Abstract

Hadith as a source of Islamic teachings is permitted to apply in responding contemporary issues such as sexual violence in which women are generally victimized. Cultural and social values or religious understandings often put women in the secondary position including being witness. Female witness should be two people compared to their male counterparts which are one. There is no room for them to have equal number with men, but hadith is clearly stated that women can be a primary witness which was initially occurred in the breastfeeding case. It is, therefore, the significant question is that why this hadith cannot be applied in sexual violence against women due to the facts that these are serious problems both in the global world and Indonesia. This research is qualitative using textual, intertexts and even contextual analysis in understanding the hadith and connecting to social and cultural context of sexual violence against women. The research shows that although there are clear qur’anic messages with respect to men and women of being witness (Q.S. Al-Baqarah: 282), woman can become a primary witness based on this hadith. The inclusive hadith is not contradictory with the qur’anic message because the conditions are different.

Abstract

This research discusses ethical and legal dilemmas related to euthanasia in the perspective of Islamic law, especially regarding inheritance rights for passive euthanasia applicants. This research uses a normative juridical method with a conceptual approach to explore how Islamic law regulates inheritance rights in cases of passive euthanasia carried out on the basis of compassion. Euthanasia, both active and passive, remains a controversial issue. Legally in Indonesia, euthanasia is very close to Article 344 on murder as well as Article 304 of the Criminal Code and Article 173 of KHI on the causes of the loss of inheritance rights, but even so the implementation and interpretation are still debatable. From an Islamic perspective, murder can prevent inheritance rights, but there are differences of opinion among scholars regarding the type of murder in question. The results of this study show that the legal illat from the hadith and Islamic legal literature to conclude that the act of passive euthanasia, if done with good intentions and not aimed at accelerating the acquisition of inheritance, does not hinder inheritance rights.

Abstract

Cases of employment termination that disregard workers' statutory rights remain a recurring problem in Indonesia's industrial relations landscape. This study examines one such case — Court Decision No. 29/Pdt.Sus-PHI/2023/PN Mks — in which a worker was dismissed unilaterally without receiving legally mandated severance and compensation. Using a normative juridical approach with conceptual and statutory analysis, this study draws on court documents and relevant legal literature to investigate how both Islamic muamalah jurisprudence and Indonesian labor law address wrongful termination. The findings show that Indonesian labor law, particularly Law No. 13 of 2003 and its amendment under Government Regulation in Lieu of Law No. 2 of 2022, explicitly requires severance pay and procedural fairness in any termination process. From the perspective of fiqh muamalah, unilateral dismissal without prior deliberation and without fulfillment of the worker's rights contradicts the foundational principles of ijarah — a contractual relationship that demands mutual consent and equitable treatment between employer and employee. The case under study reveals a clear violation of both legal frameworks, compounded by weak enforcement mechanisms. This study argues that stronger integration between Islamic legal values and national labor regulation, alongside consistent judicial and administrative enforcement, is essential to building a more just employment protection system in Indonesia.

Abstract

This study aims to examine the legal reasoning of judges at the Bengkayang Religious Court in granting petitions for the marriage dispensation of minors. Marriage dispensation is a concession granted by the court to prospective spouses who have not reached the minimum marriageable age of 19 years, as regulated under Law Number 16 of 2019. In deciding a marriage dispensation petition, judges do not rely solely on juridical aspects but are also obliged to consider the facts established through evidence as well as the needs of the petitioners, with the prevention of harm as the primary consideration. This study employs an empirical juridical method with a qualitative approach. The data sources consist of primary data in the form of interviews with judges and the Bengkayang Religious Court Decree Number 5/Pdt.P/2026/PA.Bky, as well as secondary data in the form of legislation, books, and legal journals. The findings show that, in deciding petitions for the marriage dispensation of minors, the Bengkayang Religious Court relies on the prevailing legal foundations and applies specific considerations adapted to the facts and conditions of the petitioners, so that decisions—whether granted or rejected—aim to eliminate harm to the parties. This study also highlights the norms governing marriage dispensation within the family law system in Indonesia and assesses the consistency of their application from the filing of the petition to the judge's decision.

Abstract

Perkembangan teknologi informasi dan komunikasi memiliki dampak yang besar terhadap kehidupan sosial. Salah satu dampaknya adalah munculnya fenomena baru yang disebut Kekerasan Berbasis Gender Daring (KBGO). KBGO merupakan bentuk kekerasan digital yang melibatkan penggunaan media digital untuk melecehkan, mengancam, atau membagikan konten pribadi tanpa persetujuan. Penelitian ini bertujuan untuk menganalisis bentuk-bentuk, dampak, serta upaya perlindungan hukum bagi korban KBGO di Indonesia. Metode yang digunakan adalah tinjauan pustaka, dengan menelaah berbagai sumber seperti jurnal ilmiah, laporan kelembagaan, serta undang-undang dan peraturan yang relevan. Hasil penelitian menunjukkan bahwa bentuk-bentuk KBGO meliputi pelecehan daring, penyebaran konten intim tanpa izin, peretasan akun, dan pelanggaran privasi individu. Dampaknya bersifat multidimensi, termasuk gangguan mental, tekanan sosial, dan pelanggaran hak asasi manusia. Perlindungan korban diatur secara hukum dalam Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual (TPKS), namun masih terdapat hambatan dalam pelaksanaannya, terutama dalam aspek penegakan hukum dan rendahnya literasi digital masyarakat. Penelitian ini menekankan pentingnya memperkuat kebijakan, meningkatkan literasi digital masyarakat, serta memperkuat kolaborasi antarlembaga untuk menciptakan ruang digital yang aman dan bebas dari kekerasan berbasis gender.

Abstract

The increasing need for a sharia-compliant pre-marital acquaintance model amid widespread free association and high divorce rates has positioned taaruf as a relevant alternative for preparing prospective couples. This study aims to describe the concept of pre-marital taaruf applied at Yayasan Amal Jariyah Indonesia (YAJI) in South Sulawesi, to analyze its implications for forming a harmonious family, and to identify its supporting and inhibiting factors. This research employed a qualitative approach with an intrinsic case-study design; data were collected through in-depth interviews, observation, and documentation involving foundation administrators, taaruf mentors, and program alumni, and were analyzed through data reduction, data display, and conclusion drawing with source triangulation. The results show that taaruf at YAJI is implemented through structured stages, namely biodata submission, kafaah-based matching, istikharah, gradual biodata exchange, nazhar, khitbah, and marriage, under mediator guidance and family involvement while maintaining sharia principles. Taaruf positively contributes to family harmony through information openness, shared religious values, character understanding, effective communication, and continuous post-marital mentoring, indicated by the absence of divorce among alumni couples. The main supporting factors include shared vision, openness, family support, mediator guidance, and sustainable mentoring, whereas the inhibiting factors involve socio-cultural considerations of kafaah (ethnicity and family background) and the limited number of marriage-ready male participants. This study concludes that institutionally managed taaruf constitutes a sharia-based pre-marital mentoring model that constructively shapes harmonious families through the integration of Islamic values, institutional guidance, and family support.
