Abstract

This paper examines the considerations of Supreme Court (MA) judges in reducing sentences for defendants of corruption crimes in Indonesia. The problem in this paper is what are the considerations of Supreme Court judges in reducing sentences for defendants of corruption crimes juridically. This research uses a juridical method by analyzing relevant theories, concepts, and laws and regulations. The results show that the judge's consideration is based on the good character of the defendant, the social impact, and the facts of the trial, referring to Law Number 48 of 2009 and Law Number 8 of 1981. Edhy Prabowo's case shows that the sentence reduction does not reflect public justice, on the contrary, Idrus Marham's case shows weakness due to the sentence reduction received.

Abstract

The social conflict that occurred in Negeri Masihulan, Central Maluku Regency, in April 2025, resulted in dozens of residents' houses burning down and had serious psychological impacts, especially for children. Children as a vulnerable group experience fear, anxiety, and trauma due to conflict and displacement situations. This community service aims to provide psychosocial assistance through trauma healing as an effort for non-litigation legal protection for child victims of social conflict. This activity was carried out using the approach of playing, drawing, telling stories, and praying together, attended by 30 children aged 5-13 years. The results of the activity showed positive changes in the emotional condition of children, a growing sense of security, and an increased spirit of togetherness after the conflict. Trauma healing has proven to be an effective instrument in psychological recovery as well as a form of implementation of community-based legal protection. It is hoped that this activity will become a model in handling child victims of conflict in areas prone to social conflict in Maluku.

Abstract

Di waktu lampau kedokteran seakan tidak terjangkau oleh hukum, namun dengan meningkatnya kesadaran masyarakat akan perlunya perlindungan hukum, dunia kedokteran tidak hanya bersifat perdata, tetapi seringkali berkembang menjadi perkara pidana. Hingga berbagai kasus yang melibatkan pasien dan dokter dalam ranah hukum kemudian menimbulkan masalah karena sangat sulit membedakan mana yang malpraktek dan mana yang kelalaian, kecelakaan, atau kegagalan. Hingga saat ini, Indonesia belum memiliki standar profesi kedokteran yang secara jelas mendefinisikan malpraktek. Hal ini dapat merugikan profesi medis dan masyarakat karena tenaga medis rentan dikriminalisasi akibat aturan yang tidak jelas dan di sisi lain dapat digunakan sebagai alat untuk membela diri atas tindakan medis yang dilakukan, terutama jika praktik medis merugikan pasien. Tulisan tentang tinjauan yuridis tindak pidana medis Indonesia ini bertujuan untuk menganalisis pentingnya perlindungan medis-hukum sebagai jaminan profesi serta perlindungan atas hak azasi manusia.

Abstract

Collective violence remains a significant social issue in Ambon City, particularly over the past two years. The increasing intensity and spread of group violence incidents underscore the importance of spatial, temporal, and social analysis in understanding the emerging patterns. This study aims to identify the distribution patterns of locus delicti, temporal trends, and the underlying social motives behind collective violence in Ambon during 2023–2024. This research employed a descriptive qualitative method with data collected through field observations, informal interviews with community members and security personnel, as well as documentation from police reports and local media. The results indicate that collective violence incidents were concentrated in densely populated urban areas, public facilities, and nightlife zones. By 2024, the locus of violence began shifting to suburban and symbolic locations such as Merdeka Square. Temporally, most incidents occurred at night until early morning, coinciding with weakened social control. Contributing criminogenic factors include weak community social control, subcultural violence within village-based youth groups, neglected environments, and the contagion effect of crowds in public spaces. This study concludes that collective violence in Ambon City is driven not only by situational and individual factors but also by environmental conditions, crime opportunities, and collective norms that legitimize violent behavior. This study recommends intensifying nighttime patrols, initiating inter-community youth dialogues, and fostering community-based early warning systems to prevent the escalation of group violence in the future.

Abstract

This study aims to analyze the implementation of restitution rights for child victims of sexual violence and to identify obstacles and solutions from a victimological perspective. Although Law Number 12 of 2022 concerning Sexual Violence Crimes (UU TPKS) has provided normative reinforcement, the fulfillment of restitution rights in practice still faces significant obstacles. The research method used is normative legal research with a statutory and conceptual approach. The results indicate that the implementation of restitution is still far from ideal due to three main obstacles: normative obstacles related to the complexity of administrative procedures, structural obstacles in the form of law enforcement officials' lack of sensitivity in calculating losses, and substantial obstacles triggered by the perpetrator's financial inability. From a victimological perspective, the failure to execute restitution is a form of secondary victimization by the state. As a solution, this study recommends optimizing the role of the LPSK, activating the Victim Trust Fund mechanism as state compensation for indigent perpetrators, and implementing the seizure of the perpetrator's assets starting from the investigation stage to ensure the certainty of restoring the victim's rights Keywords: restitution, child sexual violence, victimology, victim recovery, UU TPKS

Abstract

Penelitian ini menganalisis implikasi yuridis dari pengesahan Undang-Undang Nomor 3 Tahun 2025 tentang Perubahan atas Undang-Undang Nomor 34 Tahun 2004 tentang Tentara Nasional Indonesia (TNI), khususnya terkait perluasan jabatan sipil yang dapat diduduki oleh prajurit aktif. Permasalahan utama yang dikaji adalah potensi terjadinya kemunduran demokrasi akibat melemahnya kontrol sipil serta munculnya ketidakselarasan sistemik antara norma pembatasan jabatan militer dan praktik penempatan prajurit aktif di lapangan. Metode penelitian yang digunakan adalah metode yuridis-normatif dengan menganalisis sinkronisasi vertikal perundang-undangan dan pendekatan kasus melalui sengketa konstitusional di Mahkamah Konstitusi. Hasil penelitian menunjukkan bahwa penempatan prajurit aktif pada kementerian non-limitatif dan Badan Usaha Milik Negara (BUMN) yang didasarkan pada regulasi di bawah undang-undang (seperti Keputusan Presiden, Keputusan Panglima TNI, dan Keputusan Menteri BUMN) melanggar asas lex superior derogat legi inferiori. Praktik penempatan tersebut melemahkan prinsip supremasi sipil, memicu tumpang tindih fungsi pertahanan dan administrasi pemerintahan, serta menciptakan dualisme akuntabilitas hukum yang mencederai integritas negara hukum yang demokratis.
