Abstract

Pendidikan karakter berbasis Pancasila merupakan landasan dalam membentuk mahasiswa Program Studi Pendidikan Pancasila dan Kewarganegaraan (PPKN) yang memiliki kemampuan berpikir kritis. Penelitian ini bertujuan untuk mengidentifikasi strategi penguatan pendidikan karakter berbasis Pancasila dalam membangun keterampilan berpikir kritis mahasiswa. Metode yang digunakan adalah pendekatan kualitatif dengan analisis data deskriptif. Hasil penelitian menunjukkan bahwa penerapan nilai-nilai Pancasila dalam pembelajaran dapat meningkatkan kemampuan analisis dan evaluasi mahasiswa terhadap isu sosial, politik, dan kebangsaan. Abstract

In 1997 the government regulated the policy of granting ownership rights to very simple houses and simple houses through KMNA/KBPN No. 9 of 1997 and KMNA/KBPN No. 6 of 1998 concerning Granting Ownership Rights to Residential Houses. The existence of this decision is very beneficial for land owners and residential houses located in housing complexes built by developers and for Indonesian citizens who own land with Building Use Rights for residential homes, it is easy to obtain changes to their land rights into Ownership Rights. To address the fact that in the statutory regulations, regulations regarding changing the status of Building Use Rights to Ownership Rights, it is deemed necessary to provide counseling/lectures so that the community in Merjosari Village, Lowokmaru District, Malang City knows the process and obstacles encountered in changing the status of Use Rights. The building becomes property rights. The counseling/lecture on the topic of changing the status of Building Use Rights to Ownership Rights involved lecturers from the Law Faculty of Cipta Wacana Christian University as a service team and involved law students from Cipta Wacana Christian University. Community service activities carried out in Merjosari Village, Lowokmaru District, Malang City can be said to have been carried out well in accordance with expectations.

Abstract

This article examines the impact of Constitutional Court Decision No. 105/PUU-XXII/2024, which restricted criminal defamation claims by institutions under the Electronic Information and Transaction Law. The ruling asserts that only individual persons—not state bodies, corporations, professions, or institutional entities—may file criminal defamation reports. Employing a normative legal method with statutory and constitutional approaches, the study analyses the decision’s implications for public oversight over governmental power, democratic deliberation, and institutional accountability. This paper argues that the decision strengthens citizens’ freedom of expression and the informal mechanism of checks and balances, while also reducing the potential misuse of criminal defamation provisions to silence criticism. However, the effectiveness of the ruling depends on judicial interpretation, harmonisation with other legal frameworks, and the institutional internalisation of democratic norms. The research concludes that although the decision contributes to the protection of civil liberties, a more systematic enforcement strategy, judicial guidelines, and legal reform are required to prevent retaliatory litigation through non-criminal avenues. Furthermore, this study contributes to constitutional scholarship by positioning the decision as a landmark shift from state-centred reputational protection towards citizen-centred constitutional guarantees. It highlights the need for a coherent legal architecture that safeguards critical expression as an essential component of democratic control over power. By mapping doctrinal consequences and practical enforcement gaps, this article offers a framework for evaluating future court rulings and policy reforms related to defamation, digital rights, and state accountability in Indonesia. Thus, the decision not only redefines the boundaries of criminal defamation but also provides momentum for strengthening constitutional democracy through legal culture transformation, legislative harmonisation, and strategic judicial oversight.

Abstract

Islamic education operates within increasingly complex legal and governance frameworks shaped by state regulation, accountability demands, and educational standardization. While state law aims to ensure institutional legitimacy and quality assurance, it simultaneously raises questions regarding autonomy and the preservation of pedagogical identity within Islamic educational institutions. This study examines how Islamic education negotiates governance, autonomy, and pedagogical identity under state law through a qualitative library-based research approach. Drawing on scholarly literature, policy documents, and legal texts related to Islamic education and educational governance, the study employs thematic analysis to explore patterns of regulatory adaptation and institutional response. The findings reveal that governance in Islamic education is best understood as a negotiated process rather than a unilateral exercise of state control. Islamic educational institutions tend to adopt selective administrative compliance to meet legal requirements while maintaining substantive autonomy in pedagogical and moral domains. Autonomy emerges as relational and context-dependent, shaped by ongoing interactions between state regulation, institutional leadership, and religious tradition. Pedagogical identity proves to be the most resilient dimension of autonomy, largely sustained through internal leadership authority and the reinterpretation of regulatory frameworks. The study contributes theoretically by advancing the concept of negotiated governance in the context of Islamic education, challenging binary views of regulation versus autonomy. From a policy perspective, the findings suggest that adaptive and dialogical regulatory approaches are more effective in supporting educational quality and institutional sustainability. Overall, this study positions Islamic education as an active educational actor capable of engaging constructively with state law while safeguarding its pedagogical distinctiveness.
