Abstract

Salah satu ajaran inti al-Qur’an adalah mengangkat harkat dan martabat manusia sama di hadapan Allah, tanpa mengenal perbedaan jenis kelamin (laki-laki dan perempuan). Yang membedakan keduanya hanyalah kualitas ketakwaannya. Wacana gender secara subtansi bukanlah hal yang baru dalam Islam. Bila dihadapan Allah derajat manusia sama, maka seyogyanya laki-laki dan perempuan mampu menjalin hubungan kerja sama yang baik tanpa merugikan salah satu pihak. Di antara penyebab masih adanya pemahaman umat Islam yang bias gender adalah konstruk pemahaman yang keliru dalam menafsirkan firman Allah dan Hadis Nabi yang kemudian dilegitimasi dengan produk hukum Islam. Untuk itu, reinterpretasi secara kontekstual terhadap setiap dalil yang bias gender mutlak dilakukan. Reinterpretasi tersebut mempertimbangkan kondisi kekinian dan prinsip kemaslahatan bersama, sehingga melahirkan makna dan paradigma baru yang berkeadilan gender serta selaras dengan nilai universal Islam.----------------------One of the core teachings of the Quran is the dignity of human beings are equal before God, regardless of differences in gender (men and women). What distinguishes the two is the quality of piety. Substancely,  gender discourse is not new in Islam. When the degrees are equal before God, then men and women should be able to establish a good working relationship without harming each other. Among the causes of the persistence of the Muslim understanding that gender bias is a false construct understanding in interpreting the word of God and the Hadith of the Prophet which then legitimized by Islamic laws. To that end, contextual reinterpretation of any gender bias arguments to be conducted. The reinterpretation considering the current situation and the principle of mutual benefit, thus giving birth to a new paradigm of meaning and gender-equitable and aligned with the universal values of Islam.

Abstract

Implementation of verstek decision in the Religious Court is one of the decision which handed down by the judges in the court. Verstek decision, is the decision which handed down because the absence of the defendant even though the defendant himself has been summoned by the proper and authorized. Verstek decision will be handed down after the parties were called and examined his case and examine whether the matters raised by the plaintiff it can be proved and the authority of the Religious Court. In the verdict verstek, then demand can be granted if the suit was groundless and did not fight right. But if the suit was groundless and or against the rights, the decision of the judge verstek a statement that the plaintiffs claim is not accepted, and if the claim is granted with verstek verdict, the defendant may seek such objection with verzet.

Abstract

Penanganan Perkara Yang Berkaitan Dengan Azas  Ne Bis In Idem, merupakan suatu kajian terhadap penerapan asas ne bis in  idem agar tidak terjadi pengulangan perkara yang sama di tingkat pengadilan. Nebis In Idem adalah prinsip hukum yang berlaku dalam hukum perdata maupun pidana. Dalam hukum perdata, prinsip ini mengandung pengertian bahwa sebuah perkara dengan obyek sama, para pihak sama dan materi pokok perkara yang sama, yang diputus oleh pengadilan yang telah berkekuatan hukum tetap yang mengabulkan atau menolak, tidak dapat diperiksa kembali untuk kedua kalinya.Kriteria perkara yang dapat dianggap Nebis In Idem adalah:  apa yang di gugat sudah pernah diperkarakan, telah ada putusan  yang telah berkekuatan hukum tetap dan bersifat positif seperi menolak gugatan, objek yang sama, subjek yang sama, materi pokok yang sama. Putusan yang dapat dikategorikan  sebagai Nebis In Idem adalah putusan bebas ( Vrijspraak), putusan pelepasan dari segalah tuntutan hukum (Onstlag van alle rechtsvolging) dan putusan pemidanaan (Veroordeling).

Abstract

Implementation of Guidance on Corruption Convicts is one of the things that must receive attention in prisons because it is one of the Extra Ordinary Crimes. In addition, most corruption crimes are committed by people who have a high social status, both in terms of their position before staying in prison as well as in terms of education and economic levels. Arrangements regarding the implementation of guidance for corruption convicts in Indonesia are regulated in the provisions of Law Number 12 of 1995 concerning Corrections and are described through Government Regulation Number 31 of 1999 concerning Guidance and Guidance of Correctional Citizens. Regarding the guidance for corruption convicts, it still refers to the provisions of Government Regulation Number 31 of 1999 where there is no difference in terms of the implementation of coaching which is still carried out through three stages, namely the initial stage, the advanced stage and the final stage. To be able to obtain the right to parole, there are special provisions that are applied to Corruption Convicts, namely in addition to having to behave well while in prison, they must also fulfill the obligation to complete the payment of fines or replacement money to be able to submit a parole proposal.

Abstract

Hukum nasional Indonesia secara historis adalah kumpulan norma-norma hukum yang hidup dalam masyarakat yang berasal dari unsur-unsur hukum Islam, hukum adat dan hukum Barat. Berbicara tentang Hukum Islam, maka yang dimaksud adalah terjemahan dari dua istilah: syariat dan fikih. Syariat adalah firman-firman Allah SWT. (Al-Qur’an) dan ketentuan-ketentuan Rasul-Nya SAW. (Al-Sunnah), keduanya bersifat sakral, universal dan kontemporal; berlaku untuk semua tempat dan segala zaman. Hukum Islam ini baru dikenal di Indonesia setelah agama Islam disebarkan di tanah air, namun belum ada kesepakatan para ahli sejarah Indonesia mengenai ketepatan masuknya Islam ke Indonesia. Sistem hukum Islam akan selalu menjadi penyeleksi proses legislasi nasional, karena secara filosofis, yuridis dan sosiologis kekuatan Islam menjadi cermin pembangunan Indonesia kedepan

Abstract

Isbat nikah sangat dibutuhkan oleh masyarakat olehnya itu hakim Pengadilan Agama melakukan “ijtihad” dari ketentuan hukum yang berlaku, kemudian mengabulkan permohonan isbat nikah berdasarkan ketentuan Pasal 7 Ayat (3) huruf (e) Kompilasi Hukum Islam (KHI), yaitu apabila perkawinan yang dimohonkan untuk diisbatkan itu tidak ada halangan perkawinan sebagaimana diatur dalam Undang-Undang Perkawinan, maka Pengadilan Agama akan mengabulkan permohonan isbat nikah meskipun perkawinan tersebut dilaksanakan pasca berlakunya Undang-undang Perkawinan (UUP). Penelitian ini bertujuan untuk mengetahui legalitas dari pencatatan perkawinan melalui isbat nikah. Penelitian ini menggunakan jenis penelitian normatif. Hasil penelitian menunjukkan bahwa legalitas dari pencatatan perkawinan melalui penetapan isbat menurut sebagian ahli hukum berpendapat bahwa KHI tidak termasuk kedalam hierarki Peraturan perundang-undangan yang disebutkan dalam Pasal 7 Ayat (1) Undang-Undang Nomor 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-Undangan. Oleh karena itu, penetapan isbat nikah oleh Pengadilan Agama tersebut tidak lebih hanya sebagai kebijakan untuk mengisi kekosongan hukum yang mengatur tentang itsbat nikah terhadap perkawinan yang dilaksanakan setelah berlakunya UUP.

Abstract

The future of the Indonesian nation is very dependent on the condition of today's children. Therefore, future attention to children is the main focus, especially for Correctional Students (ADP) who live in the Special Child Development Institution (LPKA). One of the things that is of concern to children who are behind bars is the right to obtain formal and informal education. The purpose of this study was to analyze and evaluate the implementation of the fulfillment of the right to education for correctional students and to design an ideal model of fulfilling the right to education for children in Class II LPKA Gorontalo. The type of research used in this research is empirical normative legal research. The research results show that the educational process for ADP at LPKA is carried out in accordance with the mandate of Law Number 22 of 2022 concerning Corrections where ADP can pursue formal or informal education. In the implementation of formal learning process activities, there are still obstacles in the form of learning processes carried out outside LPKA, so it is necessary to formulate a learning model that should be made like a child-friendly school within LPKA and supported by educators who are truly competent and experienced in educating children.

Abstract

The phenomenon of violence against women has recently become a prominent issue. This is not only due to the increasing severity of cases of violence experienced by women, but the intensity is even more worrying. This study focuses on domestic violence during the covid-19 pandemic in Gorontalo Province. The method used in this research is field research with a sociological juridical approach to determine the application of law to society, in this case the enforcement of related laws regarding Law Number 23 of 2004 concerning the Elimination of Domestic Violence.The results of this study are forms of domestic violence in the form of physical violence, namely actions that cause pain, fall ill, or seriously injured. Psychological violence, namely actions that cause fear, loss of self-confidence, loss of ability to act, sense of helplessness, and/or severe psychological suffering on a person. Factors causing Domestic Violence (KDRT) which are often found in handling victims, include: Perpetrators who cheat or have WIL, Communication factors that are not harmonious, There are influence factors from the family either from the victim or perpetrator, Socio-economic factors, Perpetrators who commit physical violence and sexual violence, perpetrators who do not provide a living or neglect for a long time and from the juridical side the problem of domestic violence (KDRT) is pursued through private law (civil) with divorce. However, the dilemma faced by the victim is that she is not ready to live her own life (as a widow) by bearing a negative predicate from the community.
