Abstract

This research is based on data from the Ministry of Women's Empowerment and Protection of the Republic of Indonesia in 2022 which indicates that there are around 52,000 marriage dispensation cases that will go to the religious courts. Around 34,000 of these cases were triggered by the faktor of love which prompted parents to apply for their children to be married off immediately. Various faktors causing early marriage include pregnancies outside of marriage, environmental influences, and family faktors such as economic limitations. Individual faktors such as physical development and the influence of social media also play a role in this problem. The purpose of this study was to identify the causal faktors and solutions to the problems of Islamic education in families of early marriage in Kundisari Kedu Village, Temanggung. The method used is a qualitative approach with descriptive methods, with data collection techniques including observation, documentation, and interviews with residents of Kundisari village. The results of the study show that the lack of parental education and limited knowledge of Islamic education affect children's education. Busy parents, lack of consistent application of religious teachings, and lack of provision for parents are also problems in Islamic education in early marriage families. Therefore, solutions can be found through an Islamic family environment, increased parental education, open communication, and monitoring the use of technology.

Abstract

This article discusses the recognition of the constitution, laws, and regulations, customary law, and Islamic law in the Indonesian and Malaysian legal systems through a comparative legal approach. Indonesia, which adheres to the civil law tradition of Dutch heritage, and Malaysia, which adopts common law inherited from the British, turn out to show important similarities in terms of recognition of the four sources of law. The Constitution is placed as the highest law that serves as the basic guideline for the administration of the state, while laws and regulations function as the main instrument to translate the mandate of the Constitution. Customary law in both countries is still recognized as long as it does not conflict with national regulations, reflects local cultural identity, and plays a role in resolving community disputes. Meanwhile, Islamic law has received formal space through religious courts in Indonesia and sharia courts in Malaysia, especially in family, inheritance, and morality matters. This study uses a normative legal method with a comparative approach, supported by primary and secondary legal materials. The results of the study show that despite the different systems, Indonesia and Malaysia have succeeded in combining colonial heritage with local and religious identities, so that the legal system is plural, dynamic, but still integrated. These findings enrich comparative legal studies in Southeast Asia and make an academic contribution to understanding the dynamics of legal pluralism in cognate regions.

Abstract

This study examines the role of ustadz as agents of religious moderation at the Majelis Tafsir Al-Qur’an (MTA) Islamic Boarding School in Karanganyar, Central Java, through a qualitative case study involving 12 informants using interviews, observations, and documentation. The findings indicate that educational background and preaching experience influence the ustadz’s understanding and strategies in internalizing moderation, whether through sermons, discussions, exemplary conduct, or non-formal activities, although consistency remains uneven. The ustadz play a role in fostering tolerance and social harmony, with positive impacts on students’ mindsets, making them more critical, inclusive, and tolerant, despite some still perceiving moderation as a weakening of principles. Challenges include student resistance, limited ustadz capacity, and the influence of digital media, while opportunities involve media literacy, inter-community activities, and internal policies. The success of religious moderation depends on curriculum integration, role modeling, and sustainable social guidance, which can be replicated in other Islamic boarding schools.
