Abstract

This study discusses the Islam and Christianity at Rumah Gadang: Characteristics of Minangnese interfaith marriage in Padang, Yogyakarta, and Salatiga. Minangnese households in these three cities are unique because they have two different beliefs. Despite this, their domestic life continues to be harmonious, and no conflicts based on religious beliefs exist. Abstract

Judges are pivotal in issuing impartial decisions that advocate for women, even when they function as primary providers. This study examines the judicial sensitivity towards women as primary breadwinners within families in Padang Lawas Utara. Employing a sociological approach, the research explores the realities among the indigenous people of Padang Lawas Utara. Subsequently, it conducts a comprehensive review of five decisions from the Religious Court of Padang Sidimpuan, falling under the jurisdiction of Padang Lawas Utara. The article reveals that the judges fail to consider the wife’s familial role, especially the role of the wife as the breadwinner. They concentrate solely on the male’s capabilities and rely on evidence of the husband’s income, which proves challenging to validate. Despite the husband’s ownership of assets, including land, houses, rice fields, vehicles, and others, the judge refrains from exercising the ex officio rights to provide the wife's māḍiyah (previous alimony). This underscores the inadequacy of the judge’s sensitivity in establishing the fulfillment and protection of women’s rights, particularly in the context of post-divorce scenarios.

Abstract

<w:LsdException Loc

Abstract

This research focuses on optimizing the management of productive waqf as a solution for economic and social empowerment in Indonesia. With the potential for waqf reaching Rp2,000 trillion per year but the realization is still low, this study highlights the importance of transforming waqf from a consumptive to productive model to strengthen the welfare of the people. The method used is a literature review with a qualitative approach, which analyzes various sources related to the implementation of productive waqf. Data was collected from relevant journals, books, and research reports from 2018-2023. The results of the study show that the implementation of productive waqf has succeeded in increasing people's income by up to 40-60% through the creation of jobs and waqf-based business units. Technological innovations, such as the adoption of digital platforms and blockchain, play an important role in increasing transparency and accountability in waqf management. This research also underscores the importance of cross-sector collaboration and strengthening the capacity of nazhir for program sustainability. The contribution of this research lies in the development of an integrative model that combines technological, social, and economic aspects, as well as the formulation of a comprehensive monitoring system. The novelty of this study is a holistic approach that not only focuses on economic aspects, but also social empowerment and improving the quality of human resources in the productive waqf ecosystem. This research is expected to be a reference in accelerating the transformation of productive waqf for the welfare of the people in Indonesia. REFERENCES Abdullah, M. (2022). Abstract

Radicalism remains a significant concern in Indonesia, particularly inside the educational setting. This study seeks to comprehend the phenomena of radicalism among students, particularly among Islamic Religious Universities (PTKI). Data was acquired using a qualitative technique through interviews, observations, focus group discussions, and surveys at five PTKIs in Sumatra. Significant findings indicate that approximately 50% of students acknowledge the presence of radical ideology on their campuses, however their understanding of the term of radicalism varies. Women have been recognized for their roles in radical organizations, serving as both recruiters and logistical supporters. This study's result underscores the necessity for enhanced literacy on radicalism among students, as well as the imperative to elevate understanding of women's participation in radical movements, which necessitates academic and legislative measures to disrupt the cycle of radicalism..

Abstract

This research discusses the role of ijtihad in the innovation of Islamic banking and finance products, focusing on products such as Sukuk and Murabahah. Ijtihad is important in developing these products to be in accordance with sharia principles, especially in facing the challenges of the conventional financial system based on riba. Sukuk, as an alternative to conventional bonds, is based on the ownership of real assets, while Murabahah is a financing method that does not involve interest. In addition, this paper also highlights the challenges faced by sharia fintechs, particularly in the P2P lending model, which requires ijtihad to ensure compliance with sharia principles. The author emphasizes the importance of general principles in muamalah, such as the prohibition of usury and tyranny, as well as the need for careful ijtihad to maintain the relevance of Islamic financial products to the needs of the times. Obstacles in the ijtihad process, including differences of opinion among scholars, the complexity of modern financial products, and limited resources, were also discussed. In addition, the role of women in contemporary ijtihad is recognized as an important contribution in providing new perspectives and fighting for gender justice.

Abstract

Social and economic transformations are prompting an increasing number of women to assume the position of primary earners within the household.  Despite its integration into contemporary social realities, this phenomena presents legal issues within the framework of Islamic family law and religious court traditions, particularly regarding the delineation of duties, rights, and obligations within the household.  This study seeks to examine the legal implications of Religious Courts about women as the economic foundation of the family, and to assess the degree to which the principle of gender justice is implemented in matters of maintenance, divorce, and child custody.  The employed methodology is qualitative, utilising a juridical-empirical approach, involving an analysis of pertinent Religious Court rulings and interviews with judges and individuals possessing firsthand experience with the matter. The research findings indicate a lack of consistency in the implementation of gender justice principles, wherein women's economic contributions frequently lack commensurate recognition and legal protection, particularly regarding post-divorce maintenance and the allocation of caregiving responsibilities.  These findings necessitate a rethinking of Islamic legal principles that is more responsive to contemporary social realities, including reforms in religious court policies that are more inclusive and gender-sensitive to secure substantive justice for women as major breadwinners.

Abstract

This study investigates the correlation between citizenship status and religious freedom within Indonesia's multicultural society, emphasizing the legal obstacles encountered by religious minority groups. The methodology employed is a normative-doctrinal legal approach, analyzing several national legal instruments, Constitutional Court rulings, and literature on legal and human rights. The research findings indicate a discrepancy between constitutional provisions that ensure religious freedom and prevailing legal practices that are often discriminatory. For instance, restrictions persist that restrict access to civil registry and marriage for followers of faiths beyond the six recognized religions. Furthermore, the legal status of groups like Ahmadiyah and practitioners of indigenous traditions signifies a de facto exclusion from citizenship. The findings suggest that the Indonesian legal system has not yet adequately ensured the concept of non-discrimination within the context of an inclusive rule of law. This research advocates for the enhancement of the alignment between positive legal norms and constitutional ideals, as well as the facilitation of additional studies utilizing comparative and empirical methodologies to advance equitable legal protection for minority groups.

Abstract

The purpose of this study is to examine how the Toba Batak Muslim community maintains its cultural identity in the face of complex dynamics while adapting to Islamic principles in the face of urbanization and economic change by examining the pattern of relationships between Islamic law and customary traditions. Three regions—traditional rural areas (Humbang Hasundutan, Tapanuli Utara, Samosir, Toba), multireligious communities (Asahan, Tanjung Balai, Labuhanbatu), and large cities (Medan, Bandung)—are the focus of this qualitative study using a case study methodology. The study's findings highlight three key trends in the interaction between Islam and customs: harmony, compromise, and adaptation. The adaptation trend is evident in individuals from the place of origin who endeavor to maintain practices with minimal impact from Islamic law. A negotiation pattern has developed among individuals in diverse religious contexts who want to reconcile local customs with Islamic principles. Simultaneously, a pattern of harmony is observed in metropolitan areas, where individuals successfully reconcile traditions with Islamic tenets within a contemporary framework. Economic conditions and social mobility significantly influence these trends. Individuals with superior economic advantages often prioritize religious ideals, whereas others with economic constraints rely more on customs as a social mechanism. Social mobility facilitates the adaptation of traditional values to be more flexible and inclusive of Islamic beliefs, particularly in metropolitan settings. This study suggests that economic factors and social mobility act as catalysts in transforming the link between customs and religion within the Toba Batak Muslim community. Research recommendations emphasize the significance of locally-based religious education, inclusive discussion between indigenous and religious leaders, and economic empowerment to foster harmony between traditional beliefs and Islam.
