Abstract

This qualitative study investigates the criminology of corruption within Indonesia's public sector, employing the Behavioral Crime Theory, Rational Choice theory, and Social Learning theory as theoretical frameworks. Drawing upon secondary data from reputable sources such as books and journals, the study aims to achieve several objectives: first, to understand the behavioral patterns underlying corrupt activities among public officials; second, to analyze the rational decision-making processes that lead individuals to engage in corrupt practices; and third, to explore the role of social learning mechanisms in perpetuating corrupt behavior within the public sector. The study hypothesizes that the low level of sanctions, coupled with the preference for corruption due to perceived benefits and the inadequate conditions of incarceration, contribute to the persistence of corruption in Indonesia's public sector. Findings indicate a correlation between lenient legal consequences, personal preference for corruption, and the state of correctional facilities, highlighting the need for comprehensive reforms in both legal enforcement and penal institutions. Recommendations include strengthening anti-corruption laws, enhancing penalties for corrupt activities, fostering a culture of integrity through education and awareness, and improving the conditions of imprisonment to serve as a deterrent against corrupt behavior. This research contributes to the understanding of corruption dynamics in the public sector and provides insights for policymakers and law enforcement agencies to combat this pervasive societal issue effectively.

Abstract

This study aims to reconstruct the role of the Prosecutor's Office in the Indonesian juvenile criminal justice system, particularly in addressing the phenomenon of child delinquency where the perpetrator is under 12 years old. The fundamental problem arises when the prosecution process is formally halted (based on Article 21 of the SPPA Law), which implicitly causes the Prosecutor to ignore the victim's rights by his capacity as Dominus Litis. Through normative juridical research methods with a philosophical and conceptual approach, this study identifies a systemic failure in realizing substantive justice for child victims. The originality of this thinking lies in the deconstruction of the Prosecutor's rigid role from merely a public prosecutor to a representative of the state through the doctrine of Parens Patriae. The results of the study recommend an integrative protection model based on Pancasila Justice, where the Prosecutor acts as a restorative catalyst that guarantees restitutio in integrum for child victims through an institutionalized non-litigation mechanism.

Abstract

AbstractChildren who become victims of serious crimes have rights guaranteed by the state through Law Number 35 of 2014 concerning Child Protection. However, the fulfilment of these rights, particularly restitution and rehabilitation, remains suboptimal. This study is important to analyse the extent to which the law ensures the fulfilment of child victims’ rights and how its implementation is reflected in the Central Jakarta District Court Decision Number 3/Pid.Sus-Anak/2023/PN.Jkt.Pst. The research method used is normative juridical with a statutory and case study approach. The results show that although the Child Protection Law provides a strong normative basis, judicial practice still prioritizes the best interests of the child offender. This study concludes that strengthening the implementation mechanism for fulfilling child victims’ rights is essential to achieve a balance between the protection of offenders and victims within the juvenile criminal justice system.AbstrakAnak sebagai korban tindak pidana berat memiliki hak yang dijamin oleh negara melalui Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak. Namun, pemenuhan hak tersebut, khususnya terkait restitusi dan rehabilitasi, masih belum optimal. Penelitian ini penting dilakukan untuk menganalisis sejauh mana ketentuan dalam undang-undang tersebut menjamin pemenuhan hak-hak anak korban tindak pidana berat serta bagaimana implementasinya berdasarkan Putusan Pengadilan Negeri Jakarta Pusat Nomor 3/Pid.Sus-Anak/2023/PN.Jkt.Pst. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan studi kasus. Hasil penelitian menunjukkan bahwa meskipun secara normatif perlindungan terhadap korban anak telah diatur, praktik peradilan lebih menitikberatkan pada kepentingan terbaik bagi pelaku anak. Simpulan penelitian ini menegaskan pentingnya penguatan mekanisme implementasi pemenuhan hak korban anak guna mewujudkan keseimbangan antara perlindungan terhadap pelaku dan korban.
