Abstract

: Air traffic control in border areas is a crucial aspect in maintaining national sovereignty and security. This study aims to assist in the regulation of laws and challenges faced in managing air traffic in border areas. The research method uses a juridical-normative approach by reviewing various national and international laws and regulations related to aviation and airspace sovereignty. The results of the study show that each country has full control over its airspace based on the 1944 Chicago Convention and UNCLOS 1982. Indonesia itself has regulated air traffic control through Law No. 1 of 2009 concerning Aviation, which affirms the state's right to regulate and supervise airspace for national interests. The main challenges in supervision include coordination between countries, security, geographical constraints, differences in regulations, and growth in air traffic volume. The study provides a collaborative approach through strengthening international cooperation, investing in advanced technologies such as AI and satellite systems, and involving all stakeholders. This study emphasizes the importance of a strong and integrated oversight mechanism to protect the airspace ecosystem from external threats and violations of the law.

Abstract

The Constitutional Court (MK) has an important role in maintaining the supremacy of the constitution and ensuring that policies and regulations are in accordance with constitutional principles. As an institution authorized to examine laws, decide disputes between state institutions, and resolve disputes over election results, the Constitutional Court is required to act independently and with integrity. Therefore, MK judges must uphold professional ethics and codes of conduct so that public trust in their decisions is maintained. However, there have been allegations of ethical violations by judges in several cases. The method used in the research is normative juridical with data sources derived from literature review, journals, and legal regulations. The approach applied includes a statutory approach and a case approach. Data collection techniques are carried out through primary data that refers to applicable positive laws, as well as secondary data obtained from journals and other sources. The results obtained in this study are that the supervision mechanism applied by MKMK is tiered and strict, starting from preliminary examination to in-depth investigation, while still upholding the principle of presumption of innocence. Then, the validity of the decision of the Constitutional Court (MK) legally remains valid even though there is a violation of the code of ethics by the judge, as seen in MK Decision Number 90/PUU-XXI/2023 concerning the age limit of presidential candidates.

Abstract

This study aims to analyze three episodes of the Rasis Infotainment program that highlight legal issues, using a Project Based Learning (PjBL) approach and a descriptive qualitative method. The primary focus is to evaluate how well these infotainment broadcasts adhere to journalistic principles and broadcasting ethics in presenting legal content, as well as their contribution to public legal education. Data were collected through direct observation and analyzed using an assessment rubric covering cognitive, affective, conative, sexuality, social norms, and violence dimensions. This limits the potential of infotainment as an effective and ethical medium for legal education. The study recommends improving the quality of legal narratives in infotainment to enhance its strategic role in fostering public legal awareness in the digital era.

Abstract

This study examines the elements of business conspiracy and the effectiveness of administrative sanctions imposed by the Indonesian Competition Commission (KPPU) in Decision Number 08/KPPU-L/2024, as well as compares them with the United States Antitrust Law framework. The research is motivated by the limited deterrent effect and lack of legal certainty for victims of unfair business competition in Indonesia, particularly in conspiracy cases causing substantial losses. This study employs a normative juridical method using statutory, case, and comparative approaches by analyzing Law Number 5 of 1999 and its implementing regulations alongside the Sherman Act, Clayton Act, and the Federal Trade Commission Act. The findings reveal that all elements of business conspiracy in Decision 08/KPPU-L/2024 were legally established; however, the administrative sanctions imposed were disproportionate to the losses incurred, did not include individual liability, and failed to provide direct restitution mechanisms for injured parties. Consequently, administrative sanctions have not functioned effectively as deterrence and legal protection instruments. The novelty of this study lies in its comparative analysis, positioning private enforcement and victim restitution under U.S. Antitrust Law as benchmarks for strengthening Indonesia’s administrative sanction regime. This study recommends enhancing KPPU’s authority, extending sanctions to both corporations and individuals, and establishing clear restitution mechanisms to ensure legal certainty and substantive justice in competition law enforcement.   Penelitian ini menganalisis unsur persekongkolan usaha dan efektivitas penerapan sanksi administratif oleh Komisi Pengawas Persaingan Usaha (KPPU) dalam Putusan Nomor 08/KPPU-L/2024, serta membandingkannya dengan rezim Antitrust Law Amerika Serikat. Penelitian ini dilatarbelakangi oleh masih lemahnya efek jera dan ketidakpastian hukum bagi korban praktik persaingan usaha tidak sehat di Indonesia, khususnya dalam perkara persekongkolan yang menimbulkan kerugian signifikan. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, kasus, dan perbandingan melalui analisis Undang-Undang Nomor 5 Tahun 1999, peraturan pelaksananya, serta Sherman Act, Clayton Act, dan Federal Trade Commission Act. Hasil penelitian menunjukkan bahwa seluruh unsur persekongkolan usaha dalam Putusan 08/KPPU-L/2024 telah terpenuhi secara sah, namun penjatuhan sanksi administratif berupa denda dinilai tidak proporsional dengan kerugian yang ditimbulkan, tidak disertai sanksi terhadap individu pelaku, serta tidak memberikan mekanisme pemulihan langsung bagi pihak yang dirugikan. Kondisi ini menyebabkan tujuan sanksi administratif sebagai instrumen efek jera dan perlindungan hukum belum tercapai secara optimal. Kebaruan penelitian ini terletak pada analisis komparatif yang menempatkan private enforcement dan restitusi korban dalam Antitrust Law Amerika Serikat sebagai tolok ukur untuk memperkuat sistem sanksi administratif di Indonesia. Penelitian ini merekomendasikan penguatan kewenangan KPPU, pengenaan sanksi terhadap korporasi dan individu, serta perumusan mekanisme restitusi langsung guna mewujudkan kepastian hukum dan keadilan substantif dalam penegakan hukum persaingan usaha.
