Abstract

Islam adheres to a patriarchal culture, where men are held higher than women, as is the deepest in the word of Allah. Meanwhile, feminists oppose and reject the patriarchal system because it is considered that women are only capable of performing reproductive functions such as; giving birth, raising children and carrying out household responsibilities As for liberal feminism, it emphasizes that women and men are created equal, have the same rights and must be given the same opportunities. Liberal feminist thought is known for advocating for gender equality, individual freedom, and rejection of discrimination against women in all its forms. In the context of Liberal Feminism, a review of the Compilation of Islamic Law can provide a deeper understanding of how Islamic law is applied to women and how issues of gender equality and the role of women are addressed in the law. This research aims to better understand this liberal feminism mind in the compilation of Islamic law. The method used in this study is qualitative descriptive using literature review as the source of data. The result of this study is that in the compilation of Islamic law, there are actually several articles that support feminist thought, such as article 32 paragraph 2 of the KHI regarding property and several other articles. The conclusion of this study is that there is a compatibility between the rules in the KHI and the principles of liberal feminism as evidence that the KHI actually accepts the ideology of liberal feminism.

Abstract

Artikel ini dimaksudkan untuk menjelaskan bagaimana pelaksanaan Undang-Undang Perkawinan bernegosiasi dengan aturan-aturan adat dalam suatu komunitas masyarakat. Lazim dipahami bahwa pelaksanaan suatu hukum positif tidak serta merta terlaksana tanpa berdinamika dengan konteks sosial-kultural di mana ia berada, terlebih jika objek yang diatur tersebut sudah diatur terlebih dahulu dengan norma adat yang lebih lokalitstik. Artikel ini bertujuan untuk mengisi celah kekosongan penelitian dalam menjelaskan bagaimana hukum positif memberikan pengaruh terhadap praktik perkawinan yang sudah lama dipraktikkan masyarakat, serta bagaimana norma-norma adat mempengaruhi pelaksanaan norma hukum positif. Studi ini menggunakan pendekatan grounded theory dengan mengandalkan data yang diperoleh melalui wawancara, observasi, dan studi dokumen, sedangkan lokasi penelitian adalah salah satu kecamatan di wilayah Kota Sungai Penuh, Jambi. Artikel ini menunjukkan bahwa masyarakat Kota Sungai Penuh tidak merasa keberatan dengan ditambahkan syarat dalam prosedur registrasi nikah di Kantor Urusan Agama, yaitu harus mendapat persetujuan tertulis dari tokoh adat yang disebut tengganai walaupun syarat itu tidak tertera secara formal dalam dokumen Undang-Undang Perkawinan dan peraturan turunannya. Justru masyarakat menerima tambahan aturan ini sebagai bentuk sinergi yang baik antara aturan negara, aturan agama, dan aturan adat.This article aims to elucidate how the implementation of the Marriage Law negotiates with customary rules within a community. It is commonly understood that the implementation of positive law does not occur in isolation but dynamically interacts with the socio-cultural context in which it operates, especially when the subject matter is already regulated by more localized customary norms. This article seeks to fill a research gap in explaining how positive law influences long-standing marriage practices within a community and how customary norms impact the implementation of positive legal norms. The study employs a grounded theory approach, relying on data obtained through interviews, observations, and document analysis, conducted in one of the sub-districts in the city of Sungai Penuh, Jambi. The article demonstrates that the community in Sungai Penuh does not object to additional requirements in the marriage registration procedure at the Office of Religious Affairs, namely obtaining written approval from a customary figure known as tengganai, even though this requirement is not formally stipulated in the Marriage Law and its derivative regulations. Instead, the community perceives this additional rule as a form of synergistic collaboration between state, religious, and customary regulations.

Abstract

This research is motivated by the issue of the high costs of conducting walimatul ‘urs in Koto Padang Village, Tanah Kampung District, Sungai Penuh City, which often becomes a financial burden, especially for families with limited economic conditions. This study aims to analyze the community's perceptions regarding the implementation of walimatul ‘urs in the village. The method used is qualitative, with data collection techniques through observation, interviews, and documentation. Data analysis was carried out through stages of data reduction, data presentation, verification, and conclusion drawing. The results of the study show that community perceptions are divided into two views. Some community members argue that the high costs of weddings reflect respect for the families of the bride and groom and the invited guests, thus becoming a symbol of social honor. However, some others believe that the high costs become a financial burden. Economically, the implementation of a wedding feast impacts the financial condition of both families. Psychologically, this event brings joy to the bride and groom. From a socio-cultural perspective, this tradition strengthens family ties and community solidarity. This study recommends strengthening Islamic education so that the wedding feast can be held more simply without diminishing the meaning of togetherness.

Abstract

Inequality in gender roles is still one of the causes of low psycho-social and sociocultural resilience in families. In response to this issue, the Family School Program is present to build equal gender partnerships and strengthen family resilience. This study used a quantitative approach with descriptive analysis, involving 86 purposively selected Family School participant families. The instrument used was the Family Resilience questionnaire from the Ministry of PPPA. The results showed that 77 families had implemented gender partnership, while 9 had not. A total of 54 families had socio-psychological resilience, and 73 families showed sociocultural resilience. Overall, 19 families were rated as low resilience, 63 as moderate, and only 3 as high. This research shows that most families are at the medium level of resilience. This study looks at the integration of gender and cultural perspectives in the context of family strengthening and contributes to more effective family-school development programs and psycho-social and local value-based interventions.

Abstract

This research discusses the situation where many pilgrims do not have tashrih in performing Hajj. Where the purpose of this study is to determine the correlation of tasrih to the mandatory requirements of Hajj and the position of the predicate status of the pilgrims. The research method used is qualitative, namely literature with an explanatory approach. The primary data source is Law No. 8 of 2019 concerning the Implementation of Hajj and Umrah (PIHU). Data was collected with documentation and conclusions were drawn with descriptive analysis techniques. The research findings state that tasrih is an official permit issued by the government of Saudi Arabia for pilgrims who want to visit Raudhah in the implementation of Hajj. If pilgrims do not have tasrih, they will be arrested and deported by the Saudi Arabian authorities because they do not have complete administrative requirements as a mandatory requirement for Hajj participants in carrying out their religious rituals. Regarding the title of mabrur Hajj, they are literally not included in the category because they performed Hajj fraudulently or illegally. However, those who are fortunate enough to perform Hajj without this authority (tasrih), their Hajj is still considered valid
