Abstract

This study aims to examine the effectiveness of mediation in resolving civil disputes and to identify various challenges faced at the District Court of Bandung. The approach used is normative-empirical juridical, combining analysis of the prevailing legal provisions particularly Supreme Court Regulation (PERMA) No. 1 of 2016 with empirical data obtained through interviews, observations, and document studies of civil cases undergoing mediation. The findings indicate that although mediation has been normatively integrated into the civil justice system, its effectiveness remains low. The main obstacles include the public's low legal awareness regarding the benefits of mediation, the limited number and competence of judge-mediators, and the lack of facilities and institutional support. Furthermore, mediation is often perceived merely as an administrative obligation rather than a substantive dispute resolution mechanism. Therefore, regulatory reform, continuous mediator training, and intensive public education are needed to make mediation a more effective, efficient, and equitable alternative for dispute resolution.

Abstract

Tujuan dilakukannya penelitian ini adalah Untuk mengetahui pelaksanaan adat ‘’Seda’’ pada kasus kawin lari/silariang di kecamatan bonehau kabupaten mamuju dapat di kualifikasi sebagai delik adat. Dalam Penelitian ini menggunakan metode penelitian hukum lapangan atau penelitian Empiris untuk menguruaikan implikasi hukum. Pada dasarnya masyarakat Kabupaten Bonehau ingin mengedepankan sanksi adat ketika kasus kawin lari terjadi. Adanya sanksi adat Seda’ yang masih diakui oleh masyarakat di Kabupaten Bonehau adalah salah satunya manifestasi dari hukum perdata adat. Bentuk sanksi Seda’ atau Hukuman adalah pengenaan sanksi non fisik berupa penghinaan, pengusiran dari desa, dan pengucilan dari masyarakat, terutama keluarga mereka. Sanksi adat Seda’ dalam praktiknya dijalankan keluar secara berkelompok (siko’bon), dengan ketentuan siapa yang diperbolehkan melakukan Seda’ adalah orang yang mempunyai hubungan keluarga atau darah dengan orang tersebutsiapa yang kawin lari (silariang).

Abstract

The protection of indigenous land rights is a crucial aspect in safeguarding the identity, culture, and economic sustainability of indigenous communities. This study examines the integration of customary law (hukum adat) into the national legal framework as a means to ensure legal certainty and justice for indigenous peoples. Using a normative juridical approach supported by statutory, conceptual, and case analysis, the research explores how national regulations accommodate the recognition, protection, and enforcement of customary land rights. The findings reveal that although the Constitution and several sectoral laws explicitly acknowledge the existence of customary law, their implementation is often hindered by overlapping regulations, weak institutional mechanisms, and the dominance of state-centered land policies. The study argues that effective integration requires harmonization between customary norms and national legislation, the establishment of participatory dispute resolution mechanisms, and the strengthening of institutional capacity to recognize and register indigenous territories. This research contributes to the discourse on legal pluralism by offering a framework for integrating customary law into national law without eroding its unique characteristics, thereby promoting both social justice and sustainable land management.

Abstract

This study presents a literature review on the effectiveness of the implementation of restorative justice in the criminal justice system in Indonesia. Restorative justice has emerged as an alternative approach to resolving criminal cases by emphasizing reconciliation, victim-offender dialogue, and community involvement rather than solely focusing on retributive punishment. Through a systematic review of relevant national and international literature published between 2010 and 2024, this study explores the theoretical foundations, legal frameworks, practical applications, and challenges of restorative justice within the Indonesian context. The findings indicate that restorative justice contributes to reducing prison overcrowding, enhancing victims’ satisfaction, and fostering community harmony. However, its effectiveness is often constrained by limited legal awareness, inconsistent implementation, and institutional resistance within the conventional justice system. This review concludes that restorative justice in Indonesia holds significant potential to strengthen a more humane and participatory criminal justice system, provided that it is supported by stronger regulatory frameworks, adequate resources, and comprehensive training for law enforcement officers.
