Abstract

This study aims to analyze the legal consequences of the transition from Suspension of Debt Payment Obligations (PKPU) to bankruptcy on lease agreements, with particular emphasis on the legal position of tenants and lessors. Previous studies have generally examined bankruptcy or PKPU separately, leaving a research gap regarding the implications of the PKPU-to-bankruptcy transition for ongoing contractual relationships. The research method employed is normative juridical with statutory, conceptual, and case study approaches.The findings show that the transition from PKPU to bankruptcy creates legal uncertainty, particularly the loss of tenants’ rights despite fulfilling their obligations, and the vulnerable position of lessors whose property may be drawn into the bankruptcy estate. Article 36, paragraph (1) of Law No. 37 of 2004 provides the legal basis for lessors to demand the return of leased property from the bankruptcy estate; however, in practice, this right often collides with the interests of other creditors. The analysis using Philipus M. Hadjon’s theory of legal protection demonstrates the weakness of preventive instruments for bona fide parties, while Gustav Radbruch’s theory of justice emphasizes the need for a balance between legal certainty, justice, and expediency in insolvency dispute settlement. Therefore, this study underlines the importance of regulatory reform to ensure a balance between preventive and repressive legal protection, and recommends that post-bankruptcy lease obligations be classified as bankruptcy estate debts, with reasonable termination rights granted to either the curator or the lessor.   Penelitian ini bertujuan untuk menganalisis akibat hukum transisi dari Penundaan Kewajiban Pembayaran Utang (PKPU) ke pailit terhadap perjanjian sewa-menyewa, dengan menekankan posisi hukum penyewa dan pemilik barang sewa. Penelitian terdahulu umumnya hanya membahas pailit atau PKPU secara terpisah, sehingga terdapat kekosongan kajian terkait implikasi transisi PKPU ke pailit bagi keberlangsungan perjanjian yang sedang berjalan. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konseptual, serta studi kasus. Hasil penelitian menunjukkan bahwa transisi PKPU ke pailit menimbulkan ketidakpastian hukum, khususnya hilangnya hak penyewa meskipun telah memenuhi kewajibannya, serta posisi rentan pemilik barang sewa karena objeknya dapat ditarik ke dalam boedel pailit. Pasal 36 ayat (1) UU No. 37 Tahun 2004 memberi dasar hukum bagi pemilik barang untuk menuntut pengembalian objek sewa dari boedel pailit, namun dalam praktiknya sering terjadi benturan dengan kepentingan kreditur lain. Analisis dengan teori perlindungan hukum Philipus M. Hadjon menunjukkan lemahnya instrumen preventif bagi pihak beritikad baik, sedangkan teori keadilan Gustav Radbruch menegaskan perlunya keseimbangan antara kepastian hukum, keadilan, dan kemanfaatan dalam penyelesaian sengketa kepailitan. Dengan demikian, penelitian ini menekankan pentingnya reformulasi regulasi agar perlindungan hukum preventif dan represif dapat berjalan seimbang, serta merekomendasikan agar kewajiban sewa pasca-putusan pailit dikualifikasi sebagai utang boedel dengan hak pengakhiran perjanjian secara wajar oleh kurator atau pemilik barang sewa.

Abstract

Rapid advancements in science and technology, propelled by globalization, have fundamentally reshaped life, facilitating cross-border information dissemination and electronic transactions. This transformation presents significant challenges for civil law, particularly in the realm of digital asset inheritance. This article analyzes how Indonesian civil law, based on principles found in the KUHPerdat), navigates the complexities of abstract digital assets, their volatile economic value, and platform terms that limit heir access. Employing a descriptive-analytical normative juridical research method with a literature review, this study identifies existing legal gaps and issues stemming from the absence of specific regulations for digital assets as inheritance objects. While digital assets can be categorized as intangible movable property inheritable under civil law, their application in customary inheritance law requires further exploration of local wisdom. As solutions, this research recommends comprehensive legal regulatory updates for digital assets, increased public digital literacy regarding inheritance planning, and robust collaboration among the government, legal institutions, and digital service providers. These steps are crucial to protecting heirs' rights, ensuring legal certainty, and preventing the loss or misuse of digital assets in an increasingly digitized era. Abstract

This study examines the performance of Satpol PP officers in enforcing public order, with a particular focus on work discipline and ethical behavior as fundamental aspects of public service accountability. Despite a clear legal mandate given to Satpol PP, challenges remain in ensuring that law enforcement practices are carried out in accordance with ethical standards and professional norms. This study aims to analyze how the legal framework and organizational factors influence the actual implementation of public order enforcement by Satpol PP officers. This study uses a normative-juridical approach combined with empirical qualitative methods. The normative analysis was conducted by examining laws and regulations, codes of ethics, and standard operating procedures that govern the authority and duties of Satpol PP. Empirical data were collected through in-depth interviews, field observations, and document analysis involving Satpol PP officers and relevant stakeholders at the local government level. The collected data were analyzed using thematic analysis to identify patterns and discrepancies between legal norms and field practices. The findings indicate that the gap between normative regulations and empirical implementation is influenced by factors such as leadership practices, organizational culture, legal understanding, and internal oversight mechanisms. These factors significantly influence the consistency of discipline and ethical behavior in enforcing public order. This study makes a practical contribution by offering recommendations for strengthening legal compliance, ethical governance, and performance evaluation mechanisms within the Public Order Agency (Satpol PP). Theoretically, this research enriches empirical legal studies by integrating normative analysis with field-based evidence in the context of public order enforcement.
