Abstract

This research aims to find out and analyse how the implementation of the basic values of ASN BerAKHLAK in improving employee performance in Garut Regency, and to find out and analyse what are the inhibiting factors in the process of implementing the basic values of ASN BerAKHLAK in improving employee performance in Garut Regency. The research method was conducted with a descriptive qualitative approach to explore and analyse the implementation of the basic values of ASN BerAKHLAK in improving employee performance in Garut Regency. This research focuses on data collection through in-depth interviews with employees who are directly involved in public services in Garut Regency. The results revealed that the implementation of ASN BerAKHLAK basic values in Garut Regency, which consist of service-oriented, accountable, competent, harmonious, loyal, adaptive, and collaborative, is an important foundation in building an effective work culture in government agencies. These values not only improve employee performance, but also strengthen ASN's commitment to public services in Garut Regency.

Abstract

Tujuan Penelitian ini adalah untuk mengetahui pengaruh Motivasi Terhadap Kinerja Pegawai Badan Kepegawaian dan Diklat Kabupaten Garut, data yang digunakan dalam penelitian ini adalah data primer, yang langsung didapatkan dari sumbernya. Metode penelitian yang penulis gunakan adalah metode penelitian kuantitatif serta variabel yang diteliti variabel kinerja dan variabel motivasi. Hasil penelitian menunjukan ada pengaruh motivasi terhadap kinerja karyawan dibuktikan dengian hasil regresi sebesar 0,749 (74,9%) dan koefisien determinasi (R²) sebesar 56,1% dibuktikan dengan hasil Uji Korelasi product moment r = 0,743 dengan signifikan p < 0,05. Hal ini juga dapat dilihat dari nilai thitung > ttabel (11,198 > 2,000) dan nilai signifikansi < taraf signifikansi (α) 0,05 (0,000 < 0,05). R² sebesar 56,1%, yang memperlihatkan bahwa Variabel Kinerja tidak hanya di-pengaruhi oleh Variabel Motivasi, melainkan ada faktor lain sebesar 43,9% yang mempengaruhi oleh pengetahuan, keterampilan, kompe-tensi dan pengalaman kerja. Hasil analis deskrips yaitu untuk pern-yataan pegawai memiliki kesempatan untuk mengembangkan ke-mampuan dan kompetensi, hal ini disebabkan masih banyaknya pegawai di Badan Kepegawaian dan Diklat Kabupaten Garut yang belum mendapatkan kesempatan untuk mengikuti Diklat teknis sesuai dengan jabatannya, misalnya Diklat Analis Sumber Daya Manusia Aparatur, Diklat Asesor Kepegawaian, dan Diklat-diklat teknis lainnya yang berkaitan dengan tugas dan fungsi Badan Kepeg-awaian dan Diklat Kabupaten Garut.

Abstract

The accelerating pace of digital transformation, globalization, and technological disruption underscores the importance of Digital Leadership Agility (DLA) in multinational corporations (MNCs). This study examines the influence of DLA on Organizational Resilience (OR) through strategic alignment and dynamic capabilities, while also considering the moderating roles of national digital competitiveness and organizational stagility.  A cross-sectional survey covering business units from multiple industries in the Asia-Pacific, European Union, and North America was conducted. Using validated measurement scales, the study applied Structural Equation Modeling (SEM) and Hierarchical Linear Modeling (HLM) to test mediation, moderation, and cross-cultural comparability. The results show that DLA significantly enhances OR through strategic alignment and dynamic capabilities, with stronger effects in high-technology industries. National digital competitiveness and organizational stagility further strengthen these relationships, indicating threshold effects of infrastructure and capability. The findings also highlight the relevance of organizational culture and resources, and emphasize the need to balance agility and stability. Practical implications include decentralizing decision making, fostering cross-functional collaboration, and tailoring leadership training to industry and cultural contexts. Overall, DLA emerges as a critical driver of OR by integrating digital transformation with adaptive leadership practices. Organizations should embed DLA in leadership development and design structures that balance responsiveness with cohesion. For policymakers, especially in digitally emerging economies, investing in leadership capacity, innovation ecosystems, and infrastructure is essential to enhance competitiveness and ensure sustainable growth.

Abstract

High technology project environments present a complex landscape of interdependent risks spanning governance, technical, and operational domains. This study examines the integration of governance structures, domain specific technical controls, and agile risk management practices to address these multifaceted challenges. The research highlights the strategic synergy between frameworks such as ISO 31000, ISO/IEC 27005, NIST SP 800 53, and the NIST AI RMF, combined with agile techniques like SAFe ROAM, to create a comprehensive, layered risk management architecture. This approach enables precise risk identification, robust mitigation planning, and responsive adaptation to rapidly evolving technological and market conditions. The methodology involved analyzing best practices in cross framework integration, risk mapping, and agile tracking methods, supported by case studies and empirical literature. Key findings show that multi-layered frameworks improve adaptability, strengthen decision making, and enhance transparency. They also create a shared risk language across technical, managerial, and executive levels, which improves communication and coordination. Results reveal that challenges persist, including coordination complexity, cultural resistance, and potential duplication when frameworks are not harmonized. Addressing these issues requires deliberate integration planning, stakeholder engagement, and change management strategies. In addition, adopting AI and automation improves real-time risk detection, dynamic control mapping, and continuous monitoring. These capabilities help organizations maintain compliance and resilience in rapidly changing regulatory environments. In conclusion, multi layered risk management frameworks represent a strategic imperative for organizations operating in high tech sectors. By combining governance oversight, technical precision, and agile adaptability, these frameworks deliver resilience, foresight, and agility essential for sustainable growth and long term competitive advantage.

Abstract

Cross-border e-commerce has created unprecedented opportunities for global trade but also introduced complex legal challenges regarding jurisdiction and applicable law in consumer disputes. This article explores how legal systems particularly those of the European Union (EU), the United States (US), ASEAN, and Indonesia govern jurisdiction and applicable law in business-to-consumer (B2C) e-commerce transactions. Using a doctrinal and comparative legal method, the study analyzes key instruments such as the Brussels I Recast, Rome I and II Regulations, Hague Conventions of 2005 and 2019, and relevant national laws. Case law from the CJEU and US courts is used to illustrate doctrinal interpretations, with attention to the targeting test, forum-selection enforceability, and protection of consumer rights. Procedural tools such as the Hague Service and Evidence Conventions are also examined. Findings reveal that while the EU offers a harmonized, consumer-focused regime, enforcement across borders remains inconsistent. The Hague 2019 Convention presents a pathway toward enforceability but requires broader ratification. The US system emphasizes contractual freedom, often limiting consumer protections. Regional efforts, particularly in ASEAN and Indonesia, demonstrate varied progress in legal harmonization. Jurisdictional ambiguity, enforcement gaps, and fragmented legal standards continue to affect legal certainty in cross-border e-commerce. The article concludes that harmonized jurisdictional and applicable law standards, coupled with technological and institutional innovation, are necessary to ensure consumer protection and support legal predictability in global digital markets.
