Abstract

Polygamy (addud al-zaujat) has been a significant issue in husband-wife relationships throughout the history of Islamic civilization. One contributing factor to the practice of polygamy is the lack of understanding regarding its underlying reasons or motives. This study aims to analyze the sanctions imposed on Civil Servants engaging in polygamy based on the Quranic perspective in Surah An-Nisa Verse 3 and according to Indonesian Law No. 1 of 1974. The research employs a library research methodology, utilizing primary sources such as the Al-Misbah commentary and secondary sources including the Quran, Hadith, Law No. 1 of 1974, and the Compilation of Islamic Law. The findings reveal two key points. First, for civil servants practicing polygamy, the condition of fairness is emphasized. Material fairness includes equal treatment in terms of rotation, living expenses, food, clothing, and housing. However, emotional fairness, involving love and feelings of the heart, is not mandated. Second, civil servants engaging in polygamy without proper authorization face four possible sanctions: i) demotion, ii) removal from office, iii) honorable dismissal without personal request, and iv) dishonorable dismissal. Female civil servants who become a second, third, or fourth wife are subject to dishonorable dismissal from their civil service roles.

Abstract

This study analyzes the law of breastfeeding in hadith from the perspective of Article 39 of the Compilation of Islamic Law (KHI), which regulates marriage prohibitions. The law of breastfeeding is explicitly outlined in the hadiths of Prophet Muhammad (PBUH), which establish that a mahram status is created after five complete feedings by a baby, forming the basis for the prohibition of marriage between those related by breastfeeding. Furthermore, Article 39 of the KHI reinforces this principle by stating that breastfeeding relations hold the same status as kinship relations concerning marriage prohibitions. Through a normative-juridical approach, this study finds that breastfeeding regulations serve to maintain clarity in lineage and family structure, as well as prevent prohibited marriages in Islam. Therefore, both in the hadith and the KHI, breastfeeding law plays a crucial role in protecting family integrity and lineage, while upholding the principles of mahram (non-marriageable kin) in Islam.

Abstract

This study aims to explore how Mandailing cultural symbols are interpreted and practiced within Islamic families, and how these symbols contribute to the development of childrens empathy amid social change. Symbols such as Dalihan Na Tolu, marbagas, and umpasa serve as vehicles for transmitting values of compassion, respect, and social responsibility. Within Mandailing society, where Islamic values such as rahmah and adab coexist with local traditions, families become dialectical spaces for culturally contextualized character education. The research was conducted in Kayu Laut Village, Mandailing Natal Regency, using a qualitative approach with Interpretative Phenomenological Analysis (IPA) to examine the symbolic meanings embedded in the lived experiences of seven Mandailing Muslim families. Data were collected through in-depth interviews, participant observation, and cultural documentation. The findings reveal that symbolic cultural practices function as effective pedagogical tools for internalizing empathy through emotionally and socially rich experiences. Despite the pressures of modernization, families demonstrate active resistance by reconstructing symbolic practices while preserving their core values. This study contributes to the fields of cultural sociology and Islamic character education, and emphasizes the importance of culturally rooted strategies in family-based education.AbstrakPenelitian ini bertujuan untuk memahami bagaimana simbol-simbol budaya Mandailing dimaknai dan dipraktikkan dalam keluarga Islam, serta bagaimana simbol tersebut berkontribusi terhadap pembentukan empati anak di tengah perubahan sosial. Simbol-simbol seperti Dalihan Na Tolu, marbagas, dan umpasa berperan sebagai medium internalisasi nilai kasih sayang, penghormatan, dan tanggung jawab sosial. Dalam konteks masyarakat Mandailing yang juga religius, nilai-nilai Islam seperti rahmah dan adab berjalan seiring dengan adat, menciptakan ruang pendidikan karakter yang bersifat dialektis dan kontekstual. Penelitian ini dilakukan di Desa Kayu Laut, Kabupaten Mandailing Natal, dengan pendekatan kualitatif dan metode Interpretative Phenomenological Analysis (IPA), untuk menggali makna simbolik dari pengalaman subjektif tujuh keluarga Mandailing Muslim. Data diperoleh melalui wawancara mendalam, observasi partisipatif, dan dokumentasi simbolik budaya. Hasil penelitian menunjukkan bahwa praktik simbol budaya menjadi wahana internalisasi empati melalui keterlibatan sosial anak yang emosional dan reflektif. Meskipun modernisasi menghadirkan tantangan, keluarga mampu melakukan resistensi aktif dengan merekonstruksi simbol budaya tanpa menghilangkan nilai intinya. Penelitian ini memberikan kontribusi pada kajian sosiologi dan pendidikan karakter Islam, serta mengusulkan perlunya penguatan pendekatan berbasis budaya dalam strategi pendidikan keluarga.

Abstract

Cuisine is an essential aspect of cultural heritage, carrying historical value and serving as a marker of local identity. Palembang is widely recognized for its distinctive culinary tradition, particularly pempek, which is not only a wellknown dish but also a symbol embedded in the cultural practices of its people. This article examines the role of cuisine in shaping cultural identity, social differentiation, and economic sustainability, with a specific focus on pempek. Employing a qualitative descriptive approach and literature analysis, this study explores how pempek has evolved from an exclusive royal dish to a widely consumed culinary staple, transcending social and economic classes. Additionally, this research highlights the ritualistic aspects of pempek consumption, its symbolic meanings, and its contribution to the construction of Palembang’s cultural identity. The findings indicate that pempek functions as both a culinary artifact and a cultural marker, reinforcing social identity within the broader discourse of tourism and Indonesia’s culinary diversity. Moreover, the economic impact of pempek is evident in its role within home-based industries and micro-enterprises that sustain local livelihoods. The preservation of traditional cuisine, therefore, is not merely an act of cultural conservation but also a strategic effort to promote regional tourism and economic resilience. Abstrak Kuliner merupakan bagian dari warisan budaya yamg memiliki nilai historis dan identitas lokal. Kota Palembang dikenal dengan kuliner khasnya, salah satunya adalah pempek, yang tidak hanya menjadi ikon Kuliner tetapi juga memiliki makna simbolik dalam tradisi Masyarakat Palembang. Artikel ini membahas peran kuliner sebagai Identitas budaya, diferensiasi soasial, serta dampak ekonominya, dengan fokus pada pempek Palembang. Melalui pendekatan kualitatif deskriptif dan analisis literatur, penelitian ini mengungkap bagaimana pempek berkembang dari makanan istana menjadi hidangan rakyat yang dapat dinikmati semua kalangan. Selain itu, penelitian ini menyoroti keunikan dalam penyajian dan komsumsi pempek, serta peranannya dalam membangun identitas kuliner Palembang. Hasil penelitian menunjukan bahwa pempek bukan sekedar makanan, tetapi juga simbol budaya yang memperkuat identitas Masyarakat Palembang dalam konteks pariwisata dan keberagaman Indonesia. Lebih lanjut, pempek berkontribusi terhadap perekonomian lokal melalui industri rumahan dan isaha mikro yang menompang mata pencarian banyak Masyarakat. Oleh karena itu, pelestarian kuliner tradisional seperti pempek menjadi penting untuk mempertahan kan identitas budaya serta meningkatkan sektor pariwisata dan ekonomi daerah.

Abstract

Breastfeeding is a bonding of a mother to her baby which is natural to meet the basic needs of the baby so that it can grow and develop physically and psychologically properly. Islamic teachings explicitly regulate this in the Qur'an and Hadith, which aim to make the basic life processes of a child follow Islamic law. This study aims to analyze breastfeeding (ar-radha'ah) problems, especially regarding breastfeeding of non-biological children which creates intimacy between mother and child, and contemporary problems related to breastfeeding through the verses of law in the Qur'an based on the opinion of scholars, especially commentators. The research in this paper uses qualitative methods with data collection techniques based on literature study by reading several references such as the Qur'an, hadith, books, and articles, and analyzing the opinions of commentators. The results of this study state that breastfeeding is recommended for mothers to their biological children, but breastfeeding is carried out by mothers to non-biological children, so this breastfeeding has legal implications, namely the prohibition of marriage. Breastfeeding creates friendship between mothers who donate breast milk and babies who are breastfed either through direct suction (tsadyu) or not, even if it's only one suck or by way of fair (sau'ut) which lasts for two years because this will form bones and grow flesh in the growth of the baby so that it will make marriage illegal. In ar-radha'ah include recommendations for breastfeeding, the father's obligation to provide support during breastfeeding, the permissibility of breastfeeding children other than the biological mother, and the nature of breastfeeding.
