Abstract

This research analyses the legal validity and limitations of non-competition clauses in employment contracts under Indonesian law, focusing on their position between business protection and workers’ constitutional rights. In Indonesian legal doctrine, employment relationships are based on elements of work, wages, and subordination as regulated in Law Number 13 of 2003 concerning Manpower. From a civil law perspective, non-competition clauses fall within contractual obligations under Indonesian Civil Code, particularly Article 1234 concerning the obligation “not to do something” and Article 1320 on the validity requirements of agreements. Using normative legal research with conceptual and comparative approaches, this study analyses statute regulations, legal doctrines, and comparative practices in Singapore, Malaysia, and the United States. The findings indicate that non-competition clauses are legally permissible in Indonesia provided they fulfil subjective and objective contractual requirements, including consent, capacity, specific object, and lawful cause. However, contractual freedom is limited by constitutional guarantees, particularly Article 27 paragraph (2) of the 1945 Constitution of the Republic of Indonesia, which protects the right to work and earn a decent living. Comparatively, Singapore applies proportionality and legitimate interest tests, Malaysia generally voids post-employment non-compete clauses; and the United States adopts a state-based reasonableness This research analyses the legal validity and limitations of non-competition clauses in employment contracts under Indonesian law, focusing on their position between business protection and workers’ constitutional rights. The study concludes that non-competition clauses may function as legitimate business protection instruments only if drafted proportionally, with clear limitations on duration, territory, and scope, while respecting workers’ fundamental rights.

Abstract

Penelitian ini bertujuan untuk menganalisis secara komprehensif regulasi poligami di Indonesia dan memberikan gambaran utuh mengenai (1) pengaturan hukum poligami di Indonesia serta (2) analisis yuridis terhadap Putusan Nomor 0206/Pdt.G/2015/PA.Pct. Penelitian ini mengadopsi jenis penelitian yuridis normatif, dengan menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Hasil penelitian menunjukkan bahwa: (1) Poligami di Indonesia diatur secara ekstensif dalam Hukum Positif dan Hukum Islam, mencakup Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan, Peraturan Pemerintah Nomor 9 Tahun 1975 tentang Pelaksanaan Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan, Kompilasi Hukum Islam, dan Undang-Undang Nomor 50 Tahun 2009 tentang Perubahan Kedua atas Undang-Undang Nomor 7 Tahun 1989. (2) Analisis terhadap Putusan Nomor 0206/Pdt.G/2015/PA.Pct. tentang Izin Poligami mengungkapkan bahwa putusan tersebut telah memenuhi ketentuan perundang-undangan yang mengatur poligami di Indonesia. Ini dibuktikan oleh pertimbangan hakim yang menyatakan pemohon telah memenuhi syarat alternatif dan kumulatif sebagaimana dijelaskan dalam Pasal 4 Ayat 2 dan Pasal 5 Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan serta Kompilasi Hukum Islam. Selain itu, proses pelaksanaan pemberian izin poligami juga selaras dengan Pasal 40 dan Pasal 44 Peraturan Pemerintah Nomor 9 Tahun 1975 tentang Pelaksanaan Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan.

Abstract

Perkembangan transaksi e-commerce di Indonesia menimbulkan konsekuensi hukum terhadap keberlakuan dan daya ikat perjanjian elektronik (e-contract) dalam sistem hukum perdata. Penelitian ini bertujuan menganalisis kekuatan mengikat perjanjian elektronik dalam perspektif asas pacta sunt servanda serta konsekuensi hukum wanprestasi penjual dalam transaksi digital. Metode yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundang-undangan dan konseptual, melalui telaah terhadap Kitab Undang-Undang Hukum Perdata, Undang-Undang Informasi dan Transaksi Elektronik beserta perubahannya, Undang-Undang Perlindungan Konsumen, serta peraturan pelaksana terkait perdagangan melalui sistem elektronik. Hasil penelitian menunjukkan bahwa perjanjian elektronik memiliki kekuatan hukum yang sah dan setara dengan perjanjian konvensional sepanjang memenuhi syarat sah perjanjian sebagaimana diatur dalam Pasal 1320 KUHPerdata. Asas pacta sunt servanda tetap berlaku dalam transaksi digital, namun penerapannya harus diharmonisasikan dengan prinsip perlindungan konsumen dan itikad baik. Dalam hal terjadi wanprestasi penjual, konsumen berhak menuntut pemenuhan prestasi, pembatalan perjanjian, maupun ganti rugi sesuai ketentuan KUHPerdata dan Undang-Undang Perlindungan Konsumen. Kajian ini menegaskan pentingnya kepastian hukum dan keseimbangan para pihak dalam praktik e-commerce.
