Abstract

Land is something that is very important for human life. From the land humans come from, on the land humans live and into the land humans will return. Ownership, control, use and utilization of land need to be regulated in such a way in national agrarian law. In particular, land rights also need to be regulated in the agrarian law. In this context, the teachings and laws in Islam as the largest religion in Indonesia also influence the conception and policies regarding land rights. In this case, the teachings contained in the verses of the Quran and the hadith of the Prophet Muhammad SAW as a source of Islamic law become the theological and philosophical basis of the substance of land rights regulated in the constitution and other laws and regulations in Indonesia.

Abstract

Penelitian ini menilai efektivitas kegiatan penyuluhan pendidikan inklusif mengenai kesadaran hak asasi manusia (HAM) pada anggota OSIS SMP Negeri 1 Nagreg. Intervensi yang dilaksanakan pada 7 November 2025 ini menggabungkan tes pre-post melalui Quizziz (n = 29), pemberian materi interaktif, serta Forum Group Discussion (FGD) dengan mitra lokal Senyum Anak Nusantara (SAN). Dengan desain single-group pretest-posttest, peserta mengerjakan 10 soal Quizziz sebelum dan sesudah sesi pemberian materi, FGD digunakan untuk menangkap pemahaman kontekstual dan respons praktis terhadap kasus perundungan. Hasil menunjukkan peningkatan pengetahuan yang signifikan dengan total jawaban benar meningkat dari 145/290 (50%) pada pre-test menjadi 276/290 (95%) pada post-tes. Sebagian besar butir mengalami peningkatan yang signifikan, meskipun pada dua butir yang berkaitan dengan aspek psikologis (butir 8-9) masih menunjukkan kurangnya pemahaman. Temuan ini menunjukkan bahwa penyuluhan tersebut efektif meningkatkan pengetahuan teknis dan kesadaran situasional, sekaligus menyoroti perlunya tindak lanjut yang berfokus pada pengenalan psikologis dan respons empatik. Rekomendasi praktis mencakup modul role-play singkat, bagan alur pelaporan satu halaman, struktur dukungan teman sebaya, serta integrasi materi HAM ke dalam pembelajaran PPKn.

Abstract

Environmental pollution and degradation remain serious issues in Indonesia, causing significant impacts on ecosystems and the social life of communities. One of the fundamental principles in environmental law aimed at ensuring ecological restoration is the Polluter Pays Principle (PPP), which obliges polluters to bear all costs arising from environmental pollution or damage caused by their activities. This study aims to analyze the effectiveness of enforcing the Polluter Pays Principle as a mechanism for ecological restoration in resolving environmental disputes in Indonesia. The research employs a normative legal research method using statutory and conceptual approaches. The findings indicate that although the Polluter Pays Principle has been normatively adopted in Law Number 32 of 2009 on Environmental Protection and Management, its implementation in practice remains suboptimal. Major obstacles include weak law enforcement, power imbalances between business actors and affected communities, lack of transparency in the use of compensation funds, and limited public participation in environmental restoration processes. Therefore, strengthening regulatory frameworks, enhancing the capacity of law enforcement institutions, and adopting a restorative justice approach are necessary to ensure that the Polluter Pays Principle functions effectively in achieving ecological restoration and environmental justice in Indonesia.
