Abstract

Moral dan hukum merupakan satu kesatuan dalam pembentukan peraturan perundang-undangan, sehingga dalam konsep hukum harus berpedoman pada nilai-nilai moral masyarakat. Cerminan suatu aturan hukum, haruslah digambarkan pada nilai moral, namun nyatanya di Indonesia sendiri masih banyak pembentukan peraturan perundang-undangan yang tidak mencerminkan moral, tumpang tindih aturan, saling bertentangan pasal dengan pasal dalam satu aturan, sering diubah secepat mungkin dan lain sebagainya. Oleh sebab itu, penelitian hukum ini menggunakan penelitian normatif dalam arti mencari kebenaran koherensi dengan menggunakan pendekatan konseptual yang berdasarkan doktrin-doktrin pada sarjana pada kaitannya filsafat hukum dan pendekatan sejarah. Yang pada akhirnya, penelitian ini memberikan beberapa pandangan tentang keterkaitan moral dan hukum. Dan seharusnya pandangan konsep Lon Fuller pada hukum kodratnya lebih relevan digunakan pada konsep perkembangan hukum di Indonesia saat ini, dibanding pemikiran Hart dan Kelsen. Karena, hubungan yang mendalam antara hukum dan moralitas serta otoritas berasal dari konsistensinya dengan moralitas.

Abstract

Gustav Radbruch's theory of justice places justice as the main pillar in the legal system. Radbruch emphasised that law cannot be separated from moral values and justice. In his perspective, an unjust law is not a true law. Radbruch identified three basic values of law: justice, legal certainty, and expediency. However, he asserted that justice should be the top priority.Radbruch experienced a change of view after World War II, where he realised that legal certainty should not come at the expense of justice. This research uses the normative method, which aims to examine legal norms. With conceptual and historical approaches. In conclusion, this article explores how Radbruch understood the concept of justice, how it interacts with other legal values, and its relevance in the modern legal context. Gustav Radbruch's theory of justice presents a dynamic interplay between moral and legal relationships, which primarily developed after his experiences with Nazi Germany. His legal philosophy, rooted in neo-Kantianism, grapples with the tension between legal positivism and natural law. Central to his thought is the ‘Radbruch formula,’ which states that grossly unjust laws have no legal validity.

Abstract

The development of legal science is very rapid, so it is inseparable from the concept of the division of powers of state institutions. The authority is used to carry out public services and the function of the citizens' human rights approach. This approach is a form of legal protection for the people as the main part of administrative law. One of the holders of legal protection powers for citizens is the Ombudsman. The Ombudsman is a projustitia state institution in various countries and ensures the legal protection of citizens against government actions. However, in this context in Indonesia, the position of the Ombudsman as a concept of legal protection through an administrative law approach has not been maximised with a number of authorities. This problem occurs because administrative law in Indonesia does not have a special position in its legal order, one example is that there is no codification of Indonesian administrative law like in other countries such as the Netherlands having Algemen Wet Bestuurrecht (AWB). In Indonesia, it forms a special rule or material guideline, namely Law Number 30 of 2014 concerning Government Administration which cannot be said to be a material administrative law concept. This is because the regulation is not theoretically based on administrative law. So, it is necessary to have an administrative law policy in terms of preventive and repressive law enforcement. Therefore, this research uses the norm method based on statutory, conceptual and comparative legal approaches. With legal materials using comparative juridical analysis of the ombudsman institutional system in the Netherlands and Sweden. So that this research shows a much different concept of authority between the Indonesian Ombudsman, the Dutch Nationale Ombudsman functions as a government watchdog mentioned in Article 78a of the Dutch Constitution, and the Riksdagens Ombudsman. Sweden which is an organ of parliament to carry out supervision of the executive as a state organiser by issuing legal products, namely recommendations and also has the authority to conduct conciliation and mediation.

Abstract

The execution of final court rulings is a crucial element in realizing the rule of law and protecting the rights of citizens in the administrative justice system. However, in practice, the execution of PTUN decisions in Indonesia still faces various obstacles, particularly in terms of effectiveness and compliance with government officials. This article examines the need for reforming the PTUN's execution mechanism by adopting lessons from the Dutch administrative justice system. The research method used is juridical-normative with a comparative law approach. Sistem Belanda menyoroti kewenangan yang lebih besar bagi hakim administrasi untuk memantau pelaksanaan putusan dan hukuman yang jelas bagi pejabat yang tidak patuh. The results of this study recommend institutional strengthening, expansion of judicial authority, and formulation of clearer legal instruments in the Indonesian PTUN system to ensure more effective and fair execution of decisions. These reforms are expected to increase public confidence in administrative courts and promote a culture of compliance among government officials.

Abstract

Through this study, the author explores the challenges and potentials that arise from granting mining licences to religious organisations, including potential conflicts between economic objectives and moral values held by religious organisations. On the one hand, mining activities can provide economic opportunities for religious organizations and neighbouring communities, but on the other hand, these activities risk damaging the environment and contradicting religious teachings that prioritise nature conservation. The article also identifies the importance of clear policies and strict supervision to ensure that mining activities by religious organisations are not only financially beneficial but also socially and environmentally responsible. Thus, this research uses a normative method to seek truth coherence, with a statutory approach, conceptual approach and case approach. In conclusion, this article recommends the need for stricter regulations, transparency in the licensing process, as well as strengthening dialogue between the government, religious organisations and the community to ensure the sustainability of these activities in line with existing religious and social values.

Abstract

Constitutional Court Decision Number 181/PUU-XXII/2024 opens up legal space for communities living in forest areas to engage in plantation activities, thereby creating new dynamics in Indonesia's forestry legal regime. This ruling has sparked debate because, on the one hand, it strengthens the protection of constitutional rights of the community, but on the other hand, it raises concerns about environmental sustainability and forest area governance. This study aims to analyse the legal implications of the ruling and the challenges of its implementation within the framework of forestry administrative law. This study uses a normative legal research method with a legislative and conceptual approach. The results of the study show that Constitutional Court Decision Number 181 / PUU-XXII / 2024 marks a paradigm shift in forestry management from a repressive approach to a more inclusive and equitable approach, emphasising the principles of proportionality, legal certainty, and recognition of the social reality of the community. However, the implementation of this decision faces serious challenges, particularly related to regulatory disharmony, limited administrative capacity, and the risk of environmental degradation. Therefore, forestry administration law reform is needed that emphasises the principles of legality, good governance, control of discretion, and integration of sustainable development principles so that the protection of community rights and forest conservation can be balanced.

Abstract

Pengembangan Ibu Kota Negara (IKN) di Kalimantan Timur memiliki peran besar bagi pengelolaan hutan, mengingat wilayah tersebut didominasi oleh ekosistem hutan tropis dan bekas lokasi pertambangan. Kebijakan pengelolaan hutan dalam pengembangan IKN diarahkan untuk mewujudkan konsep kota hutan lestari, dengan target minimal 65–70% wilayahnya berupa ruang terbuka hijau. Nomor melalui kerangka hukum seperti Undang-Undang 3 Tahun 2022 tentang Ibu Kota Negara, Undang-Undang Kehutanan, dan Peraturan Presiden Nomor 63 Tahun 2022 tentang Rencana Induk IKN, pemerintah telah menegaskan kembali komitmennya terhadap konservasi, rehabilitasi lahan, perlindungan masyarakat adat, dan pengembangan ekonomi hijau. Namun, implementasi kebijakan hukum ini melawan tantangan, seperti tumpang tindih klaim lahan, potensi konflik kepentingan antara pembangunan dan konservasi, serta lemahnya pengawasan dan penegakan hukum lingkungan. Penelitian kebijakan hukum ini, yang didasarkan pada analisis normatif dengan pendekatan legislatif dan konseptual, menyimpulkan bahwa keberhasilan pengelolaan hutan dalam pembangunan IKN tidak hanya bergantung pada regulasi yang ada, tetapi juga pada implementasi yang konsisten, sinergi antarlembaga, dan keterlibatan aktif masyarakat lokal dan adat. Dengan demikian, kebijakan hukum pengelolaan hutan di IKN diharapkan dapat menjadi model pembangunan berkelanjutan yang menyeimbangkan kepentingan, ekonomi, dan sosial.

Abstract

Administrative law philosophy is the foundation for understanding the nature, sources of knowledge, and objectives of administrative law in government administration practice. Ontologically, administrative law is viewed as a tool of public power that provides legitimacy and limits the authority of the government in carrying out administrative functions. From an epistemological perspective, administrative law is constructed through legislation, expert doctrine, court decisions, and government practices that evolve in line with social dynamics and community needs. Meanwhile, in the axial dimension, administrative law has values and objectives to ensure legal certainty, protect the rights of citizens, and realise transparent, accountable, and fair governance. This legal research uses a normative approach, with conceptual, legislative, and case studies. By examining administrative law through these three philosophical dimensions, it is hoped that a more comprehensive understanding will emerge and serve as a normative guideline for the government so that every administrative action is always in line with the principles of justice and democracy.
