Abstract

Pemenuhan Hak Anak para Pekerja Migran, khususnya anak Pekerja Migran Indonesia (PMI) yang berada di Malaysia merasakan berbagai permasalahan dalam pemenuhan hak mereka sebagai anak, termasuk akses terhadap pendidikan, layanan kesehatan, dan perlindungan dari eksploitasi dan diskriminasi. Faktor-faktor seperti status imigrasi, ketidakstabilan ekonomi, dan kurangnya kesadaran akan hak-hak anak menjadi hambatan utama dalam memperjuangkan hak-hak mereka. Penelitian ini diharapkan dapat meningkatkan pemahaman yang lebih mendalam tentang situasi anak Pekerja Migran Indonesia Malaysia dan mendorong adanya perhatian lebih lanjut terhadap perlindungan dan pemenuhan hak mereka.

Abstract

Problem sampah masih tetap menjadi permasalahan serius bagi masyarakat. Walaupun secara hukum pengaturan mengenai lingkungan yang bersih dan sehat telah ada, namun dalam praktiknya kondisi lingkungan tetap rawan mengalami pencemaran, termasuk karena keberadaan sampah. Masyarakat Desa Umbul Tanjung juga menghadapi problem sampah, yang jika tidak tertangani dengan baik, maka berpotensi pula menimbulkan dampak negatif, baik terhadap kesehatan masyarakat bahkan terhadap hasil tangkapan ikan para nelayan di Desa Umbul Tanjung. Kajian ini akan membahas mengenai kegiatan pengabdian kepada masyarakat yang dilakukan oleh tim Fakultas Hukum Universitas Pancasila yang ditujukan untuk mengatasi persoalan sampah. Kegiatan tersebut lantas menawarkan beberapa alternatif solusi untuk mengatasi problem sampah di Desa Umbul Tanjung yang mengedepankan sinergi antara aspek sosial, hukum, dan teknologi ramah lingkungan.

Abstract

Climate change has become a major driver of cross-border displacement, creating the phenomenon of climate refugees. Although the 1951 Refugee Convention does not explicitly recognize this category, the reality of climate-induced displacement demands legal and policy responses from states, including Indonesia. As a transit country, Indonesia lacks a national legal framework specifically addressing the status and protection of climate refugees, and in practice, protection relies on the United Nations High Commissioner for Refugees through the single submission scheme, the only system for refugee identification and registration in the country. This reliance exposes a regulatory vacuum and legal vulnerabilities related to state sovereignty. This paper examines Indonesia’s response, highlighting the importance of updating national regulations and strengthening coordination with UNHCR to provide inclusive, human rights-based protection for climate refugees.

Abstract

The armed conflict in Aceh for nearly three decades has had serious impacts on civil society, including family loss, psychological trauma, poverty, and limited access to justice. The establishment of the Aceh Truth and Reconciliation Commission (KKR) is an important effort in the framework of transitional justice to uncover the truth and restore victims' rights. However, the cancellation of Law Number 27 of 2004 concerning KKR by the Constitutional Court erased the basis of national law, thereby weakening the state's responsibility in the recovery of victims. This study aims to analyze the role of the Aceh KKR in restoring victims' rights and the impact of the repeal of the law on the effectiveness of recovery. This study uses an empirical-normative method with a legislative and sociological approach. Primary data were obtained through in-depth interviews with three families of conflict victims in Blang Bintang District, Aceh Besar, while secondary data came from academic literature, laws and regulations, and reports from human rights institutions. The analysis was carried out qualitatively to understand the relationship between the legal framework and the social reality of the victim. The results of the study show that the Aceh KKR carries out recovery through disclosure of the truth, reparation recommendations, and social reconciliation. However, the absence of national legal support creates legal uncertainty, administrative barriers, and psychological burdens for victims. Thus, the Aceh KKR plays an important but limited role in the national legal vacuum. Therefore, this study recommends strengthening the national legal framework that supports transitional justice as well as the implementation of effective and sustainable reparations for conflict victims.
