Abstract

Al-bai’u is an exchange goods or exchange goods for money and Execution of trade contracts It requires the consent of both parties. Akad al-bai’u in restaurants Anyer Banten with the seller does not deliver list of pice of food to customers This research uses an approach qualitative and method Analysis normative-empirical of law research and answer issues that arise in the contract al-bai’u in restaurants The research results show that akad al-bai’u in restaurant is allowed, if akad in restaurant Anyer Banten This is done at the beginning, namely when the buyer has finished taking the desired menu So it's counting Price of food set before the buyer eats And the nature of payment in a direct way between sellers and buyers who meet face to face and Akad al-bai’u in restaurant Anyer Banten is in the form of debts and receivables which must be recorded as stated in the statement of Allah which is written in surah al baqarah ayat 282

Abstract

Faktor-faktor yang mempengaruhi pembiayaan syariah adalah tingkat pendidikan, tingkat religiusitas, tingkat pengetahuan tentang lembaga keuangan syariah, biaya akad, dan jumlah modal terhadap penyerapan pembiayaan syariah oleh UKM pada lembaga keuangan syariah di Kota Metro. Metode pengumpulan data pada penelitian ini menggunakan metode simple random sampling hasil penelitian menunjukkan bahwa terhadap 100 responden yang diambil secara acak, hasil regresi dengan bantuan program SPSS menunjukkan bahwa kelima variabel bebas baik secara sendiri sendiri maupun bersama sama berpengaruh terhadap pembiayaan syariah oleh UKM pada tingkat signifikansi 5% pengaruh tingkat pendidikan, tingkat religiusitas, biaya akad, dan jumlah modal terhadap tingkat penyerapan pembiayaan syariah adalah positif. Sedangkan pengaruh tingkat pengetahuan responden tentang lembaga keuangan syariah terhadap tingkat penyerapan pembiayaan syariah adalah negative. Dengan menggunakan uji beta, diketahui pula bahwa variabel bebas yang paling berpengaruh terhadap penyerapan pembiayaan syariah oleh UKM adalah biaya akad, kemudian diikuti secara berturut turut jumlah modal, tingkat religiusitas, tingkat pendidikan, dan tingkat pengetahuan tentang lembaga keuangan syariah.

Abstract

It cannot be denied that nusus of syari’ah eternal as a scripture Of Allah is absolute Nusus is guidance that covers all aspects human life, individual or society This research uses an approach qualitative method library research The research results show that elasticity of law of syariah which is always based on hikmah and Maslahah al-Ibad. efforts to maintain goals of syariah with maslahah Mu’tabarah, Maslahah Mulghah, and nusus syariah on maslahah in marriage registration is one attempt to realize one of the three of maslahah that exists within humans, namely Daruriyyah, Hajjiyah and Tahsiniyah which is included in the orientation islamic of law pattern“Jalb al-Manfa’ah Wa Daf’u al-Madarrah”, where is the recording? Of marriage with Maslahah Daruriyyah which is included in guarding one of the five things that must be guarded, namely; ad-Din, an-Nafs, al-‘Aql, an-Nasab wa al-Mal.

Abstract

The clothing worn by many Muslim women today often does not align with the guidelines outlined in the Qur'an and is more frequently perceived as a fashion statement on social media. This study aims to analyze the views of prominent mufassirs on Muslim women's clothing based on Qur'anic exegesis, specifically regarding the obligation to cover the aurat. The method used is qualitative analysis, comparing the interpretations of two leading mufassirs, Ibn Kathir and M. Quraish Shihab, regarding the verses that address clothing and aurat. The findings show that, according to both mufassirs, the characteristics of Muslim women's clothing include non-transparent, non-tight, and non-attention-grabbing attire. Although there are differing views on the boundaries of a woman's aurat, both mufassirs agree that covering the aurat is an obligation that must be fulfilled with clothing in accordance with Islamic law, and that the best attire is taqwa clothing. This study concludes that Muslim women should maintain their honor and be cautious in their social interactions to avoid being influenced by the changing times. The world is a temporary place, while the afterlife is the eternal home. The contribution of this study is to provide an understanding of the mufassirs' perspectives on Muslim women's clothing and its relevance to the lives of Muslims in the modern era.

Abstract

Zihar caused controversy between Imam Abu Hanifah and Imam Malik regarding the husband's statement that mentions body parts other than the back or mentions women other than mothers who are forbidden to marry forever. This research uses a qualitative approach with a literature study method. The results show that according to Imam Abu Hanifah, zihar only occurs if the husband mentions body parts that are forbidden to be seen. In contrast, Imam Malik argues that the mention is already included in the category of zihar. In terms of divorce law, Imam Abu Hanifah argues that zihar is not the same as talaq (divorce), while Imam Malik argues that zihar is close to talaq. Imam Abu Hanifah was of the opinion that zihar is close to talaq. Lastly, Imam Abu Hanifah was of the opinion that to erase zihar, one only needs to return to the teachings of Islam, while Imam Malik was of the opinion that the zihar offender must pay kifarat as a form of atonement.

Abstract

Background. The total rejection and cancellation of ash-Shafi'i RA against Istihsan as a legal postulate, both Istihsan carried out by Imam Abu Hanifah RA and his disciples and Istihsan carried out by his followers, and Istihsan carried out by Imam Malik RA and his disciples and followers. Purpose. The study examines the rejection and cancellation of asy-Shafi'i RA against Istihsan. Method. This literature study illustrates the rejection and cancellation of asy-Shafi'i RA against Istihsan. Data was collected from various main sources in the form of books and opinions. The data were analyzed descriptive-qualitatively in the form of causal relationships, associative relationships, and comparisons. Result. The rejection and cancellation of ash-Shafi'i RA against Istihsan is the Istihsan of Imam Abu Hanifah which is narrated by his disciples according to Imam ash-Shafi'i RA has caused many legal decisions that are considered strange because they have left the meaning of the Qur'an and sunnah. As for the accusations of Hanafiah scholars regarding istihsan carried out by as-Shafi'i in a number of his ijtihad practices, none of them have been proven to be true. Which means that Imam as-Shafi'i was consistent in his rejection of Istihsan in his ijtihad.
