Abstract

Moral dan hukum merupakan satu kesatuan dalam pembentukan peraturan perundang-undangan, sehingga dalam konsep hukum harus berpedoman pada nilai-nilai moral masyarakat. Cerminan suatu aturan hukum, haruslah digambarkan pada nilai moral, namun nyatanya di Indonesia sendiri masih banyak pembentukan peraturan perundang-undangan yang tidak mencerminkan moral, tumpang tindih aturan, saling bertentangan pasal dengan pasal dalam satu aturan, sering diubah secepat mungkin dan lain sebagainya. Oleh sebab itu, penelitian hukum ini menggunakan penelitian normatif dalam arti mencari kebenaran koherensi dengan menggunakan pendekatan konseptual yang berdasarkan doktrin-doktrin pada sarjana pada kaitannya filsafat hukum dan pendekatan sejarah. Yang pada akhirnya, penelitian ini memberikan beberapa pandangan tentang keterkaitan moral dan hukum. Dan seharusnya pandangan konsep Lon Fuller pada hukum kodratnya lebih relevan digunakan pada konsep perkembangan hukum di Indonesia saat ini, dibanding pemikiran Hart dan Kelsen. Karena, hubungan yang mendalam antara hukum dan moralitas serta otoritas berasal dari konsistensinya dengan moralitas.

Abstract

Gustav Radbruch's theory of justice places justice as the main pillar in the legal system. Radbruch emphasised that law cannot be separated from moral values and justice. In his perspective, an unjust law is not a true law. Radbruch identified three basic values of law: justice, legal certainty, and expediency. However, he asserted that justice should be the top priority.Radbruch experienced a change of view after World War II, where he realised that legal certainty should not come at the expense of justice. This research uses the normative method, which aims to examine legal norms. With conceptual and historical approaches. In conclusion, this article explores how Radbruch understood the concept of justice, how it interacts with other legal values, and its relevance in the modern legal context. Gustav Radbruch's theory of justice presents a dynamic interplay between moral and legal relationships, which primarily developed after his experiences with Nazi Germany. His legal philosophy, rooted in neo-Kantianism, grapples with the tension between legal positivism and natural law. Central to his thought is the ‘Radbruch formula,’ which states that grossly unjust laws have no legal validity.

Abstract

The development of legal science is very rapid, so it is inseparable from the concept of the division of powers of state institutions. The authority is used to carry out public services and the function of the citizens' human rights approach. This approach is a form of legal protection for the people as the main part of administrative law. One of the holders of legal protection powers for citizens is the Ombudsman. The Ombudsman is a projustitia state institution in various countries and ensures the legal protection of citizens against government actions. However, in this context in Indonesia, the position of the Ombudsman as a concept of legal protection through an administrative law approach has not been maximised with a number of authorities. This problem occurs because administrative law in Indonesia does not have a special position in its legal order, one example is that there is no codification of Indonesian administrative law like in other countries such as the Netherlands having Algemen Wet Bestuurrecht (AWB). In Indonesia, it forms a special rule or material guideline, namely Law Number 30 of 2014 concerning Government Administration which cannot be said to be a material administrative law concept. This is because the regulation is not theoretically based on administrative law. So, it is necessary to have an administrative law policy in terms of preventive and repressive law enforcement. Therefore, this research uses the norm method based on statutory, conceptual and comparative legal approaches. With legal materials using comparative juridical analysis of the ombudsman institutional system in the Netherlands and Sweden. So that this research shows a much different concept of authority between the Indonesian Ombudsman, the Dutch Nationale Ombudsman functions as a government watchdog mentioned in Article 78a of the Dutch Constitution, and the Riksdagens Ombudsman. Sweden which is an organ of parliament to carry out supervision of the executive as a state organiser by issuing legal products, namely recommendations and also has the authority to conduct conciliation and mediation.

Abstract

War crimes in the Charter of the International Military Tribunal 1945 and listed in the Treaty of London 8 August 1945. War crimes are extraordinary crimes as gross violations of human rights. Therefore, in 1998 in Rome, 120 UN member states enacted the statute establishing the International Criminal Court (ICC). The ICC aims to provide human rights protection to victims and law enforcement of war crimes perpetrators. This article aims to examine the important role of the ICC in the enforcement of war crimes in the aspect of contemporary criminal law, based on the nortmative legal research method. The results show the important role of human rights enforcement in the criminal law aspect of war crimes.
