Kata Kunci: Implementasi, Nilai-Nilai, Budaya Islam,MAN 11 Jakarta Selatan

Abstract

The expansion of digital technology has enabled corporations to conduct employee surveillance beyond working hours through electronic systems and personal data monitoring. Such practices raise legal concerns as they may exceed employer authority under labor law and violate personal data protection principles. This study analyzes the legal limits of off-duty employee surveillance based on Indonesian labor law, electronic information law, and personal data protection law, and formulates corporate criminal liability for such practices. Using normative juridical methods and statutory analysis, the study finds that off-duty surveillance lacks legal basis in labor law, may constitute unlawful electronic access under electronic information law, and represents unlawful personal data processing under data protection law. When implemented as corporate policy, such surveillance fulfills elements of corporate criminal liability. Off-duty employee surveillance constitutes a deviation from statutory limits of corporate authority and infringes workers’ privacy rights.

Abstract

The growing elderly population in Indonesia highlights the need for effective psychosocial interventions that can enhance learning interest and active participation among older adults living in social care institutions. One approach that has potential but remains underexplored in this context is positive reinforcement. This study aimed to examine the effect of positive reinforcement on the learning interest of elderly individuals participating in psychosocial guidance activities at the Tresna Werdha Budi Mulia 3 Social Welfare Institution, Jakarta. A quantitative approach was employed using a quasi-experimental pretest–posttest control group design. A total of 30 elderly participants were divided equally into an experimental group, which received positive reinforcement, and a control group, which received no reinforcement. Learning interest was measured using an instrument developed based on B. F. Skinner’s operant conditioning theory. Data analysis was conducted using Jamovi software, including normality testing and t-test analysis. The results indicated that the data were normally distributed. Statistical analysis revealed a significant difference in posttest learning interest scores between the experimental and control groups (p < 0.001). The experimental group demonstrated substantially higher learning interest compared to the control group, with a very large effect size, indicating a strong practical impact. These findings suggest that positive reinforcement is an effective strategy for enhancing learning interest among older adults in psychosocial guidance settings.

Abstract

This study is motivated by the decline of moral integrity in legal politics and public policy in Indonesia, characterized by the dominance of pragmatic interests and the insufficient implementation of Pancasila values and the 1945 Constitution of the Republic of Indonesia. Normatively, the strengthening of state ideology is mandated in Article 1(3) of the 1945 Constitution, which affirms Indonesia as a state governed by law, Article 31(3) concerning the development of a national education system based on faith, piety, and noble character, and Law No. 20 of 2003 on the National Education System emphasizing character building. However, in practice, the teaching of Pancasila and constitutional values remains suboptimal across educational levels, resulting in weak ideological and constitutional understanding among society, including academics, public officials, and legal practitioners. This research aims to analyze the condition of moral integrity in legal politics, examine the impact of weak ideological education, and formulate a reconstruction of national legal development based on Pancasila and constitutional values. The study employs a normative juridical method with statutory, conceptual, philosophical, and historical approaches. The findings indicate that moral degradation in legal politics is closely linked to the weak internalization of Pancasila values in education and legal practice. Therefore, strengthening Pancasila education, reforming legal policies, and reinforcing constitutional values across all aspects of national life are essential to achieving a just, moral, and sustainable legal system.
