Abstract

 Electronic medical records are needed in healthcare facilities for the hospital’s complete, accurate and real-time data required to improve an optimum, efficient and integrated health care. Electronic documents can be used as legal evidence based on Article 5 paragraphs (1) and (2) of Law Number 11 The year 2008 on Electronic Information and Transactions stating that electronic documents are legal evidence that is lawful and they are the expansion of legal evidence. Electronic documents are considered valid if the system is in accordance with the provision of Article 5 paragraph (3) of Law Number 11 The year 2008 on Electronic Information and Transactions.Keywords: evidence, electronic and medical records

Abstract

Abstrak Skincare menjadi kebutuhan utama masyarakat di semua kalangan, baik perempuan ataupun laki-laki dan dari beragam kelas ekonomi. Akan tetapi hal ini dimanfaatkan oleh beberapa pelaku yang tidak bertanggung jawab usaha atau bahkan dokter yang mengerti akan kandungan kosmetika yang seharusnya tidak untuk digunakan untuk tubuh dengan memproduksi skincare, menambahkan bahan kimia berbahaya steroid. Rumusan Masalah dalam artikel ini adalah Apa peranan Badan Pengawas Obat dan Makanan (BPOM) dalam melakukan pengawasan terhadap produk kosmetik yang bersteroid dan bagaimana tanggung jawab pelaku usaha terhadap kerugian konsumen akibat kosmetik bersteroid. Metode pendekatan yang digunakan adalah metode yuridis normatif. Peranan Badan Pengawas Obat dan Makanan (BPOM) adalah turut serta melakukan kewenangannya sebagai pengawas, dan melakukan suatu pengecekan apabila terjadi suatu kecurigaan terhadap suatu produk yang disinyalir menggunakan suatu bahan yang dilarang oleh pemerintah yang dapat merugikan, dan mengancam keselamatan jiwa terhadap konsumen sesuai dengan Undang-Undang yang berlaku. Tanggung Jawab Pelaku Usaha terhadap konsumen yang mengalami kerugian akibat penjualan kosmetik bersteroid berupa pemberian ganti rugi. Hak ganti kerugian yang diberikan kepada konsumen ini bersifat universal disamping hak-hak pokok lainnya. Kata Kunci : Tanggung Jawab Pelaku Usaha, Konsumen, skincare bersteroid.  Abstract Skincare is a major need of society in all circles, both women and men, and from various economic classes. Increasingly the age of increasing number of types of skincare that can be chosen by consumers. However, this is exploited by some business-responsible actors or even doctors who understand the cosmetics content that should not be used for the body by producing skincare, adding dangerous steroid chemicals. The sale and purchase of skincare, which is carried out specifically by individuals who understand the dangerous ingredients of skincare, are carried out to get the attention of various groups of people. Steroids are active chemicals in sterol fat which, when mixed with other cosmetics, will cause skin scaling. It is this skin erosion that causes the skin to grow white. However, long-term effects caused will cause the skin to become thin and bluish veins will appear that cannot be removed. The effects caused by the presence of steroids cannot be eliminated permanently even with laser action, so the mixing of steroids against cosmetics is very detrimental to consumers. Abstract

The aim of this research is to find out about the simple evidentiary regulations in Law Number 37 of 2004 concerning Bankruptcy and PKPU. In addition, to find out the formal evidence as well as the judge's legal considerations in the decision to postpone the payment of debt obligations that ended in bankruptcy at PT. Sarana Yeoman Sembada. This research uses normative legal research. The results of this study are that the simple evidence referred to in the determination of bankruptcy is also contained in the PKPU arrangement in Article 222 of the Bankruptcy Law and PKPU. In addition, the Bilyet Giro submitted in the PKPU application against PT. Sarana Yeoman Sembada is invalid as evidence because it does not meet the formal requirements of the Bilyet Giro and violates the provisions contained in the Bankruptcy Law and PKPU, so that the bankruptcy decision given by the Panel of Judges to PT. Sarana Yeoman Sembada was declared wrong because the application which was granted by the Panel of Judges came from an application submitted by the Petitioner who had no legal standing.

Abstract

Business actors at the Bungkul gas station 34.45232 located on Jalan Soekarno Hatta, Bojong Sari Village, Indramayu Regency, West Java have been proven to have committed fraud in filling fuel oil at the gas station which was found by the Directorate General of Consumer Protection and Orderly Commerce. permissible error limit. Business actors in this case cause harm to consumers, consumer rights and protection issues. The use of measuring instrument technology in the business world is needed in the hope of satisfying consumers but in reality it causes many problems. There is an additional tool at the fuel measuring pump in the form of an electronic circuit to commit fraud. This practice results in harm to people who are not aware that they have been cheated while refueling. Various modes are carried out by the SPBU officers, one of which is by manipulating the measuring instrument at the gas station so that it seems as if the fuel that is served by the consumer is in accordance with the price paid. Business actors violate consumer rights, especially the right to obtain measurements, measurements, scales, comfort and safety in using goods and/or services. Then the method used is the statutory approach, the conceptual approach. The results of this study indicate that the Bungkul gas station must be responsible for providing compensation or compensation in the form of a refund of the amount that has been harmed. Abstract

Company management based on Good Corporate Governance (GCG) principles is an effort to make GCG a rule and guideline for company managers in carrying out their business activities. Corporate governance is also an essential element of driving performance; many studies have proven that corporate governance affects the company’s performance. Implementing the principles of GCG in the management of the company is very important because it guides the company to make decisions appropriately and responsibly and the management of the company to be healthier, thereby increasing the company’s value. This study aimed to analyze corporate governance in Subsidiaries State owned subsidiaries that are incompatible with the core business by using normative juridical research methods, with the data source being secondary data obtained by library research. In secondary data used primary legal material in the form of statutory regulations, secondary legal material in the form of literature related to this research. Based on the research results, the concept of governance of Subsidiaries State owned subsidiaries that do not suit the core business, in general, has not been going well due to the establishment of a subsidiary to pursue profit. If the Good Corporate Governance mechanism does not function properly in the company, this can reduce the company’s value and lead to poor company performance and even loss. If the principles of Good Corporate Governance are appropriately implemented in subsidiaries that do not suit the core business.

Abstract

The purpose of this study is to determine how the legal protection and dispute resolution efforts of consumers who are harmed due to the presence of Bisphenol A (BPA) content in refillable gallon packaging. This research is motivated by BPOM's findings on the migration of Bisphenol A content in 6 (six) regions (Medan, Bandung, Manado, Jakarta, Banda Aceh and North Aceh) in an alarming condition and exceeds the threshold in Medan and North Aceh where the Bisphenol A threshold is 0.6 ppm. This research uses normative juridical by adjusting legal issues with applicable legal norms. The data in this research uses secondary data relevant to the research. The results of this study reveal that Bisphenol A can endanger human health such as emotional disorders in children, therefore the need for legal protection in the form of clear and honest information about Bisphenol A in the form of labels on refillable gallon packaging which aims to encourage businesses to be careful in the production process. Dispute resolution efforts for consumers who are harmed can be through the court and out of court.

Abstract

This article examines legal protection for consumers due to negligence in the process of funds transfer by BRI. The method used is the normative legal research. This study uses statue and conceptual approach. The legal materials used in this study are primary legal and secondary legal sources. The results obtained from the research. Form of protection law against consumers namely external protection. In this case the basis of consumer protection is listed in Law Number 8 of 1999, Law No.10 of 1998, Law Number 21 of 2011. Consumers who are harmed can claim legal responsibility to the business actors). This negligence case has also violated Law Number 10 of 1998 stating bank employees should apply the prudential banking principle.

Abstract

In the era of the Covid-19 Pandemic as a form of national disaster that must receive special attention, because the condition of the Covid-19 Pandemic greatly affects the health and economy of the community. The community's economy as a result of the Covid-19 pandemic, has an impact on finance companies where debtors have difficulty in paying debt obligations. The implementation of the responsibilities of financial institutions as institutions that collect public funds in carrying out their activities is regulated in the Financial Services Authority regulation Number 11/POJK.03/2020 concerning National Economic Stimulus as a Countercyclical Policy. Basically, by providing asset quality determination and concessions to debtors by means of credit restructuring is the best step. Thus, debtors whose credit is bad because of problems cannot pay off debts can be saved. The title of this article is the legal implications of non-performing loans in financing companies as a forum for collecting public funds which will later be channeled back to people who need funds. The purpose of this research is expected to increase knowledge of scientific works in the field of financing law, and is also expected to contribute ideas in terms of scientific development, especially in financing law.Keywords : Legal Implications, Non-Performing Loans, Financing Companies, Covid 19 Pandemic.

Abstract

Kosmetik menjadi kebutuhan utama bagi konsumen baik laki-laki maupun perempuan. Hal ini dijadikan peluang bisnis bagi pelaku usaha untuk berlomba-lomba memberikan inovasi sesuai dengan kebutuhan konsumen salah satunya yaitu kosmetik dengan sistem share in jar, namun pada kenyataannya kosmetik dengan sistem share in jar sangat berpotensi membahayakan keselamtan konsumen. Rumusan masalah dalam artikel ini Apa bentuk perlindungan hukum terhadap konsumen atas penggunaan produk kosmetik dengan sistem share in jar tanpa label pada kemasan dan Apa upaya penyelesaian yang dapat dilakukan oleh konsumen yang mengalami kerugian akibat penggunaan produk kosmetik dengan sistem share in jar tanpa label pada kemasan. Metode pendekatan yang digunakan yaitu yuridis normatif. Hasil studi menunjukan bahwa Pertama konsumen yang mengalami kerugian mendapatkan perlindungan eksternal sebagaimana yang telah diatur dalam Pasal 196 dan 197 Undang-Undang No. 36 Tahun 2009 tentang Kesehatan. Kedua, upaya penyelesaian yang dapat dilakukan oleh konsumen yang mengalami kerugian akibat penggunaan kosmetik share in jar tanpa label pada kemasan berdasarkan Pasal 45 UUPK dapat melalui 2 (dua) cara, yakni melalui jalur pengadilan (litigasi) dan jalur luar pengadilan (non litigasi).  Kata Kunci: Perlindungan Hukum, Konsumen, Share in jar  Cosmetics are a major need for both male and female consumers. This is used as a business opportunity for business actors to compete to provide innovation according to consumer needs, one of which is cosmetics with a share in jar sistem, but in reality cosmetics with a share in jar sistem have the potential to endanger consumer safety. The formulation of the problem in this article What is the form of legal protection for consumers for the use of cosmetic products with a share in jar sistem without a label on the packaging and what are the solutions that can be taken by consumers who experience losses due to the use of cosmetic products with a share in jar sistem without labels on the packaging. The approach method used is normative juridical. The results of the study show that firstly, consumers who experience losses receive external protection as regulated in Articles 196 and 197 of Law no. 36 of 2009 concerning Health. Second, the settlement efforts that can be made by consumers who experience losses due to the use of share in jar cosmetics without labels on packaging based on Article 45 of the UUPK can be in 2 (two) ways, namely through court (litigation) and out-of-court (non-litigation) channels.  Keywords: Legal Protection, Consumers, Share in jar REFERENCES Barkatullah, Abdul Halim.2020. Abstract

Penelitian ini bertujuan untuk menganalisis Perlindungan Hukum terhadap Konsumen atas Penelantaran Pendaki Gunung Rinjani oleh Tour Guide. Metode penelitian yang digunakan yaitu: tipe penelitian yuridis normatif, pendekatan perundang-undangan dan konseptual, bahan hukum primer, bahan hukum sekunder, dan non hukum, pengumpulan bahan hukum dengan studi kepustakaan, dan analisis bahan hukum. Hasil penelitian skripsi ini yaitu, pertama bentuk perlindungan hukum terhadap konsumen atas penelantaran pendaki pertama, Bentuk perlindungan hukum yang didapat konsumen atas penelantaran pendaki Gunung Rinjani oleh tour guide dibagi menjadi dua yakni perlindungan hukum internal dan perlindungan hukum eksternal. Kedua, Tanggung jawab tour guide sebagai pelaku usaha dalam Pasal 19 angka (1) UU No. 8 tahun 1999 tentang Perlindungan Konsumen menerangkan bahwa pelaku usaha bertanggungjawab memberikan ganti rugi. Ketiga, Upaya Penyelesaian sengketa apabila konsumen yang dirugikan oleh tour guide sebagai pelaku usaha yang telah menelantarkan para pendaki Gunung Rinjani yakni berdasarkan Undang-undang Perlindungan Konsumen pada Pasal 45 terdapat dua cara yaitu penyelesaian sengketa secara non litigasi dan secara litigasi.
