Abstract

Penerapan Restorative Justice pada tingkat Penuntutan terhadap tindak pidana penganiayaan di Kejaksaan Negeri Kotamobagu merupakan tahap paling efektif dalam menyelesaikan kasus yang adil bagi semua pihak. Pada tindak pidana Penganiayaan, kerapkali telah terjadi perdamaian antara pelaku dan korban namun dikarenakan berkas telah lengkap (P21) dan Penyidik telah melimpahkan Tersangka ke Kejaksaan (Penuntut Umum) maka perkara tersebut tidak dapat dihentikan, sehingga dalam hal ini Restorative Justice dinilai akan berperan signifikan dalam pelaksanaan supremasi hukum di Indonesia khususnya dalam penerapannya di tingkat Penuntutan. Penelitian yang berlokasi di Kejaksaan Negeri Kotamobagu ini menggunakan data primer dan sekunder sebagai sumber data rujukan dalam metode penelitian hukum empiris. Hasil penelitian ini menemukan bahwa Restorative Justice di Kejaksaan Negeri Kotamobagu dilaksanakan di tingkat penuntutan dalam penyelesaian tindak pidana penganiayaan Pasal 351 ayat (1) KUHP. Peraturan Jaksa Agung (Perja) Nomor 15 Tahun 2020 tentang Penghentian Penuntutan berdasarkan Restorative Justice pun telah benar dilaksanakan di Kejaksaan Negeri Kotamobagu namun masih ditemukan kendala yang diatur dalam Pasal 9 point 5 dalam Perja tersebut sehingga ada perkara yang telah diupayakan namun tidak berhasil dilaksanakan penghentian penuntutan sampai terbit SKP2 atau Surat Ketetapan Penghentian Penuntutan.The application of Restorative Justice at the Prosecution level for criminal acts of persecution at the Kotamobagu District Attorney is the most effective stage in resolving cases that are fair for all parties. In the crime of torture, there is often peace between the perpetrator and the victim, but because the file is complete (P21) and the investigator has delegated the suspect to the Prosecutor’s Office (the General Prosecutor), the case cannot be stopped, so in this case Restorative Justice is considered to have a significant role in the implementation of book supremacy. in Indonesia, especially in its application at the Prosecution level. This research, which is located at the Kotamobagu District Attorney’s Office, uses primary and secondary data as a source of reference data in empirical legal research methods. The results of this study found that Restorative Justice at the Kotamobagu District Attorney’s Office was carried out at the prosecution level in the settlement of the Crime of Persecution Article 351 Paragraph (1) of the Criminal Code. The Attorney General’s Regulation (Perja) Number 15 of 2020 concerning Termination of Prosecution based on Restorative Justice has also been properly implemented at the Kotamobagu District Attorney but there are still obstacles as stipulated in Article 9 point 5 in the Perja so that there are cases that have been attempted but have not succeeded in terminating the prosecution, until the issuance of SKP2 or Decision Letter for Termination of Prosecution.

Abstract

Ulayat rights are the rights of customary law communities which in essence are the authority possessed by certain customary law communities. The customary land law of the Tolaki Mekongga tribe is land that is controlled or owned by a family, either because the family has directly cultivated it, or because the land has been inherited from generation to generation. The main objective of this research is to find out the concept of customary land ownership of the Tolaki Mekongga tribe and its relation to inheritance and customary rights. The type of research used in this study is normative legal research (doctrinal legal research), namely research on law as a norm and reality (behavior) or as something to aspire to and as a living reality or law. The Tolaki Mekongga indigenous people still exist today and occupy certain areas, but until now there are no regional regulations regarding customary rights over these areas, so efforts are needed to obtain legal certainty and justice for customary law communities in managing their customary rights.

Abstract

Visum et Repetum (VeR) merupakan suatu laporan tertulis dari dokter (ahli) yang dibuat berdasarkan sumpah mengenai apa yang dilihat dan diketemukan atas bukti hidup, mayat, fisik atau barang bukti lain, kemudian dilakukan pemeriksaan menurut pengetahuan sebaik-baiknya. Visum et Repetum sering diminta oleh pihak penyidik (polisi) kepada dokter menyangkut perlukaan pada tubuh manusia. Penelitian ini bertujuan untuk mengetahui serta mempelajari secara mendalam bagaimana peranan dan kedudukan dokter dalam mengungkap tindak pidana pembunuhan melalui visum di Puskesmas Tanggetada, dan Untuk mengetahui bagaimana kekuatan pembuktian seorang dokter dalam mengungkap tindak pidana pembunuhan melalui visum di Puskesmas Tanggetada. Penelitian ini dilakukan dengan menggunakan metode penelitian hukum yang menggabungkan kedua metode penelitian hukum, yakni metode penelitian hukum Normatif-Empiris. Hasil penelitian yang ditemukan bahwasanya kedudukan seorang dokter di dalam penanganan korban kejahatan dengan menerbitkan Visum et Repetum seharusnya disadari dan dijamin netralitasnya, karena bantuan profesi dokter akan sangat menentukan adanya kebenaran. Visum et Repertum mempunyai kekuatan pembuktian yang cukup berpengaruh dalam proses peradilan tindak pidana, dimana hasil dari Visum et Repertum didapat dari hasil temuan dokter ahli forensik dalam upaya mencari sebab musabab yang terjadi pada tubuh korban, sebelum terjadinya sebuah kematian. Oleh karena itu, kekuatan pembuktian dari Visum et Repertum tidak ada yang bisa melemahkan alat bukti tersebut, sebelum diketemukannya alat bukti lain yang lebih konkrit

Abstract

This study aims to determine Police Law Enforcement in Disclosing Narcotics Crimes Using the Undercover Buy Technique at North Kolaka Police Station. The formulation of the problem posed is: What are the legal strengths and consequences for undercover buys made by non-Police members (informants)? and What are the obstacle factors in uncovering narcotics crimes with the Undercover Buy Technique?. The type of research used by the author in the preparation of this thesis final project is research that uses empirical research methods. The empirical legal research method is a legal research method that functions to see the law in a real sense and research how the law works in society. Covert Purchase as stipulated in Law No. 22 of 1997 which has been changed to Law No. 35 of 2009 is an addition to the investigator's authority in efforts to eradicate narcotics trafficking. This is because narcotics crimes are organized, secret crimes, and in practice they use sophisticated modus operandi and technology, making it difficult to collect evidence. Unlike other criminal acts, the implementation of covert purchases in narcotics crimes is not contrary to human rights if carried out in accordance with applicable regulations. However, it will be different if it is not implemented in accordance with applicable regulations. This is because the implementation of covert purchases cannot be separated from the participation of the community, so that the rights of the people who participate must be protected. In order to reduce errors and the implementation of covert purchases, it is necessary to know and understand clearly by investigators regarding the implementation of covert purchases themselves as stipulated in Law No. 35 of 2009. Abstract

Penelitian ini bertujuan untuk menganalisis sinergi Polres Kolaka dan Dinas Pemberdayaan Perempuan dan Perlindungan Anak dalam penanggulangan kekerasan terhadap anak. Kekerasan terhadap anak merupakan permasalahan serius yang memerlukan penanganan terpadu dari berbagai pihak. Metode yang digunakan dalam penelitian ini adalah kualitatif dengan pendekatan deskriptif. Data dikumpulkan melalui wawancara mendalam, observasi, dan studi dokumentasi. Hasil penelitian menunjukkan bahwa sinergi kedua lembaga telah terlaksana namun masih belum berjalan dengan baik, ditandai dengan koordinasi penanganan perkara, sosialisasi pencegahan kekerasan, dan pemberian pendampingan hukum dan psikologis bagi korban yang terkendala penolakan alokasi anggaran dalam menjalankan tugasnya. sosialisasi. Perlunya sinergitas antara kepolisian dan pemerintah daerah dalam penanganan kasus kekerasan terhadap anak perlu ditingkatkan dengan membuat MoU yang mencantumkan pembagian kerja masing-masing pihak. Pemerintah daerah melalui Dinas Pemberdayaan Perempuan dan Perlindungan Anak Kabupaten Kolaka hendaknya melakukan sosialisasi dengan memasang spanduk yang mencantumkan nomor kontak yang dapat dihubungi masyarakat jika mengetahui adanya kekerasan terhadap anak yang terjadi. Selain itu, diperlukan kerja sama masyarakat untuk lebih proaktif dalam melaporkan kejadian kekerasan terhadap anak di lingkungannya. Penelitian ini memberikan kontribusi penting dalam memahami dinamika kolaborasi antar lembaga dalam penanganan kekerasan terhadap anak dan diharapkan dapat menjadi referensi untuk meningkatkan efektivitas penanganan kasus kekerasan anak di daerah lain.

Abstract

This thesis aims to find out what factors cause perpetrators to commit criminal acts of domestic violence in the jurisdiction of the Kolaka District resort police, and also to find out the efforts made by the Kolaka District resort police in dealing with criminal acts of domestic violence. This research uses research methods Empirical law, namely this research is carried out directly on legal phenomena in society or social facts found in society. Based on the results of the research and discussion, it can be concluded that what are the factors that cause perpetrators to commit criminal acts of domestic violence in the jurisdiction of the Kolaka District Resort Police, namely economic factors, infidelity factors, alcoholic beverage factors and then to find out the efforts made by the Kolaka District Resort Police Kolaka in dealing with criminal acts of domestic violence, namely conducting outreach or seminars, namely collaborating with regional government institutions, sub-district offices, social services, and sub-district offices and others.

Abstract

Constitutional Court Decision Number 20/PUU-XII/2023 states that article 30C letter h and explanation letter h of Law Number 11 of 2021 concerning the Prosecutor's Office of the Republic of Indonesia are contrary to the Constitution of the Republic of Indonesia Year 1945 and have no binding legal force. So that this is considered contrary to the purpose of law and legal principles, namely the principle of equality before the law and the principle of equality of arms principle. Therefore, this encourages the author to analyze the concept of judicial review carried out by the Public Prosecutor who actually represents the victim and even the state. The writing of this thesis uses normative juridical research methods with methods of approaching laws and regulations, cases, historical and conceptual. This legal research found that the Criminal Procedure Code for victim protection has not been optimal compared to perpetrators of crimes, where the Criminal Procedure Code only identifies or tends to lead to perpetrators only. Then, with the decision of the Constitutional Court No. 20/PUU-XII/2023, it has the effect of closing the prosecutor's authority to be able to apply for review as a return of position to the convict.

Abstract

Euthanasia in positive criminal law regulations in Indonesia has not been regulated firmly and specifically. And according to human rights, the act of euthanasia is a violation of a person's right to life. The act of euthanasia itself occurs because of the unbearable sufferinga person experiences due to a disease that has no hope of being cured. The patient or family will ask the doctor to carry out euthanasia because they have lost hope or the opportunity to be cured with other alternatives. Juridically, criminal law, the act of euthanasia is indirectly regulated in articles 304, 344 and 345 of the Criminal Code as well as articles 461 and 462 of Law number 1 of 2023 and in human rights the act of euthanasia is very contrary to a person'sright to life, the emergence of the act of euthanasia It has become a demand that euthanasia ispart of human rights, namely the right to die. This right to die is not regulated either in the 1945 Constitution, Law Number 39 of 1999, and the Universal Declaration of Human Rights. The new thing that can be stated is that the process of legislation and legal reform, especiallyregarding this action, must continue to be carried out based on Pancasila and the 1945 Constitution of the Republic of Indonesia, taking into account the religious and cultural normsthat apply in Indonesian society.

Abstract

Early marriage is a marriage event carried out by children under 19 years old for both men and women. As in Central Buton Regency, the number of early marriages always occurs, causing the village government to minimize the number of early marriages. This study aims to determine the background of early marriages. This study uses a normative empirical approach, described descriptively with data sources consisting of children or adolescents who have early marriages, the community, KUA and health authorities. The validity of the data in this study uses source triangulation techniques, and data analysis uses Milles and Huberman interactive analysis. This study produced several findings, namely that early marriages that occur in Central Buton Regency are caused by several factors, both internal and external. Internal factors that come from within are their own will, while external factors are the parents' economy, the parents' wishes, education and pregnancy outside of marriage. The public's view of early marriage in Central Buton Regency is to have a positive view because it is commonplace. The role of the government is very influential on the welfare of its people. The village government certainly regrets that children who are still of school age have to choose to get married because these children should get a decent education and must continue their education to a higher level. This has triggered the village government to overcome or minimize the occurrence of marriages by, in the initial stage, being advised by the KUA, the Health Department regarding the impact of early marriage on health, motivating parents to continue their children's education to a higher level, suspending marriage books, tightening the rules of the Marriage Law and its sanctions.
