Abstract

The issue of female instrumentary witnesses in notarial deeds is significant due to differing perspectives between Indonesian positive law and Islamic law. The Notary Office Act (UUJN) does not differentiate witnesses based on gender, as long as they are adults, legally competent, and independent. In contrast, some classical Islamic views consider women’s testimony in muamalah matters to be worth half that of men, as stated in Surah Al-Baqarah verse 282. This raises questions regarding the validity of notarial deeds involving female instrumentary witnesses. This study employs a normative juridical method with a conceptual approach through library research, including UUJN, the Qur’an, classical exegesis, and academic literature. The analysis is qualitative with deductive reasoning, comparing positive legal norms and Islamic law, while also interpreting their relevance through the principle of maqashid al-shari‘ah. The findings show that under Indonesian positive law, a notarial deed remains valid even with female witnesses, since the key requirement lies in legal competence rather than gender. Meanwhile, classical Islamic law restricts women’s testimony, but contemporary interpretations grounded in maqashid al-shari‘ah emphasize justice and equality, thereby granting women equal standing in giving testimony. In conclusion, the use of female instrumentary witnesses in notarial deeds does not contradict Indonesian positive law or contemporary Islamic legal principles. This study highlights the importance of harmonizing national law and Islamic law so that Indonesia’s legal system can be more responsive to justice and gender equality values.

Abstract

This study revisits the complex imperial identity of Ottoman Sultan Mehmed II (Muhammad al-Fatih), to challenge the conventional portrayal of his reign as exclusively Islamic. While modern Muslim communities in Indonesia and Turkiye celebrate him as an ideal Islamic hero, a closer reading of historical sources reveals a ruler whose legitimacy emerged from a deliberate synthesis of Islamic, Byzantine, and Persian traditions—an identity best described as Islamicate. Through a critical examination of Tursun Beg’s Tarih-i Ebü’l-Feth, this study demonstrates how Intellectuals strategically wove together sacred, political and aesthetic symbols to construct Mehmed II’s authority as a universal ruler rather than a merely Muslim conqueror. By unsettling the binary of Islamic versus Christian civilizations, this study situates Mehmet II within a broader, polycentric Islamicate world and highlights the continuing relevance of his hybrid legitimacy for rethinking pluralism and political identity in contemporary Muslim societies.

Abstract

ABSTRACT Economic education has a strategic role in strengthening the integration of the Green-Blue Economy (GBE), Digital Economy (ED), and Creative Economy (CE) sectors as pillars of sustainable development in Indonesia. This research aims to analyze the structural barriers in the trisectoral integration and formulate a relevant transformative education model. Using the Systematic Literature Review (SLR) method based on the PRISMA protocol, 68 selected documents (2018-2024) were thematically analyzed using the Braun & Clarke approach. The results showed three main findings: (1) significant cross-sector competency gaps, (2) low adoption of integrative curricula in higher and vocational education, and (3) evidence of the effectiveness of project-based education approaches in improving HR competitiveness. The "Pentagon Education" conceptual model is proposed as an innovative framework based on five elements: trisectoral curriculum, experiential pedagogy, penta-helix collaboration, digital infrastructure, and impact evaluation. The model is proven to boost the growth of the green-digital-creative sector 2.3 times faster in regions that have implemented it. These findings provide an important basis for education policy reform and sustainable human capital planning in Indonesia. ABSTRAK Pendidikan ekonomi memiliki peran strategis dalam memperkuat integrasi sektor Green-Blue Economy (GBE), Ekonomi Digital (ED), dan Ekonomi Kreatif (EK) sebagai pilar pembangunan berkelanjutan di Indonesia. Penelitian ini bertujuan menganalisis hambatan struktural dalam integrasi trisektoral tersebut dan merumuskan model pendidikan transformatif yang relevan. Menggunakan metode Systematic Literature Review (SLR) berdasarkan protokol PRISMA, sebanyak 68 dokumen terpilih (2018–2024) dianalisis secara tematik menggunakan pendekatan Braun & Clarke. Hasil menunjukkan tiga temuan utama: (1) kesenjangan kompetensi lintas sektor yang signifikan, (2) rendahnya adopsi kurikulum integratif di pendidikan tinggi dan vokasi, serta (3) bukti efektivitas pendekatan pendidikan berbasis proyek dalam meningkatkan daya saing SDM. Model konseptual “Pentagon Education” diusulkan sebagai kerangka inovatif berbasis lima elemen: kurikulum trisektoral, pedagogi experiential, kolaborasi penta-helix, infrastruktur digital, dan evaluasi berdampak. Model ini terbukti mendorong pertumbuhan sektor hijau-digital-kreatif 2,3 kali lebih cepat di wilayah yang telah mengimplementasikannya. Temuan ini menjadi dasar penting bagi reformasi kebijakan pendidikan dan perencanaan SDM berkelanjutan di Indonesia.
