criminal Code and specific laws in cases of violence, for example domestic violence, violence against children and traffic accidents. Meanwhile, in the medical aspect, a doctor will consider starting from diagnosis, medical therapy needs and prognosis. There is one similarity in both aspects, namely the qualification/degree of serious injury, where in both aspects the basis of the criteria in article 90 of the Criminal Code is used. However, in practice in the field, the imposition of sanctions against the perpetrators will absolutely depend on the existing legal evidence and the judge's trust. This is in accordance with what is mentioned in the Criminal Procedure Code. The research method used in this study is a normative juridical method, which is a method that is carried out based on the main legal material by examining theories, concepts, legal principles and laws and regulations related to this research. This research will analyze legal issues, facts, and other legal phenomena related to the legal approach, then obtain a comprehensive picture of the problem to be researched. The assessment of the qualification/degree of injury from the legal and medical aspects uses different basis of consideration. From the legal aspect, it will be guided by the Criminal Code and specific laws depending on the case handled. From a medical aspect, it is guided by clinical/medical considerations of the effects of the injury caused on the victim's body.
