Abstract

This research discusses the role of ijtihad in the innovation of Islamic banking and finance products, focusing on products such as Sukuk and Murabahah. Ijtihad is important in developing these products to be in accordance with sharia principles, especially in facing the challenges of the conventional financial system based on riba. Sukuk, as an alternative to conventional bonds, is based on the ownership of real assets, while Murabahah is a financing method that does not involve interest. In addition, this paper also highlights the challenges faced by sharia fintechs, particularly in the P2P lending model, which requires ijtihad to ensure compliance with sharia principles. The author emphasizes the importance of general principles in muamalah, such as the prohibition of usury and tyranny, as well as the need for careful ijtihad to maintain the relevance of Islamic financial products to the needs of the times. Obstacles in the ijtihad process, including differences of opinion among scholars, the complexity of modern financial products, and limited resources, were also discussed. In addition, the role of women in contemporary ijtihad is recognized as an important contribution in providing new perspectives and fighting for gender justice.

Abstract

This study aims to analyze the role and function of stamp duty in agreements in Indonesia. Stamp duty is one of the important elements in the document legalization process, which functions as evidence that an agreement has met the formal requirements set by law. In this study, qualitative methods were used to collect data through literature studies. The results of the study indicate that stamp duty not only functions as a source of state revenue, but also provides legal certainty for the parties involved in the agreement. In addition, this study identifies the challenges faced in the implementation of stamp duty, including low public understanding and potential legal disputes. This study is expected to contribute to the development of policies related to stamp duty and increase public awareness of the importance of legal aspects in agreements.-

Abstract

Sustainable economic development aims to balance economic growth, social welfare, and environmental preservation. In the Islamic economic context, Islamic banks are not only profit-oriented but also serve as instruments for public welfare. This study aims to analyze the impact of Islamic bank financing on sustainable economic development through a case study at Bank Syariah Indonesia (BSI) Krakatau Branch, Medan. The research uses a qualitative descriptive approach through interviews, observation, and literature review. Primary data were obtained from interviews with three financing clients and one financing officer, while secondary data were collected from BSI reports, OJK publications, and academic literature. The findings show that Islamic financing positively impacts community economic growth, MSME empowerment, and environmentally friendly financing (green financing). The musyarakah and mudharabah contracts enhance business productivity and welfare, while social programs such as qardhul hasan strengthen social solidarity. However, challenges remain in the dominance of consumptive financing and low Islamic financial literacy. Therefore, Islamic financing should be continuously developed in accordance with maqashid al-syariah principles to achieve an inclusive and sustainable economy.
