Abstract

The city of Manado, as one of the centers of economic growth in North Sulawesi, has experienced an increasing demand for transportation in line with population growth and urbanization. This phenomenon presents challenges related to overloaded freight transport, which impacts traffic safety and road infrastructure conditions. This study aims to evaluate the implementation of Permenhub Number 18 of 2021 concerning the supervision of freight transport loads in the city of Manado. The research employed a qualitative approach with a case study method, involving the Head of the Transportation Agency of Manado City and three truck drivers as samples selected through purposive sampling. Data were collected through interviews, field observations, and analysis of related documents. The focus of the research is to identify the effectiveness of the supervision carried out by the Transportation Agency of Manado City and the evaluation measures taken on vehicles with excessive loads. The findings indicate that the supervision of freight transport loads still faces several challenges, including a lack of supporting facilities such as weighbridges and limited monitoring personnel. Efforts made by the Transportation Agency include improving coordination with related institutions, providing education to transportation operators, and imposing sanctions in accordance with regulations.

Abstract

Yayasan merupakan salah satu bentuk subyek hukum yang dibentuk bukan untuk tujuan mencari profit sebagaimana badan hukum lainnya. Tujuan dari penelitian ini adalah untuk mengetahui peran dan tanggungjawab organ pengawas dalam mencegah penyalahgunaan fungsi dan tujuan Yayasan. Metode penelitian yang dipakai yakni penelitian hukum normatif atau lazim disebut dengan studi pustaka atau library research. Hasil penelitiannya dapat dikemukakan bahwa regulasi yang mengatur terkait dengan yayasan tersebut telah ditata dalam hukum Indonesia malahan sebelum dibentuknya atau diterbitkannya Undang-Undang Yayasan 16 Tahun 2001 jo Undang-undang Nomor 28 Tahun 2004 yang merupakan perubahan Undang-undang Nomor 16 Tahun 2001, yakni sumbernya berasal dari Yurisprudensi maupun dapat ditelusuri pada pasal-pasal di KUHPerdata atau Kitab Undang-Undang Hukum Perdata. Pada pendirian yayasan harus lewat notaris yang akta pendiriannya itu diberikan kepada Kemenkumham lewat Sistem Administrasi Badan Hukum atau Sisminbakum. Undang-undang Yayasan sudah mengatur dengan tegas wewenang serta tanggung jawab bagi tiap organ yayasan sehingga bisa memperkecil ruang gerak terhadap mereka yang mau melakukan penyelewengan atau penyalahgunaan kewenangannya.

Abstract

Online gambling's explosive expansion and the widespread reach of social media platforms have raised serious concerns, especially with regard to its effects on young people. This study investigates how young people in Tomohon, Indonesia, perceive and behave in response to online gambling ads via Instagram influencers (selebgram). The goal of this study was to find out how young people's attitudes and comprehension of the legal ramifications of online gambling are influenced by their exposure to gambling advertisements on social media. Twenty young people between the ages of 18 and 25 participated in in-depth interviews and focus groups as part of a qualitative research approach, which also included a content analysis of Instagram posts endorsing online gambling. According to the study, a sizable percentage of participants (75%) had encountered online gambling ads, and 60% said they would like to try it out despite their lack of knowledge about the potential legal repercussions. Furthermore, it was discovered that young people's views of online gambling as an enjoyable and possibly lucrative pastime were influenced by their frequent usage of social media and the favorable representation of gambling by influencers. The study comes to the conclusion that in order to inform young people about the dangers and potential legal repercussions of online gambling, there is an urgent need for more legal literacy and focused awareness initiatives. Furthermore, to stop the marketing of online gambling on social media platforms, stricter regulations are needed.
