Abstract

Abstract: This research reveals that the settlement of criminal cases in Indonesia is at present constructed through criminal justice system organized by the government. The system places abuse of criminal law as an abuse of state concerns, not as a violation to individuals. The formulation and meaning of criminal acts are not viewed as acts of personally and concretely violating the victim’s law concern, but they are seen as the abuse of state norms. Meanwhile, from the model of criminal case settlement in Islamic criminal law, it is found that the arrangement differs from the Indonesian current state of the art. The flow of formal Islamic criminal law provides an opportunity for the victim to prosecute, even to determine the compensation amount. Academically, the formulation of Islamic criminal law possesses a potential of being a reforming model for the setllement of criminal cases in Indonesia.

Abstract

This study aims to analyze the performance of the publihed research results by professors in three State Islamic Universities (UINs). By using the descriptive–qualitative analysis and quantitative data reading, this study analyzes research outputs of lecturers with a full professorship in the State Islamic Universities from January to October 2019. The research finds that most of the professor’s research results were not published whether in the forms of books or scientific journal articles. 60% of the professors have a lack of understanding of the open journal system, which causes a low level of publication among them. One program that is very effective in helping them to increase the productivity of the publications is a program of publication assistance.  The well-versed information technology assistants help the professors to get familiar with the information technology. This study adds to the existing literature regarding the research performance of university professors, especially in understanding what factors that hinder the publication performance of State Islamic University professors in Indonesia.

Abstract

Sunda Wiwitan as a religion had existed prior to the other, more well known religions in Indonesia, but is currently isn’t recognized as an official religion by Act No.1/PNPS/1965. The state, as opposed to guaranteeing the freedom of belief and its practice, instead imposes restrictions on religion in this particular case, leaving the believers of Sunda Wiwitan feeling abandoned and as outcasts. As a result, many violations and discriminations are experienced by adherents of Sunda Wiwitan. One example of such discrimination is the “whiting-out” of the “religion” column in ID Cards. The result of this discrimination is difficulty in accessing civil documents, in addition to verbal violence from certain parts of the society who assume the Sunda Wiwitan belief as heretic.

Abstract

Abstract: The practice of marital rape or known as marital rape is a discussion that is often considered a contradictio in terminis which is interpreted as a combination of contradictory words, because currently rape is limited outside marriage. Rape in marriage is a form of inequality in gender justice, the assumption is that men/husbands have an autonomous right to force their wives to have sex, while women/wives are legitimized by construction to devote themselves to accepting whatever is done in marriage. This should not be in line with what has been regulated in the Marriage Law, which basically states that the purpose of marriage is to form a happy and eternal family (household) based on the One Godhead. Marital rape can be defined as coercion of sexual activity by one party without regard to the other party. The purpose of this study is to explain the basis for regulating marital rape in positive law in Indonesia and Islamic law. The research method used is juridical-normative, namely research by analyzing the provisions of laws and regulations relating to marital rape by connecting the basic arrangements in Islamic law. The results of this study indicate that domestic rape or known as marital rape is part of sexual violence in the household as regulated in the PKDRT Law. Meanwhile, in Islam the essence of marriage is interpreted as mistaqan ghalidzan or a sacred and strong bond, then the practice of forced sexual intercourse is considered an inequality of rights and obligations of sexual relations in marriage. Islam teaches the principle of mu'asyarah bil ma'ruf, namely a good and voluntary relationship. in having sexual relations by not monopolizing sexuality in the name of religion because it is clearly against the Shari'a.Absktrak: Marital rape menjadi pembahasan yang sering dianggap sebagai suatu contradictio in terminis, karena pengaturan hukum tentang pemerkosaan masih terbatas di luar perkawinan.
