Abstract

Indonesia memiliki keragaman budaya dengan adat istiadat unik di setiap daerah yang mencerminkan identitas khas. Prinsip "hukum untuk manusia, bukan manusia untuk hukum" menegaskan bahwa hukum harus menyesuaikan perkembangan masyarakat. Hukum adat sering dianggap statis, seperti hukum adat Batak Toba yang menganut sistem kekerabatan patrilineal. Sistem ini mengutamakan anak laki-laki sebagai ahli waris, mencerminkan struktur patriarkal di mana laki-laki memegang peran dominan dalam keluarga dan masyarakat. Penelitian ini mengkaji peran Boru Batak dalam hukum adat Batak Toba, khususnya terkait hak waris. Tujuannya adalah menunjukkan pengakuan yang semakin meningkat terhadap perempuan dalam sistem ini, menciptakan keadilan dan kesetaraan yang lebih baik. Pendekatan yang digunakan adalah sosiologis-yuridis dengan data primer dari wawancara, diskusi, dan kuesioner, serta data sekunder dari peraturan perundang-undangan, buku, jurnal, dan sumber referensi lainnya. Analisis data dilakukan secara kualitatif dengan metode deduktif. Hasil penelitian menunjukkan bahwa meskipun hukum adat Batak Toba masih sering dianggap tidak adil terhadap Boru Batak, ada perkembangan dalam pengakuan hak waris perempuan. Studi ini menekankan perlunya penelitian lanjutan untuk memperkuat kedudukan hukum perempuan dalam sistem adat Batak Toba.

Abstract

The rapid development of information and communication technology in Indonesia's business sector has made the existing business sector increasingly complex and competitive. The application of strong ethics is very important to maintain integrity and trust among business actors, considering that the challenges faced by business actors are also based on Islamic principles. The perspective of Muhammadiyah values, which are based on Islamic teachings that prioritize justice and ethics, has an important point in making a significant contribution to overcoming the challenges that exist in business ethics today. This study aims to identify and analyze the principles of business law ethics from the perspective of Muhammadiyah values, exploring the challenges faced in the application of business ethics from the perspective of Muhammadiyah values in the modern era. This research uses a literature study research method, which is a series of activities related to collecting library data, reading and recording, and managing research materials. The context of this research is important to examine in order to strengthen the position of business ethics from the Muhammadiyah perspective.
