Abstract

The focus of this research is on the critical issue of overlapping Corporate Social Responsibility (CSR) regulations within Indonesia's legal system. This is a significant problem that affects business compliance and social development outcomes. The study investigates the normative juridical aspects of various legislative frameworks, including the Company Law, Investment Law, and Mining Law. The study identifies three major consequences of regulatory redundancy: uncertainty in implementation standards, resource inefficiency due to program duplication, and complexity in supervision. It highlights systemic weaknesses within Indonesia's CSR legislative system and proposes an innovative legislative model to integrate CSR. To enhance legal certainty and implementation effectiveness, the study recommends a comprehensive harmonization method that integrates regulations, establishes consistent implementation mechanisms, and develops supervision protocols. These findings assist policymakers and legal practitioners in improving Indonesia's CSR regulatory framework.

Abstract

Disrupsi menggambarkan transformasi mendasar dalam digitalisasi berbagai aspek, termasuk diantaranya dibidang system peradilan, khususnya peradilan pidana. Maka dari itu, penelitan ini bertujuan melihat pengaruh pelaksanaan sistem peradilan pidana dan kaitannya dengan pemenuhan keadilan di Indonesia. Pendekatan yang dugunakan dalam penelitian ini adalah pendekatan undang-undang (statute approach) guna menelaah semua peraturan perundang-undangan, regulasi dan kebijakan yang berkaitan dengan teknologi digital pada sistem peradilan pidana. Peraturan Mahkamah Agung Tentang Administrasi dan Persidangan Perkara Pidana Di Pengadilan Secara Elektronik mempengaruhi proses administrasi peradilan, baik pada mekanisme persidang secara elektronik. Persidangan secara elektronik adalah serangkaian proses memeriksa, mengadili, dan memutus perkara terdakwa oleh pengadilan yang dilaksanakan dengan dukungan teknologi informasi dan komunikasi, audio visual dan sarana elektronik lainnya. Selain itu juga digunakan pada proses permohonan izin secara elektronik dan pelimpahan berkas melalui Sistem Informasi Pengadilan. Administrasi perkara pidana terpadu secara elektronik telah berdampak pada percepatan proses peradilan, penyederhanaan system birokrasi yang rumit antara penegak hukum dan membuat biaya peradilan semakin efisian bagi pencari keadilan.

Abstract

This study aims to analyze the implementation mechanism and application of the Moronene Customary Oath (Tanduale) as a means of dispute resolution in Bombana Regency. This research employs an empirical normative legal method using both conceptual and statutory approaches. Data were collected through literature review, observation, interviews with Moronene customary leaders, and analysis of relevant documents. The findings reveal that the implementation of Tanduale consists of several stages, namely the emergence of a dispute, submission of the case to customary institutions, customary deliberation, ritual preparation, oath administration, issuance of a customary decision, and monitoring of customary consequences. Its effectiveness is supported by the community’s adherence to customary law, belief in the spiritual consequences of the oath, and the social legitimacy of customary authorities. Tanduale is commonly used in resolving disputes related to customary land rights, inheritance, allegations of theft, and violations of customary norms. This study confirms that Tanduale represents a form of living law that remains functional within the Moronene community and possesses significant potential to be optimized as a non-litigation dispute resolution mechanism that promotes peace and social harmony in Bombana Regency.
