Abstract

Asymmetric warfare involving state and non-state actors in modern conflicts poses serious challenges to the implementation of International Humanitarian Law (IHL). This study analyzes the mismatch in the identification of combatants, the problems surrounding civilian protection, and accountability for violations within the context of asymmetric conflicts. The findings indicate that the ambiguity of combatant status and the strategic use of civilians as human shields hinder the application of fundamental IHL principles, such as distinction and proportionality. Moreover, international legal enforcement mechanisms continue to face significant limitations in prosecuting violations, particularly those committed by non-state actors. This study recommends strengthening adaptive legal frameworks and establishing effective accountability mechanisms to ensure the protection of human rights and legal order in asymmetric conflict situations. The research contributes significantly to the development of humanitarian law that is responsive to the dynamics of contemporary conflicts.

Abstract

Serangan siber terhadap infrastruktur kritis, seperti energi, transportasi, dan kesehatan, telah menjadi ancaman serius bagi keamanan nasional dan kesejahteraan masyarakat. Kerentanan yang meningkat, dampak ekonomi yang signifikan, serta gangguan sosial dan psikologis menuntut pendekatan komprehensif untuk mitigasi. Studi literatur ini menganalisis berbagai sumber akademis dan laporan industri untuk mengidentifikasi pola serangan siber, dampaknya, serta strategi mitigasi yang efektif. Pendekatan kualitatif digunakan untuk menyintesis temuan dari kasus-kasus serangan besar seperti WannaCry (2017) dan serangan jaringan listrik Ukraina (2015). Serangan siber meningkat drastis, terutama ransomware (300% pada 2020–2022) dan DDoS (2.5 Tbps pada 2022). Dampak ekonomi mencapai $385 miliar secara global pada 2022. Efek sosial mencakup peningkatan kecemasan (42%) dan penurunan kepercayaan publik. Analisis menunjukkan kerentanan infrastruktur akibat ketergantungan pada sistem terhubung dan teknik serangan multivector (47% kasus). Perlindungan infrastruktur kritis memerlukan kolaborasi multisektor (Pentahelix), regulasi ketat, dan adopsi teknologi canggih seperti AI dan blockchain. Edukasi keamanan siber serta kebijakan terintegrasi penting untuk meningkatkan ketahanan nasional.

Abstract

The development of combat drone technology has revolutionized the landscape of modern warfare, but also presents new challenges to the fundamental principles of International Humanitarian Law (IHL), particularly the principle of distinction between combatants and civilians. This article examines the ethical and legal dilemmas of drone usage through a qualitative normative juridical approach, using case studies from the Gaza conflict (Israel vs. Hamas) and the Russia–Ukraine war. The analysis reveals that despite drones offering high precision, field practices often demonstrate violations of the principle of distinction, whether due to intelligence negligence or policies that relax the definition of combatants. The technological imbalance of drone warfare also risks eroding humanitarian values and dehumanizing victims. This study underscores that technological advancement must be accompanied by the strengthening of legal accountability, the integration of ethics into military procedures, and the adaptation of operational rules to uphold humanitarian principles in warfare. Therefore, redefining the application of the principle of distinction is necessary to address the challenges of remote drone-based warfare, in order to ensure that the value of life remains protected amidst the escalation of military technology

Abstract

Prinsip proporsionalitas merupakan salah satu pilar utama dalam hukum humaniter internasional yang mengatur perilaku dalam konflik bersenjata. Artikel ini menganalisis implementasi prinsip proporsionalitas dengan membandingkan dua konflik berbeda era: Perang Dunia II (1939-1945) dan Konflik Rusia-Ukraina (2014-sekarang). Menggunakan metode kajian literatur komprehensif, penelitian ini mengevaluasi bagaimana interpretasi dan penerapan prinsip proporsionalitas berevolusi dari konflik konvensional berskala besar ke konflik kontemporer yang lebih kompleks. Temuan menunjukkan pergeseran signifikan dalam penerapan prinsip proporsionalitas, dipengaruhi oleh perubahan teknologi persenjataan, peran media dan opini publik, serta perkembangan kerangka hukum internasional. Studi ini mengidentifikasi bahwa meskipun terdapat kemajuan dalam kodifikasi hukum humaniter, tantangan dalam implementasi proporsionalitas tetap persisten, khususnya dalam konflik asimetris dan hibrid seperti yang terjadi di Ukraina. Implikasi penting muncul bagi reformasi hukum humaniter internasional dan pelatihan militer untuk mengadaptasi prinsip proporsionalitas sesuai dengan karakteristik peperangan modern.
