Penerapan hukum pidana terhadap prajurit militer yang melakukan tindak pidana umum masih menimbulkan perdebatan, terutama ketika hakim lebih memilih menggunakan KUHP daripada KUHPM yang secara normatif merupakan lex specialis. Penelitian ini bertujuan untuk menganalisis penerapan Pasal 363 KUHP terhadap prajurit aktif TNI AU dalam perkara pencurian, dengan fokus pada konsistensi sistem peradilan militer dan kepastian hukum. Metode yang digunakan adalah pendekatan yuridis normatif dengan teknik analisis kualitatif terhadap data sekunder berupa peraturan perundang-undangan, doktrin hukum, dan putusan pengadilan. Hasil penelitian menunjukkan bahwa putusan hakim yang menggunakan Pasal 363 KUHP serta menjatuhkan pidana bersyarat tidak sejalan dengan prinsip lex specialis dan menimbulkan ketimpangan antara fakta hukum dan sanksi yang dijatuhkan. Tindakan ini berpotensi melemahkan disiplin militer dan kredibilitas sistem peradilan militer itu sendiri. Implikasi dari temuan ini menunjukkan perlunya konsistensi dalam penerapan hukum militer serta penguatan pemahaman yudisial terhadap asas-asas hukum pidana khusus dalam kerangka negara hukum Indonesia.

Penerapan Surat Edaran Mahkamah Agung (SEMA) Nomor 1 Tahun 2017 yang membatasi penjatuhan pemecatan terhadap prajurit militer yang memasuki Masa Persiapan Pensiun (MPP), termasuk bagi pelaku tindak pidana berat seperti penyalahgunaan narkotika, telah menimbulkan kontroversi hukum yang signifikan. Penelitian ini bertujuan untuk menganalisis pertimbangan yudisial dalam putusan Pengadilan Militer I-02 Medan Nomor 50-K/PM.I-02/AD/IV/2022, khususnya terhadap tidak dijatuhkannya pidana tambahan berupa pemecatan terhadap prajurit aktif yang terbukti menyalahgunakan narkotika golongan I. Metode penelitian yang digunakan adalah yuridis normatif, dengan pendekatan kualitatif melalui studi dokumen dan analisis deskriptif-analitis terhadap peraturan perundang-undangan, yurisprudensi, dan doktrin hukum. Hasil penelitian menunjukkan bahwa meskipun SEMA bertujuan melindungi prajurit menjelang pensiun, implementasinya justru menciptakan ketimpangan hukum, menurunkan efek jera, serta berpotensi melemahkan integritas dan kedisiplinan militer. Introduction: Community service is one of the main punishments as a sub-system in the imposition of punishment in the sanction system in the Criminal Code. Currently, the sanction system in the Criminal Code and the crimes that occur are interesting to discuss and analyze.Purposes of the Research: Community service is one of the main punishments as a sub-system in the imposition of punishment in the sanction system in the Criminal Code. Currently, the sanctions in the Criminal Code and the crimes that occur are interesting to discuss and analyze. From this, the question is whether the imposition of community service can be applied to military crimes that occur in the Criminal Code, and how the future criminal policy will be for the renewal of military law.Methods of the Research: Normative legal approach method, namely by legal research conducted by examining library materials or secondary data periodically (in addition to the existence of sociological or empirical legal research which mainly examines primary data) by looking at the provisions of existing laws and regulations, through literature review.Results Main Findings of the Research: The legal basis for imposing Social Work sentences in Indonesia is regulated in National Law Number 1 of 2023 concerning the Criminal Code, Article 65, so it is necessary to reform criminal law, especially military criminal law because the purpose of punishment for the military is not only retribution but also guidance and prevention because if the perpetrator of the crime is a military person, it can have a very broad impact both for military interests and public interests.

Perbedaan paling mendasar antara tindak pidana umum dan tindak pidana medic terletak pada focus dari masing-masing tindak pidana. Pada tindak pidana umum, perhatian utama lebih kepada akibat yang ditimbulkan dari adanya tindak pidana tersebut, sedangkan pada tindak pidana medis fokus lebih diarahkan pada penyebab yang mendasari dari tindak pidana tersebut. Oleh karena itu, penting untuk mengidentifikasi berbgai faktor yang dapat menyebabkan terjadinya tindak pidana medik. Tindak pidana medis dapat disebabkan oleh berbagai faktor yaitu faktor medis, faktor teknis, faktor ekonomi, faktor social budaya, faktor pasien dan faktor sistem pelayanan kesehatan. Beragam faktor penyebab tindak pidana ini dapat berdampak terhadap kualitas layanan kesehatan dan berpotensi meningkatkan risiko terjadinya tindak pidana medis. Penelitian ini bertujuan untuk mengidentifikasi faktor-faktor penyebab terjadinya tindak pidana medis dalam praktik kedokteran di Indonesia dan memberikan rekomendasi untuk pencegahannya. Diharapkan hasil penelitian ini dapat memberikan kontribusi dalam peningkatan pelayanan kesehatan di Indonesia.

The enactment of Law Number 1 of 2023 concerning the new Indonesian Criminal Code (KUHP), which replaces the colonial-era Criminal Code, necessitates synchronization and reform of the Indonesian Military Criminal Code. This reform must be examined through the lens of sentencing theories that underpin the vision of the new KUHP. The research aims to identify whether military criminal law aligns with Law Number 1 of 2023, while analyzing and elaborating the required reforms of the military criminal sentencing system. This study employs normative legal research with a global approach as conceptualized by Mulyadi, enabling a clear and comprehensive assessment of sentencing aspects that require synchronization and reform. Findings reveal that the military criminal sentencing system must shift its orientation from retributive to restorative justice. Additionally, reforms are required in several areas, including the focus of sentencing objectives, sentencing guidelines, the scope of additional punishments, and their implementation. The reform of the military criminal code is expected to impact the overall military justice system in Indonesia. In conclusion, synchronization and reform of the sentencing system are necessary to ensure harmonization between lex specialis and lex generalis, thereby preventing overlaps in principles and systems.

Purpose: Pros and cons about the position and jurisdiction of military courts still often occur in legal discourse in Indonesia. On the one hand, there are groups that state that military courts are only authorized to try military crimes and are not authorized to try general crimes committed by TNI soldiers, but other groups state that military courts still have the authority to try both general and military crimes. This article will capture the discourse that has existed so far. This article will also explain about the Position and Jurisdiction of Military Courts in Indonesia after being under the authority of the Supreme Court and the impact of the submission of TNI soldiers to the General Court on military principles. Method: The method used is an in-depth interview with a number of sources, especially to see the opinions that develop if TNI soldiers are tried in the general court. Result: The conclusion of this article is that psychologically and culturally, TNI soldiers are not appropriate to be tried in general courts. Thus the issue of submission of TNI soldiers to the general court is not only juridical but also psychological and cultural. In addition, if TNI soldiers are subject to the general court, this will result in the destruction of the joints or principles of the military which are the backbone of law enforcement and discipline of Soldiers.

Purpose: This paper will discuss the position and function of the judicial power in Indonesia, as seen from its development since 1959, when Indonesia returned to the 1945 Constitution until 2008. Thus this paper will look at the entirety of the legislation governing the judicial power since the return to the 1945 Constitution through the Presidential Decree of July 5, 1959 and towards a one-stop judiciary under the Supreme Court. The study will primarily be directed at how to make the judiciary in Indonesia more independent and accountable. Method: Examine legal literature, policies, and case studies related to judicial independence and accountability. Results: Identify key issues affecting the independence and accountability of the judicial system.

Purpose: Reform of the military justice system (criminal law enforcement) is essentially part of the idea of law reform. Law reform not only includes "legal substance reform" and "legal structure reform", but also "legal culture reform". Therefore, the reform of the military criminal law system must also be accompanied by a renewal of military legal culture, which includes, among others, updating the cultural aspects of legal behavior and legal awareness related to "military culture" and updating the aspects of military legal education/science Methodology: Thus, "legal behavior, legal, science and legal education reform" is also needed. This paper will discuss Military Justice Reform in Indonesia, by conducting a comparative study with existing military justice systems in various countries. Results: This article concludes that the prospect of the position of military justice in Indonesia after the administrative, organizational and financial fields are in the Supreme Court will make military justice better and more independent. Its administration and organization will be better organized in line with other courts.

Purpose: Analyze the scope of jurisdiction and authority of military courts over cases involving military personnel and other related issues adan Assess how military courts interact with civilian courts and the implications for justice and military discipline. Method: Conduct interviews with legal experts, military personnel, and practitioners in the field of military justice to gather insights on the functioning and challenges of military courts. Result: A detailed explanation of how military courts are situated within Indonesia's judicial hierarchy, including their relationship with civilian courts and the constitutional basis for their existence. An outline of the specific types of cases military courts are authorized to handle, including criminal offenses committed by military personnel, disciplinary matters, and other related issues. Insights into how military courts operate in practice, including procedural aspects, the role of military judges, and the enforcement of military justice.
